I. The following activities within the territory of the People's Republic of China*** and the State shall comply with this Law:
1, food production and processing (hereinafter referred to as food production), food sales and catering services (hereinafter referred to as food business);
2, the production and operation of food additives;
3, packaging materials, containers, detergents, sanitizers used for food and Tools and equipment used for food production and operation (hereinafter referred to as food-related products) production and operation;
4, the use of food additives and food-related products by food production and operation;
5, the storage and transportation of food;
6, safety management of food, food additives and food-related products.
Second, one of the following circumstances, food safety risk assessment should be carried out:
1, through the food safety risk monitoring or received reports found that food, food additives, food-related products may be a potential safety hazard;
2, for the development or revision of national standards of food safety to provide the scientific basis for the need to carry out risk assessment;
3, in order to determine the supervision and management of key areas, key varieties need to carry out risk assessment;
4, the discovery of new factors that may jeopardize food safety;
5, the need to determine whether a certain factor constitutes a food safety hazard;
6, the State Council administrative department of health believes that the need to carry out a risk assessment of other circumstances.
Legal basis: "Chinese People's **** and State Food Safety Law" Article 102 The State Council organizes the formulation of national emergency plans for food safety accidents. Local people's governments at or above the county level shall, in accordance with the provisions of the relevant laws and regulations and the higher people's government's emergency plan for food safety accidents, as well as the actual situation in the administrative region, formulate the administrative region's emergency plan for food safety accidents, and submit it to the higher level of the people's government for the record. Emergency response plan for food safety accidents should be food safety accident classification, accident disposal organization and command system and responsibilities, prevention and early warning mechanism, disposal procedures, emergency safeguard measures and other provisions. Food production and management enterprises should develop food safety accident disposal program, regularly check the implementation of the enterprise's food safety precautions, and timely elimination of potential accidents.
