Legal basis: Article 82 of People's Republic of China (PRC) Labor Contract Law. If the employer fails to conclude a written labor contract with the employee for more than one month and less than one year from the date of employment, it shall pay the employee twice the monthly salary.

Article 7 of the Regulations for the Implementation of the Labor Contract Law, if an employer fails to conclude a written labor contract with an employee within one year from the date of employment, it shall be complacent and pay the employee twice the monthly salary according to the provisions of Article 82 of the labor contract from the day after one month to the day before the expiration of one year, and the day after the expiration of one year from the date of employment shall be regarded as an open-ended labor contract with the employee, and it shall immediately conclude a written labor contract with the employee.
