Legal basis: Article 36 of People's Republic of China (PRC) Food Safety Law. Small food production and processing workshops and food vendors engaged in food production and marketing activities shall meet the food safety requirements stipulated in this Law that are suitable for the scale and conditions of their production and marketing, and ensure that the food they produce and market is hygienic, non-toxic and harmless. The food safety supervision and management department shall strengthen supervision and management. The local people's governments at or above the county level shall comprehensively manage food production and processing workshops and food vendors, strengthen services and unified planning, improve the production and operation environment, encourage and support them to improve their production and operation conditions, enter centralized trading markets, shops and other fixed places to operate, or operate in designated temporary business areas and time periods. Specific measures for the administration of food production and processing workshops and food vendors shall be formulated by provinces, autonomous regions and municipalities directly under the Central Government.
Article 33 of the Regulations on the Management of Small Food Workshops and Vendors in Shaanxi Province shall register with the local county (city, district) urban management comprehensive administrative law enforcement department or the city appearance and environmental sanitation department with a valid health certificate and obtain the food vendor registration card before engaging in food business activities. County (city, district) urban management comprehensive administrative law enforcement departments or city appearance and environmental sanitation departments shall, when accepting the application for registration of food vendors, make arrangements by drawing lots and shaking numbers according to the number of applicants and the actual capacity of designated regional stalls, and in accordance with the principles of openness, fairness and impartiality, and announce them to the public. When the county (city, district) urban management comprehensive administrative law enforcement department or the city appearance and environmental sanitation department registers food vendors, it shall record the name, ID number, address, business scope and other information of the operators, determine their business location and business hours, issue food vendor registration cards, and inform the county (city, district) food and drug supervision and management department and township (town) people's government and sub-district offices of the registration information in writing within ten working days. The food vendor registration card is valid for one year. If it is necessary to continue to operate after the expiration of the validity period, the operator shall go through the renewal formalities at the original registration and filing department one month before the expiration of the validity period. If an application for renewal is filed within the time limit, it shall be handled in accordance with the new application for registration and filing.
