Dalian Jinshitan National Tourist Resort Management Regulations
Chapter I General Provisions Article 1 In order to strengthen the management of Dalian Jinshitan National Tourist Resort, accelerate the construction of tourism facilities, the development of tourism, and promote the opening up and economic and social development, in accordance with national laws, regulations and relevant provisions, combined with the actual situation of Dalian, the enactment of these regulations. Article 2 Dalian Jinshitan National Tourist Resort (hereinafter referred to as the Resort) is approved by the State Council of the People's Republic of China *** and the State Council approved the establishment of a comprehensive tourist resort mainly to receive overseas tourists. Article 3 The construction and development of the resort area must meet the requirements of international tourism and Dalian City, economic and social development planning, adhere to the external and internal links, the introduction of advanced tourism products and projects and scientific management experience combined with the development of high foreign exchange earnings of the tourism industry as the mainstay of the development of the tourism industry as appropriate to the development of the tourism industry as a complement to the principle of productive enterprises. Article 4 The resort must strengthen the planning and management, to provide investors with a favorable investment environment. No unit or individual shall destroy the natural and humanistic landscapes as well as other tourism resources in the resort area. Article 5 Enterprises, other organizations and individuals inside and outside China are encouraged to invest in the resort area, develop tourism facilities (including infrastructure) and operate tourism projects and products. Article 6 Employees of enterprises, institutions and organizations in the resort area shall have the right to establish trade union organizations, carry out trade union activities and safeguard the lawful rights and interests of employees in accordance with law. Article 7 All units and individuals in the resort area must abide by the laws and regulations of the People's Republic of China*** and the State and these Regulations, and their legitimate rights and interests shall be protected by law. Chapter II Administration Article 8 The resort area set up a management committee (hereinafter referred to as the resort area management committee), under the leadership of the Dalian Municipal People's Government, the administrative affairs of the resort area to implement unified management. Article 9 The management committee of the resort area shall exercise the following powers and functions:

(1) to prepare the general plan and development plan of the resort area, and be responsible for organizing and implementing them after they are approved by the municipal people's government;

(2) to formulate and issue the relevant specific management regulations of the resort area according to law;

(3) to approve the investment projects of the resort area according to the regulations;

(4) to take charge of the Finance and taxation, labor and personnel, culture, education and health, planning and land, urban construction and real estate, environmental protection, road traffic, public security and fire fighting, tourism and other administrative management;

(e) responsible for the construction and management of various basic utilities in the resort area;

(f) according to the relevant provisions of the import and export business management of the resort area;

(g) to the municipal government departments in the (vii) Supervision and management of the work of the dispatching organizations of the municipal government departments in the resort area;

(viii) Supervision and management of the enterprises and institutions in the resort area in accordance with the law;

(ix) Other powers and functions conferred by the municipal government. Article 10 The resort area of Chinese personnel short-term business trip and sent abroad for training, or the resort area units and individuals to invite foreign personnel to the resort area to engage in business activities, the resort area management committee after examination, to the Municipal Foreign Affairs Office for approval procedures. (2) hotels (hotels), villas, catering and shopping and other service projects;

(3) productive enterprises serving the tourism industry;

(4) public utilities, infrastructure and other construction projects that are compatible with the resort area;

(5) Other tourism and service projects.

Projects that pollute the environment are prohibited in the resort area. Article 13 Within the resort area, foreign investors are allowed to operate wholly-owned tourism service projects specifically for overseas tourists as permitted by the laws of China. Article 14 Within the resort area, foreign exchange stores or joint venture or cooperative retail commercial enterprises may be opened upon approval; the first type of joint venture travel agency may be opened to operate overseas tourism business.

Specific approval procedures in accordance with relevant state regulations. Article XV in the resort area to set up enterprises, should be submitted to the resort area management committee to apply for the project, after approval, in accordance with the relevant provisions of the land use certificate, business license, financial and tax registration procedures. Article XVI of the resort area enterprises, may determine their own internal organization, staffing, recruitment conditions, wage distribution and determine the form of wages in accordance with the law.

Enterprises recruiting workers, not subject to district boundaries, employees are implemented labor contract system. Article 17 Enterprises must, in accordance with state regulations to ensure that employees enjoy labor, rest, vocational skills training, remuneration for labor, access to labor, safety, health protection and other rights provided by laws and regulations; in accordance with the provisions of the employees for old age, work-related injuries, medical care, unemployment, maternity and other social insurance; and strict implementation of the state's provisions on family planning, special protection of female workers and underage workers. It is strictly prohibited to recruit child laborers under the age of sixteen. Article 18 Enterprises in the resort shall establish financial and accounting books. For the import and export of duty-free and customs as bonded goods, materials, should establish a customs-approved special account books.

Enterprises shall submit accounting and statistical statements to the relevant departments and accept supervision as required. The annual accounting statements of an enterprise shall be verified and certified by an accountant registered in China.
