Article 1 In order to ensure the sustained and healthy development of the tea industry and promote the quality improvement and efficiency improvement of the tea industry, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Quality and Safety of Agricultural Products and relevant laws and regulations, combined with the actual situation of this province.
Article 2 These Regulations shall apply to activities related to the tea industry within the administrative area of this province.
The tea industry as mentioned in these Regulations includes tea planting, tea processing, brand building, cultural activities and related support and services.
The term "tea" as mentioned in these Regulations refers to the products processed from fresh leaves of Camellia plants of Theaceae.
Article 3 The development of tea industry adheres to the principles of ecological priority, green development, government promotion, enterprise subject, brand guidance, market guidance, scientific and technological support and quality assurance, so as to realize the unification of economic benefits, social benefits and ecological benefits.
Article 4 The people's governments at or above the county level in tea-producing areas shall strengthen their leadership over the development of tea industry, incorporate the development of tea industry into the national economic and social development plan and annual plan, incorporate the funds needed for the development of tea industry into the fiscal budget at the same level, establish and improve the coordination mechanism for promoting the development of tea industry, and improve the policies and measures for the development of tea industry.
Fifth administrative departments of agriculture and rural areas of the people's governments at or above the county level shall be responsible for the development of tea industry within their respective administrative areas.
Development and reform, education, science and technology, industry and information technology, finance, human resources and social security, natural resources, ecological environment, water conservancy, commerce, culture and tourism, health, market supervision and management, forestry, meteorology and other relevant departments shall, according to their respective responsibilities, do a good job in promoting the development of tea industry.
Township people's governments and sub-district offices shall strengthen the guidance, service and supervision of tea planting and tea processing activities within their respective administrative areas, and implement the responsibility of territorial management of tea quality and safety.
Village (neighborhood) committees shall assist township people's governments and sub-district offices in the development of tea industry. Encourage the formulation of village rules and regulations on tea quality and safety management.
Article 6 The people's governments at or above the county level in tea producing areas and their relevant departments shall establish a traceability and supervision system for tea quality and safety, organize and implement the clean work of tea planting, tea processing, packaging and transportation, and strengthen the supervision and management of tea quality and safety.
Seventh people's governments at or above the county level and their relevant departments should strengthen the publicity of tea industry, popularize tea knowledge and spread tea culture.
Encourage radio and television, websites, newspapers and media to strengthen the publicity of the tea industry.
Eighth to encourage and support social capital investment and participation in the development of tea industry.
Ninth support the cultivation and development of social organizations in the tea industry. Social organizations in the tea industry should standardize industry behavior, strengthen industry self-discipline and personnel training, guide tea operators to produce and operate according to law, establish and improve industry norms and reward and punishment mechanisms, provide services such as information, technology, training and intellectual property protection, and promote industry self-discipline and integrity construction.
Tenth units and individuals that have made outstanding contributions in the development of tea industry shall be commended and rewarded in accordance with the relevant provisions of the state and province.
Chapter II Tea Tree Planting
Article 11 The people's governments at or above the county level in tea-producing areas and their relevant departments shall promote the construction of tea planting bases in accordance with the development model of centralized contiguous, moderate scale, high quality and efficiency, standard and standardized, and supporting industries.
Twelfth provincial people's government administrative departments of agriculture and rural areas shall, jointly with the administrative departments of standardization, formulate technical regulations for standardized planting of tea trees.
Tea planting should be standardized according to the growth and development characteristics of tea trees and planting technical regulations.
Thirteenth tea producing areas at or above the county level people's government and its relevant departments shall do a good job in the construction of the following tea planting bases:
(a) to encourage the circulation of tea planting bases according to law and promote large-scale operation;
(two) to strengthen the protection of tea germplasm resources and optimize the breeding of tea varieties, promote improved tea varieties, and expand high-standard tea planting bases;
(three) the implementation of green prevention and control of pests and diseases, and the promotion of advanced technologies such as biological, physical and ecological coordination;
(four) support the tea planting base to carry out green, organic, geographical indications, good agricultural practices and other agricultural products certification;
(five) the establishment of more than 500 acres of contiguous tea planting base environmental monitoring and meteorological information system;
(six) to promote the use of organic fertilizers and special fertilizers for tea, and to implement soil testing and formula fertilization;
(seven) to promote the mechanization of picking fresh tea;
(eight) to support the construction of brand tea, specialty tea and tea export bases;
(nine) to strengthen the protection of ecological environment around the tea planting base.
Fourteenth tea planting enterprises and farmers' professional cooperative economic organizations shall establish records of tea planting and production, and truthfully record the following matters:
(a) the name, manufacturer, source, quantity, place of use, purpose and date of use of agricultural inputs such as fertilizers and pesticides;
(two) the occurrence and prevention of diseases, insects and weeds in tea planting bases;
(three) the date and output of picking fresh tea.
Tea planting and production records shall be kept for two years. It is forbidden to forge tea planting and production records.
Fifteenth tea planting base to prohibit the implementation of the following acts:
(a) the use of highly toxic, highly toxic and banned pesticides;
(two) the use of unregistered chemical herbicides, plant growth regulators and other pesticides on tea trees;
(three) the use of pesticides is not in accordance with the scope of use, method and dosage, technical requirements and precautions, and safe intervals;
(four) the use of budding elements and other unregistered fertilizers on tea trees;
(five) other acts prohibited by laws and regulations.
Article 16 The people's governments at the county level in tea producing areas may designate tea planting bases that meet the following conditions as tea ecological planting protection areas and implement origin protection:
(1) It has natural geographical conditions such as soil and climate suitable for the ecological planting of tea trees, with an altitude of over 600 meters and a distance of 500 meters from major highways;
(two) relatively contiguous planting of more than 500 acres;
(3) scientific planting methods and good quality control measures have been formed, which have certain advantages in resources, technology and benefits;
(4) The tea production is highly organized, and the product market sales are stable;
(five) other conditions that should be met by the tea ecological planting protection zone.
Specific areas of tea germplasm resources with local characteristics can be designated as tea ecological planting protection areas.
Article 17 The administrative departments of agriculture and rural areas of the people's governments at the county level in tea producing areas shall organize relevant departments, scientific research institutions and experts to demonstrate the designated tea ecological planting protection areas, listen to the opinions of the owners of tea planting bases and local villagers, report them to the people's governments at the county level for approval, and announce them to the public.
The tea ecological planting protection zone shall set up protection signs, delimit the scope of protection and determine the responsible subject.
Eighteenth provincial people's government administrative departments of agriculture and rural areas shall, jointly with relevant departments, formulate relevant standards for the construction of tea ecological planting protection zones, and standardize the construction of tea ecological planting protection zones.
Article 19 The people's governments at or above the county level in tea producing areas shall take measures to strengthen the infrastructure construction of tea ecological planting protection areas, and give priority to the infrastructure construction of roads, water conservancy, electricity and communications in tea ecological planting protection areas.
Twentieth individual growers, family farms, farmers' professional cooperative economic organizations and planting enterprises in the tea ecological planting protection zone shall operate tea gardens in accordance with green, organic and good agricultural standards.
Encourage and support individual growers, family farms, farmers' professional cooperative economic organizations and planting enterprises in the tea ecological planting protection zone to cultivate tea trees in accordance with international market quality standards.
Twenty-first tea ecological planting protection zone, in addition to the implementation of the provisions of article fifteenth, but also prohibit the following acts:
(a) occupation, destruction of tea ecological planting protection base;
(two) unauthorized felling or damage of trees in the tea ecological planting protection area;
(3) Discharging waste water and waste gas, dumping and piling up solid wastes and other toxic and harmful substances;
(four) the destruction of tea ecological planting protection zone infrastructure and protection signs;
(five) non-production motor vehicles enter the tea ecological planting protection zone;
(six) to carry out catering, barbecue, camping and other tourism activities that destroy the ecological planting environment of tea trees;
(seven) unauthorized construction, renovation and expansion of construction projects that affect the ecological planting of tea trees and destroy the production environment;
(eight) other acts prohibited by laws and regulations.
Chapter III Tea Processing
Twenty-second people's governments at or above the county level in tea producing areas and their relevant departments shall strengthen the guidance, service and supervision of tea processing.
Enterprises should adopt standardized and clean methods to produce and process tea.
Article 23 The administrative departments of agriculture and rural areas of the people's governments at or above the municipal level in tea producing areas shall, jointly with the administrative departments of standardization, organize the formulation of local standards for tea processing. Encourage social organizations and tea enterprises in the tea industry to formulate and use group standards and enterprise standards higher than national and local standards.
Twenty-fourth tea-producing areas at the county level people's government and its relevant departments shall do the following work:
(1) Cultivate leading enterprises in tea processing;
(two) to encourage and support the application for national quality management system certification, hazard analysis and critical control point certification, green, organic, geographical indications and other product certification;
(three) to support the construction of primary production, refining, deep processing and mechanized production lines of tea;
(four) to support the construction of cold chain facilities such as enterprises and farmers' professional cooperative economic organizations;
(five) support the establishment and improvement of fresh tea leaf trading market.
Article 25 Production and business entities such as tea planting enterprises, tea processing enterprises, farmers' specialized cooperative economic organizations and family farms shall establish a self-inspection system for the quality and safety of fresh tea leaves, regularly check and evaluate the production status of tea processing, establish tea processing records and files, and truthfully record the following matters:
(a) the variety, grade, quantity, time of entering the factory (factory), and the name, address and contact information of the supplier, and keep the relevant documents;
(two) the type, grade, quantity, storage time and storage conditions of the tea produced.
The storage period of tea processing records and vouchers shall not be less than one year after the expiration of the shelf life of tea products. Forgery of tea processing records is prohibited.
Twenty-sixth encourage and support the development and processing of tea derivatives such as food, beverage, handicrafts and daily necessities with fresh tea leaves, semi-finished tea products, finished tea or by-products as raw materials.
Tea derivatives processing should comply with laws and regulations and related technical standards.
Twenty-seventh in addition to the production and processing of tea derivatives, it is forbidden to add sugar, sweeteners, pigments, flavors and other foreign substances in tea processing.
It is forbidden to adulterate or adulterate tea in the production and operation, pass the fake as the real, pass the inferior as the good, and pass the unqualified products off as qualified products.
Chapter IV Brand Building
Twenty-eighth provincial people's government and its relevant departments shall, in accordance with the principles of government guidance, industry guidance, honesty, excellent quality and enterprises as the main body, establish an operating mechanism for the development, promotion, protection and utilization of tea brands. Focus on the development of Guizhou green tea, Guizhou black tea, Guizhou matcha, Guizhou black tea and other popular tea brands, focus on promoting the protection of origin and brand building, and support enterprise product brands.
Article 29 The administrative department of standardization of the provincial people's government shall, jointly with the administrative department of agriculture and rural areas, formulate and improve the quality standards of tea public brands and well-known sub-brands, including external forms, internal quality, packaging labels and other contents.
Thirtieth to encourage the use of public brands of tea, and support the expansion and strengthening of well-known sub-brands and enterprise product brands.
Thirty-first tea public brand holders should formulate management regulations and implement unified management. Management regulations should include quality traceability, supervision and inspection, etc.
Authorized users of tea public brands shall implement brand management regulations.
Any unit or individual may supervise and report acts that violate the provisions on the administration of tea public brands.
Article 32 The people's governments at or above the county level in the tea producing areas shall protect the tea trademarks or logos that have obtained famous products such as Chinese time-honored brands, geographical indications and national climate signs.
Thirty-third people's governments at or above the county level and their relevant departments can hold brand tea exhibition activities, organize and guide enterprises to participate in various tea-related fairs.
Support all kinds of production and business entities to promote and sell brand tea in traditional media, new media and self-media.
Article 34 The administrative departments of transportation and market supervision and management of the people's governments at or above the county level shall support the promotion of public brands in major traffic trunk lines and public places, open brand tea stores and carry out brand tea promotion activities.
Thirty-fifth encourage tea enterprises to develop marketable brand tea products, innovate brand marketing methods, broaden brand circulation channels, and build brand loyal consumer groups.
Thirty-sixth support tea industry social organizations and tea enterprises to establish Guizhou tea brand promotion centers at home and abroad.
Encourage brand tea products in this province to enter airports, railways, hotels, tourist attractions, expressway service areas, supermarket chains and e-commerce platforms inside and outside the province for promotion and sales.
Article 37 Encourage the deep exploration of the production, life, ecology and cultural value of tea, promote the deep integration of tea industry development with intangible cultural heritage, folk skills, rural customs and beautiful countryside construction, strengthen the protection and inheritance of old crafts, time-honored brands and old varieties, and cultivate tea industry brands with cultural connotations.
Encourage brand value evaluation, brand identification and release, so as to expand brand publicity and improve brand awareness and influence.
