it takes 21 working days from the date of acceptance of the catering license to obtaining evidence. To apply for a food business license, one should first obtain a business license and other legal subject qualifications. Enterprise legal person, partnership enterprise, sole proprietorship enterprise, individual industrial and commercial households, etc., take the subject specified in the business license as the applicant. For the canteens of government agencies, institutions, social organizations, private non-enterprise units, enterprises and other bidding units, the applicant shall be the subject specified in the registration certificate or business license of the legal person registration certificate of government agencies or institutions and social organizations. The approximate time required can be summarized as follows:
1. After acceptance, make a review decision of approval, rectification within a time limit or approval or disapproval within 21 days;
2. register at the registration window within 11 days after approval, and get the food hygiene license.
1. The catering service license, that is, the business license of the catering industry in China, was officially opened according to the Food Safety Law that came into effect on June 1, 2119, replacing the food hygiene license that has been used for decades.

II. Licensing conditions
1. Having a place for food raw material processing, food processing and storage suitable for the variety and quantity of food to be produced and supplied, keeping the environment of the place clean and tidy, and keeping a prescribed distance from toxic and harmful places and other pollution sources;
2. Having business equipment or facilities suitable for the variety and quantity of food to be produced and supplied, and corresponding equipment or facilities for disinfection, changing clothes, washing hands, lighting, lighting, ventilation, freezing and refrigerating, dust prevention, fly prevention, rodent prevention, insect prevention, washing, wastewater treatment and garbage and waste storage;
3. Having food safety management personnel who have been trained in food safety and meet the relevant conditions, and rules and regulations that are suitable for the actual situation of the unit to ensure food safety;
4. Have a reasonable layout and processing flow to prevent cross-contamination between food to be processed and directly imported food, raw materials and finished products, and avoid food contact with toxic and unclean substances;
5. Other conditions stipulated by the State Food and Drug Administration or the food and drug administrations of provinces, autonomous regions and municipalities directly under the Central Government.
III. Materials to be submitted for handling the catering license:
(1) Application for the Catering Service License;
(2) the certificate of pre-approval of the name (a copy of the business license can be provided for those who have engaged in other businesses);
(3) a copy of the identity certificate of the legal representative (person in charge or owner);
(4) The directly responsible person in charge has no violation certificate;
(5) certification materials of food safety management personnel trained by the food and drug supervision and administration department;
(6) certificate of health examination and food safety knowledge training for catering service employees;
(7) Relevant legal use certificates such as house ownership certificate or lease agreement of catering service places. The location of catering service places should meet the requirements (the location is more than 25m away from pollution sources such as cesspits, sewage pools, exposed garbage dumps (stations) and dry toilets, and it is set outside the influence of dust, harmful gases, radioactive substances and other diffuse pollution sources);
(8) the location map, floor plan, equipment layout, processing flow, sanitary facilities and other schematic diagrams and descriptions of the catering service business premises (the total area of the business premises, the names and areas of each function room, the positions of sanitary facilities such as cleaning and disinfection, the positions of doors and windows, and the direction of people flow and logistics shall be indicated);
(9) various rules and regulations to ensure food safety.
Legal basis
Article 17 of the Measures for the Administration of Food Business License stipulates that local food and drug supervision and administration departments at or above the county level shall make a decision on whether to approve the administrative license within 21 working days from the date of accepting the application. If it is necessary to extend the time limit due to special reasons, it may be extended for 11 working days with the approval of the person in charge of this administrative organ, and the applicant shall be informed of the reasons for extending the time limit.
Article 18 of the Measures for the Administration of Food Business License stipulates that the local food and drug supervision and administration department at or above the county level shall, based on the examination of the application materials and on-site inspection, make a decision on granting the business license to those who meet the requirements, and issue the food business license to the applicant within 11 working days from the date of making the decision; If it does not meet the requirements, it shall make a written decision on disapproval in time and explain the reasons, and inform the applicant that he has the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.
