chapter I general provisions article 1 in order to strengthen the management of building decoration activities, standardize the market order, ensure the quality and safety of building decoration projects, and safeguard the legitimate rights and interests of the parties involved in building decoration activities, these measures are formulated in accordance with the construction law of the people's Republic of China, the regulations on quality management of construction projects, the regulations on safety production management of construction projects and other relevant laws and regulations, and combined with the actual situation of this municipality. Article 2 These Measures shall be observed when engaging in building decoration activities within the administrative area of this Municipality and implementing the supervision and management of building decoration activities.
if there are other provisions in laws and regulations on architectural decoration activities such as ancient buildings, memorial buildings, village and town buildings, those provisions shall prevail. Article 3 The term "building decoration" as mentioned in these Measures refers to the activities of using decoration materials, components and equipment to decorate the exterior and interior of buildings and structures to meet certain environmental quality and use requirements.
the term "decorator" as mentioned in these measures refers to the owner, user or manager who decorates buildings and structures.
the "public buildings" as mentioned in these measures refer to buildings such as office buildings, shopping malls, hospitals, exhibition halls, railway stations, airports and subway stations for people to engage in public activities.
residential buildings mentioned in these measures refer to buildings for people to live in, including residential and non-residential residential buildings. Residential refers to the building for family living; Non-residential residential buildings refer to residential buildings for non-family use such as student dormitories and staff dormitories. Article 4 The municipal administrative department of urban and rural construction shall be responsible for the supervision and management of the decoration activities of public buildings and non-residential buildings within the administrative area of this Municipality. The municipal real estate administrative department is responsible for the supervision and management of residential decoration activities within the administrative area of this Municipality.
the building decoration management department determined by the county (city, district) people's government is responsible for the supervision and management of building decoration activities within its jurisdiction according to the principle of territorial management and division of responsibilities.
relevant administrative departments such as development and reform, natural resources and planning, ecological environment, comprehensive law enforcement of urban management, market supervision, etc. shall, within the scope of their respective duties, do a good job in the supervision and management of building decoration.
street offices and township people's governments shall, in accordance with the provisions of these measures, do a good job in building decoration. Article 5 Building decoration shall comply with the relevant provisions of urban and rural planning, environmental protection, safety and fire control, and shall not harm the interests of the state, the public and the legitimate rights and interests of others.
encourage the adoption of new technologies, new materials, new processes and new equipment that are environmentally friendly and energy-saving. Chapter II General Provisions Article 6 The contracting parties of building decoration projects shall sign a written contract according to law.
promote the use of model text of building decoration contract. The model contract text shall be formulated by the municipal administrative department of urban and rural construction in conjunction with the municipal market supervision and management department. Seventh non-owners of buildings and structures for decoration, shall obtain the written consent of the owner. Eighth building decoration design units shall design in accordance with the engineering construction norms and technical standards, and be responsible for the design quality.
the construction unit of building decoration shall carry out the construction according to the engineering design drawings, construction specifications and technical standards, and be responsible for the construction quality.
The building decoration supervision unit shall carry out supervision in accordance with relevant specifications, technical standards, design documents and project contract, and bear corresponding supervision responsibilities. Article 9 Materials, components and equipment used for building decoration shall meet the relevant national design requirements, product quality, energy-saving and harmful substance limit and combustion performance control standards, and be accompanied by product quality inspection certificate and product name, specification, model, name and address of the manufacturer indicated in Chinese.
it is forbidden to use building decoration materials, components and equipment that are unqualified in quality, explicitly eliminated by the state or do not meet the relevant standards of environmental pollution control and energy conservation. Article 11 No decoration shall be carried out under any of the following circumstances:
(1) Buildings and structures that have exceeded their designed service life and failed the safety inspection;
(2) The main structure of a new building or structure has not been accepted or failed to pass the acceptance. Eleventh building decoration activities, the following acts are prohibited:
(a) without the original design unit or design units with corresponding qualifications put forward a design plan, unauthorized changes to the main building, load-bearing structure;
(2) Dismantling and refitting pipeline gas facilities by themselves;
(3) Demolition of building facilities or components related to fire safety;
(4) damage the original energy-saving facilities of the building;
(5) occupying public space or damaging public parts and facilities;
(6) changing the structure and supporting facilities of buildings and structures, which infringes upon the legitimate rights and interests of others;
(7) excavating the ground floor of a building to expand the use space;
(8) other behaviors that affect the safety of building structure and use. Twelfth building decoration construction units should establish and improve the construction quality inspection system, strict process management, quality inspection and record of concealed works.
the building decoration construction unit shall formulate the safety production management system and the emergency plan for safety accidents, ensure the safety of decoration construction, and undertake the responsibility for project safety production according to law.
the building decoration construction unit shall strengthen the management of the construction site, implement the real-name registration system of labor and employment according to law, and publicize the name of the unit, the name of the person in charge of construction, contact information, commencement and completion dates and complaint telephone numbers at the construction site.
