Article 18 of the "Regulations on the Implementation of the Regulations on Supervision of Labor Security," Article 18 of the complaint meets the following conditions, the administrative department of labor security shall accept the complaint within five working days from the date of receipt of the complaint in accordance with the law, and the date of acceptance of the case to investigate and deal with:
(a) violation of labor security laws occur within two years;
(b) (ii) a clear employer under complaint ) There is a clear employer under complaint, and the legitimate rights and interests of the complainant are infringed upon by the employer under complaint for violation of labor security laws;
(c) It is within the purview of the labor security supervision and is under the jurisdiction of the administrative department of labor security that receives the complaint.
The administrative department of labor security shall decide within five working days from the date of receipt of the complaint that the complaint does not meet the requirements of paragraph 1 (a) and notify the complainant in writing.
For complaints that do not meet the provisions of paragraph 1 (b), the labor security inspection agency shall inform the complainant to correct the complaint materials.
For complaints that do not meet the provisions of paragraph 1 (c), that is, complaints that do not fall within the purview of the labor security supervision, the labor security inspection agency shall inform the complainant; for complaints that fall within the purview of the labor security supervision, but do not fall within the jurisdiction of the administrative department of labor and security that accepts the complaint, the complainant shall be informed to the relevant administrative department of labor and security.
