The general office of the people's government at or above the county level is the competent department of government information disclosure in this administrative region, and is responsible for promoting, guiding, coordinating and supervising the government information disclosure in this administrative region.
The Township People's Government shall designate a person to be responsible for the information disclosure of the government at the corresponding level. Article 6 The daily work of the government information disclosure of administrative organs shall be undertaken by the agency in charge of comprehensive coordination in the general office (office). Specific responsibilities are:
(a) to undertake the government information voluntarily disclosed by administrative organs, and to maintain and update the government information voluntarily disclosed by administrative organs;
(2) Organizing confidentiality review;
(three) to accept and handle the application for government information disclosure submitted to this organ;
(four) to organize the preparation of government information disclosure guidelines, government information disclosure catalogue and annual work report on government information disclosure;
(5) Duties related to the disclosure of government information as prescribed by this organ. Article 7 The administrative organ shall establish and improve the working system of government information disclosure, such as confidentiality review, voluntary disclosure, disclosure upon application, information release and registration. Article 8 The confidentiality review of government information disclosure shall adhere to the principles of "who is open and who is responsible" and "review first and then open".
When drafting an official document, the administrative organ shall make it clear whether the official document belongs to the nature of voluntary disclosure, disclosure upon application or non-disclosure.
Before the administrative organ discloses the government information, it shall examine the government information to be disclosed in accordance with the law of People's Republic of China (PRC) on guarding state secrets and other laws, regulations and relevant provisions of the state.
When the administrative organ is not sure whether the government information can be made public, it shall report it to the relevant competent business department or the secrecy administrative department at the same level for confirmation, and the relevant competent business department or the secrecy administrative department shall make a reply within 5 working days. Ninth administrative organs shall establish and improve the coordination mechanism of government information release. Government information involving other administrative organs shall be communicated and confirmed to ensure the accuracy and consistency of government information released.
If the administrative organ needs to approve the disclosure of government information according to the relevant provisions of the state and this province, it shall obtain approval before the release. Tenth administrative organs should establish and improve the information monitoring and clarification mechanism. When an administrative organ discovers false or incomplete information that affects or may affect social stability and disrupt social management order, it shall issue accurate government information within its scope of duties to clarify it. Article 11 The disclosure of government information by administrative organs shall not endanger national security, public security, economic security and social stability. Chapter II Active Disclosure of Government Information Produced by Administrative Organs Article 12 The administrative organ that produces the government information is the subject of disclosure.
Government information produced by two or more administrative organs shall be made public by the producing organs respectively. Thirteenth government information obtained by administrative organs from citizens, legal persons or other organizations according to law shall be made public by the administrative organs that keep the government information. Article 14 Where an administrative organ is dissolved, merged or its functions are adjusted, the government information produced and obtained by it shall be made public by the administrative organ that continues to perform its functions. Fifteenth administrative organs in addition to the voluntary disclosure of the "Regulations" provisions of the ninth, tenth, eleventh and twelfth government information, but also should focus on the disclosure of the following government information:
(1) Information on administrative examination and approval;
(2) Financial budget and final accounts, expenses for going abroad on business, purchase and operation expenses of official vehicles, official reception expenses and other information;
(three) information on the construction plan of affordable housing projects, the start and completion of the projects, and the allocation and withdrawal of affordable housing;
(four) food and drug safety standards, production and business license, special inspection and rectification information;
(five) environmental verification and approval, environmental status bulletin and major environmental emergencies and other information;
(six) illegal bidding behavior and treatment, state-owned funds holding or leading position in accordance with the law must be tender and other information;
(seven) production safety accident early warning and prevention, response and disposal, investigation and processing information;
(eight) agricultural land conversion approval, collective land acquisition approval, land acquisition announcement, land acquisition compensation and resettlement announcement, collective land acquisition closed;
(nine) information such as the items, prices, basis, implementation time and scope of government-guided prices, government pricing and administrative fees;
(ten) the province's college enrollment, financial and other information;
(eleven) the audit results of budget implementation and other financial revenue and expenditure information;
(twelve) other information that the government at the corresponding level has decided to voluntarily disclose.
