Article 1 In order to strengthen the management of cattle and sheep slaughter, ensure the quality of cattle and sheep products, safeguard the health of residents and respect the customs and habits of ethnic minorities, these measures are formulated according to the Law of People's Republic of China (PRC) on Animal Epidemic Prevention, the Regulations of the State Council on the Management of Pig Slaughtering and other laws and regulations, with the authorization of the provincial government and combined with the actual situation of this Municipality.

Second units and individuals engaged in cattle and sheep slaughter business within the administrative area of this Municipality shall abide by these measures.

Article 3 Within the administrative area of this Municipality, a system of slaughtering cattle and sheep at designated points and centralized quarantine shall be implemented. Except in rural areas, people kill themselves and feed themselves.

Article 4 The municipal administrative department of commerce shall be responsible for the planning, guidance, supervision, coordination and service of the cattle and sheep slaughtering industry within the administrative area of this Municipality.

County (city) district administrative department of commerce is responsible for the supervision and management of cattle and sheep slaughter within their respective administrative areas.

The administrative departments of agriculture, industry and commerce, environmental protection, health, quality supervision, public security and ethnic affairs shall, according to their respective duties, do a good job in the supervision and management of cattle and sheep slaughter and the circulation of cattle and sheep products.

Township (town) people's governments and sub-district offices shall implement corresponding supervision and management responsibilities in accordance with the principle of territorial management.

Relevant social organizations shall cooperate with the government and its relevant departments to do a good job in the supervision and management of cattle and sheep slaughter.

Fifth any unit or individual has the right to report violations of these measures. The people's governments at or above the county level or the relevant departments shall commend and reward those who report meritorious service.

Article 6 The layout planning of cattle and sheep slaughtering plant (field) shall be organized by the municipal administrative department of commerce in conjunction with the administrative departments of planning, land, agriculture, industry and commerce, environmental protection, health, ethnic affairs, etc. according to the overall planning of urban and rural planning and land use in Kunming, and implemented after being reported to the Municipal People's Government for approval.

Article 7 Cattle and sheep slaughtering plants (fields) located in the main urban area of this Municipality, Chenggong New District and the planning area of Airport Economic Zone shall implement large-scale and mechanized slaughtering, and other areas shall gradually implement it.

Eighth cattle and sheep slaughtering plant (field) shall meet the following conditions:

(1) Conforming to the layout plan; (2) The site selection shall not be within the protection scope of drinking water surface source protection areas, scenic spots and cultural relics protection areas, and shall not be far away from toxic and harmful places, and shall not hinder and affect the life of surrounding residents and activities in public places; (3) There are inspection rooms, waiting rooms, slaughter rooms, emergency slaughter rooms, isolation rooms, hanging slaughter facilities and vehicles that meet the requirements of the state and are suitable for the slaughter scale; (four) the necessary inspection and quarantine equipment, disinfection and anti-fly, anti-mouse facilities and harmless treatment facilities; (five) there are water supply and drainage facilities suitable for the scale of slaughter, and the production water should meet the standards prescribed by the state; (6) Having pollutant treatment facilities that meet the requirements of environmental protection; (seven) slaughter technicians who have obtained health certificates according to law; (eight) meet other conditions stipulated by laws, regulations and national mandatory standards.

Ninth the establishment of cattle and sheep slaughtering plant (field), shall submit a written application to the local county (city) District Department of commerce. The county (city) district commerce department shall, within 10 days from the date of receiving the application, conduct preliminary examination in conjunction with the relevant departments of agriculture, health and environmental protection according to the conditions stipulated in these Measures. Those who pass the preliminary examination shall be reported to the municipal administrative department of commerce, which shall, jointly with relevant departments, conduct the preliminary examination within 65,440 days. After the completion of the project, the Municipal People's Government shall organize the relevant departments to carry out acceptance, and issue certificates and signs of slaughtering cattle and sheep if they pass the acceptance. The applicant shall go through the registration formalities with the administrative department for industry and commerce with the certificate of designated slaughter.

Without a fixed point, no unit or individual may engage in cattle and sheep slaughter business activities.

Tenth the establishment of Muslim cattle and sheep slaughtering plant (field), shall abide by the relevant provisions of the national, provincial and municipal halal food management, halal food business license procedures in accordance with the law.

The slaughtering activities of Muslim cattle and sheep slaughtering plants (fields) shall be carried out in accordance with the customs and habits of ethnic minorities who believe in Islam.

Eleventh cattle and sheep slaughtering plant (field) shall comply with the following provisions:

(1) The slaughtered cattle and sheep are accompanied by the quarantine certificate issued by the supervising agency for animal health in the place of origin; (2) Cattle and sheep products that have passed the quarantine inspection shall be stamped with the inspection seal by the supervising agency for animal health, and have the quarantine certificate. Cattle and sheep products that have not passed quarantine inspection and quarantine inspection shall not leave the factory (field); (three) under the supervision of animal health and quarantine officers, harmless treatment of diseased meat; (four) to ensure the normal operation of harmless, harmless and environmentally friendly treatment facilities and equipment.

Twelfth no unit or individual may inject water or other substances into cattle and sheep or cattle and sheep products.

Thirteenth cattle and sheep slaughtering plant (field) shall establish a registration system for the quarantine results and treatment of cattle and sheep and their products entering and leaving the factory (field), and the registration materials shall be kept for more than two years.

Fourteenth cattle and sheep products sold in the wholesale market shall also have the quarantine certificate of the animal health supervision institution, the seal of meat quality inspection and the certificate of designated slaughter of cattle and sheep.

Muslim cattle and sheep products must also have a Muslim food license.

Fifteenth markets, supermarkets, hotels, restaurants, collective catering units and other sales and processing units of cattle and sheep products shall purchase qualified cattle and sheep products slaughtered in designated slaughterhouses (fields).

Sales and processing of Muslim cattle and sheep products, should buy Muslim slaughtering plant (field) of qualified cattle and sheep products.

Sixteenth fresh cattle and sheep products from other places to enter the city for sale shall meet the following requirements:

(a) products slaughtered by cattle and sheep slaughter plants (fields) approved by the people's governments at or above the city (state) level of origin; (2) Having passed the re-inspection by the municipal supervising agency for animal health; (three) the use of special means of transport that meet the national hygiene standards; (four) attach a detailed list of each batch of products, indicating the name of the designated slaughtering plant (field), the source of cattle and sheep, quarantine certificate, quantity, license plate number and other product information.

Article 17 Units and individuals engaged in the wholesale business of cattle and sheep products shall establish accounts for the sales of cattle and sheep products, and truthfully record the varieties, specifications, quantity, flow direction and other contents of wholesale products.

Units and individuals selling cattle and sheep products shall establish and implement the incoming inspection system, verify the business qualifications of suppliers, verify the product certificate and product identification, establish an incoming ledger, and truthfully record the product name, specifications, quantity, suppliers and their contact information, purchase time and other contents.

Article 18 Anyone who violates the provisions of the second paragraph of Article 9 of these Measures shall be banned by the comprehensive administrative law enforcement department, and his slaughtering tools, slaughtered cattle and sheep and their products and illegal income shall be confiscated, and a fine of more than 3 times the value of goods 1 times shall be imposed, with the maximum fine not exceeding 30,000 yuan; If it is difficult to determine the value of the goods, the unit shall be fined 1 10,000 yuan but not more than 30,000 yuan, and the individual shall be fined 2,000 yuan but not more than 6,000 yuan.

Counties (cities) that have not established comprehensive administrative law enforcement shall be banned and fined by the administrative department of commerce.

Nineteenth in violation of the provisions of Article 11 (1), (3) and (4) of these measures, the administrative department of commerce shall order it to make corrections within a time limit and impose a fine of more than 5000 yuan 10000 yuan; If no correction is made within the time limit, it shall be ordered to suspend business for rectification.

In violation of the provisions of Item (2) of Article 11, the competent department of commerce shall order it to suspend business for rectification, confiscate the products of cattle and sheep and the illegal income, and impose a fine of 1 times and less than 3 times the value of the goods, with a maximum of 30,000 yuan, and impose a fine of 1 10,000 yuan on the main responsible person; If the value of the goods is difficult to determine, a fine of not less than 3,000 yuan but not more than 9,000 yuan shall be imposed; Causing serious consequences, cancel the qualification of its cattle and sheep slaughtering plant (field); If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 20 In violation of the provisions of Article 12 of these measures, cattle and sheep, cattle and sheep products, water injection tools and equipment and illegal income injected with water or other substances shall be confiscated by the competent commercial department, and a fine of 1 times or more and less than three times the value of the goods shall be imposed, with a maximum of 30,000 yuan, and the main person in charge of the cattle and sheep slaughtering plant (field) shall be fined 1 10,000 yuan. If the value of the goods is difficult to determine, the cattle and sheep slaughtering plant (field) shall be If a crime is constituted, criminal responsibility shall be investigated according to law.

Cattle and sheep slaughtering plant (field) that injects water or other substances into cattle and sheep products shall be ordered by the administrative department of commerce to suspend business for rectification in addition to punishment in accordance with the provisions of the preceding paragraph; Causing serious consequences, or injecting water or other substances into cattle and sheep products for more than two times, the qualification of designated slaughtering plant (field) for cattle and sheep will be cancelled.

Twenty-first in violation of the provisions of article thirteenth of these measures, the administrative department of commerce shall give a warning and impose a fine of more than 3000 yuan 1000 yuan.

Twenty-second in violation of the provisions of Article 10, Article 14, Article 15, Article 16 and Article 17 of these measures, the administrative departments of industry and commerce, agriculture, health and ethnic affairs shall be punished according to relevant laws, regulations and rules.

Twenty-third law enforcement supervision and inspection personnel shall produce law enforcement certificates when conducting law enforcement supervision and inspection. The units and individuals under inspection shall cooperate and shall not obstruct or refuse the inspection.

Article 24 If the staff of the administrative department of commerce and other relevant departments abuse their powers, neglect their duties or engage in malpractices for selfish ends in the supervision and management of cattle and sheep slaughter, they shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Twenty-fifth the term "cattle and sheep products" as mentioned in these Measures refers to the unprocessed meat, fat, organs, bones, heads, hooves, skins and tails of cattle and sheep after slaughter.
