article 1 these provisions are formulated in accordance with the law of the people's Republic of China on the prevention and control of air pollution, the regulations on the safety management of fireworks and firecrackers and other relevant laws and regulations, in combination with the actual situation of this municipality, with a view to strengthening the management of fireworks and firecrackers, ensuring the safety of the public and personal and property, and preventing and controlling environmental pollution.

article 2 these provisions shall apply to the sale, discharge and related activities of fireworks and firecrackers within the administrative area of this municipality.

article 3 the sale and discharge of fireworks and firecrackers are prohibited in the urban built-up areas of Wuxing district, nanxun district, Deqing county, Changxing county and Anji county. The specific scope of urban built-up areas shall be determined by the municipal and county people's governments according to law and announced to the public.

the county (district) people's government may, according to the actual situation of its administrative area, determine other areas where the sale and discharge of fireworks and firecrackers are prohibited.

Article 4 It is forbidden to set off fireworks and firecrackers in the following places outside the area specified in Article 3 of these Provisions and within a distance of 51 meters around them:

(1) the office of state organs;

(2) crowded places such as cinemas (theatres) and tourist attractions;

(3) Construction sites, high-rise buildings and underground buildings;

(4) First-class protected areas for drinking water sources;

(5) places for religious activities;

(6) military restricted zones and military administrative zones;

(7) other places prohibited by laws, regulations and rules.

article 5 the people's governments of cities and counties (districts) shall set up obvious signs or make public announcements in areas and places where the sale and discharge of fireworks and firecrackers are prohibited.

No unit or individual may deface or destroy the sign prohibiting the sale and discharge of fireworks.

Article 6 During the period of heavily polluted weather, it is forbidden to set off fireworks and firecrackers within the administrative area of this Municipality.

the municipal people's government shall timely release the warning information of heavy polluted weather and the announcement prohibiting the discharge of fireworks and firecrackers to the public through the news media.

article 7 these provisions shall be implemented by the people's governments at all levels in this municipality. City, county (District) people's government should strengthen leadership, co-ordinate the major issues in the work of prohibiting the sale and discharge of fireworks and firecrackers.

the public security department is responsible for the safety management of fireworks and firecrackers, and the safety production supervision and management department is responsible for the safety production supervision and management of fireworks and firecrackers. Relevant departments in charge of quality and technical supervision, market supervision and management, comprehensive administrative law enforcement, housing and urban and rural construction, urban and rural planning, environmental protection, education, meteorology, etc. shall, according to their respective functions and duties, strengthen cooperation and linkage, and do a good job in the management of fireworks sales and discharge.

article 8 state organs, social organizations, enterprises, institutions and other organizations in this municipality shall carry out publicity and education activities prohibiting the sale and discharge of fireworks and firecrackers.

news media such as television, radio, newspapers, and the internet should carry out public welfare propaganda to prohibit the sale and discharge of fireworks and firecrackers and to change customs.

The autonomy convention encouraging villages, communities and residential quarters stipulates that fireworks and firecrackers are prohibited.

article 9 if it is really necessary to hold a fireworks show or other large-scale fireworks display in the area specified in article 3 of these provisions for major public events determined by the municipal people's government, the organizer shall apply to the public security department for permission according to the provisions, conditions and procedures of hierarchical management.

when the public security department makes a decision to grant permission, it shall announce the time, place, type, specification and quantity of the permitted discharge to the public.

article 11 the layout of retail outlets of fireworks and firecrackers outside the region as stipulated in article 3 of these provisions shall be determined by the county (district) safety production supervision and management department after consulting the opinions of the township (town) people's government and the subdistrict office in accordance with the principles of strict access, safety guarantee and reasonable layout.

The retail outlets of fireworks and firecrackers should implement the sales in specialized stores and set up obvious sales signs; Special counter sales can be implemented in rural areas, and special store sales can be gradually implemented.

article 11 fireworks wholesale enterprises and retail outlets shall establish business files, truthfully record the product names, specifications, quantities, shelf life and other contents of storing and selling fireworks and firecrackers, and issue and keep relevant vouchers. Archives and vouchers shall be kept for a period of not less than two years.

Article 12 Buyers shall purchase fireworks and firecrackers from legal wholesale enterprises and retail outlets, and shall not purchase illegally sold fireworks and firecrackers, and discharge fireworks and firecrackers in a safe and civilized manner according to the discharge instructions.

advocate the use of safe and environmentally friendly alternative products for fireworks and firecrackers.

article 13 no unit or individual may store fireworks and firecrackers in the area specified in article 3 of these provisions.

outside the areas specified in article 3 of these regulations, non-fireworks wholesale enterprises and retail outlets shall not store more than 31 kilograms of fireworks.

article 14 units and individuals engaged in catering, accommodation, wedding ceremonies and funeral services within the areas and places specified in articles 3 and 4 of these provisions shall inform the clients of the regulations prohibiting the discharge of fireworks and firecrackers, and shall not provide relevant services for the discharge of fireworks and firecrackers.

article 15 citizens, legal persons and other organizations have the right to report violations of laws and regulations on the management of fireworks and firecrackers to the public security department and the safety production supervision and management department.

when grass-roots mass autonomous organizations and property service enterprises find violations of laws and regulations on the management of fireworks and firecrackers, they should discourage them and report to the public security department and the safety production supervision and management department in time.

the public security department and the supervision and administration department of production safety shall accept it and investigate it in time; If it is verified, the whistleblower shall be given appropriate rewards in accordance with relevant regulations.

article 16 fireworks wholesale enterprises and retail operators who sell fireworks in violation of article 3 of these provisions shall be ordered by the safety production supervision and management department to stop selling, and the wholesale enterprises shall be fined between 11,111 yuan and 51,111 yuan, and the retail operators shall be fined between 1,111 yuan and 11,111 yuan.

Article 17 Whoever, in violation of the provisions of Articles 3, 4 and 6 of these Provisions, sets off fireworks and firecrackers in areas where fireworks and firecrackers are prohibited and during heavily polluted weather, shall be ordered by the public security department to stop the discharge and be fined between 111 yuan and 511 yuan; If it constitutes a violation of public security administration, it shall be punished according to law.

article 18 whoever, in violation of the second paragraph of article 5 of these provisions, defaces or destroys the sign prohibiting the sale and discharge of fireworks and firecrackers shall be ordered by the public security department to restore the original state and may be fined from 111 yuan to 511 yuan.

article 19 in violation of the provisions of article 11 of these provisions, failing to establish business files, or failing to issue and keep vouchers as required, the safety production supervision and management department shall order it to make corrections within a time limit; If no correction is made within the time limit, a fine of not less than 1,111 yuan but not more than 11,111 yuan shall be imposed on wholesale enterprises, and a fine of not less than 111 yuan but not more than 1,111 yuan shall be imposed on retail operators.

Article 21 Where fireworks and firecrackers are stored in violation of Article 13 of these Provisions, the illegally stored fireworks and firecrackers shall be confiscated by the public security department, and a fine ranging from 111 yuan to 511 yuan may be imposed.

Article 21 If fireworks and firecrackers are set off in violation of the provisions of Article 14 of these Provisions and the obligation of informing is not fulfilled, the public security department shall impose a fine of more than 211 yuan and less than 511 yuan; Those who provide services related to the discharge of fireworks and firecrackers shall be ordered by the public security department to make corrections and be fined between 1,111 yuan and 3,111 yuan.

article 22 where anyone violates these regulations and is subject to administrative punishment, relevant information shall be recorded in social credit files according to law.

Article 23 If the public security, production safety supervision and management departments and their staff violate these Provisions and commit any of the following acts, the competent authority shall, according to the management authority, punish the responsible person in charge and other directly responsible personnel:

(1) Failing to implement the administrative license according to law;

(2) failing to perform the duties of supervision and management according to law;

(3) illegal acts are not dealt with according to law;

(4) other acts of dereliction of duty, malpractice and abuse of power.

article 24. if laws and regulations have provided for legal liability for acts in violation of these provisions, those provisions shall prevail.

article 25 these provisions shall come into force as of October 1, 2118.
