Article 1 These Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Quality and Safety of Agricultural Products and other relevant administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the production of agricultural products and their supervision and management within the administrative area of this province. Article 3 People's governments at all levels shall take overall responsibility for the quality and safety of agricultural products within their respective administrative areas, establish a coordination mechanism for the supervision and management of agricultural products quality and safety, coordinate the supervision and management of agricultural products quality and safety within their respective administrative areas, and study and solve major problems in the supervision and management of agricultural products quality and safety.

The people's governments at or above the county level shall, in accordance with the provisions of the state, clarify the responsibilities of supervision and management of agricultural products quality and safety in various departments, establish an accountability system for supervision and management of agricultural products quality and safety, improve the supervision, management and inspection institutions and teams of agricultural products quality and safety on schedule, and include the funds for agricultural products quality and safety in the financial budget at the corresponding level and guarantee them.

The township (town) people's government shall gradually establish a public service system for the supervision and management of agricultural products quality and safety, equip full-time (part-time) agricultural products quality and safety supervision and management personnel and necessary inspection and testing equipment, implement the responsibility of supervision and management of agricultural products quality and safety, and strengthen the guidance and supervision of agricultural products production within their respective administrative areas.

The villagers' committee shall assist the people's government to do a good job in the quality and safety of agricultural products and organize publicity and education activities on the quality and safety of agricultural products. Fourth agricultural (animal husbandry) administrative departments at or above the county level shall be responsible for the supervision and management of the quality and safety of agricultural products within their respective administrative areas; The water administrative department shall be responsible for the supervision and management of the quality and safety of aquatic products within its administrative area; The administrative department of forestry shall be responsible for the supervision and management of the quality and safety of edible forest products within their respective administrative areas. The administrative departments of agriculture (animal husbandry), water, forestry, etc. are hereinafter collectively referred to as the supervision and administration departments of agricultural product quality and safety.

The administrative departments of industry and commerce, quality and technical supervision, health and environmental protection at or above the county level shall, in accordance with their respective duties, do a good job in the quality and safety of agricultural products within their respective administrative areas. Article 5 Agricultural product trade associations, farmers' specialized cooperative economic organizations and agricultural product production enterprises shall strengthen self-discipline management and integrity construction, provide their agricultural product producers with services such as agricultural product quality and safety management and production technology, and guide them to engage in agricultural product production activities according to law. Sixth provincial agricultural products quality and safety supervision and management departments shall set up an expert committee for risk assessment of agricultural products quality and safety, analyze and evaluate the potential hazards that may affect the quality and safety of agricultural products in this province, and take corresponding measures according to the risk assessment results. The results of risk assessment shall be submitted to the provincial people's government in a timely manner and notified to the relevant departments.

Provincial agricultural products quality and safety supervision and management departments shall, in accordance with their functions and powers, timely release agricultural products quality and safety information to the society and notify relevant departments at the same time. Article 7 People's governments at or above the county level shall adopt policies, funds and other measures to support scientific research, popularization and standardized production of agricultural products.

Encourage and support producers of agricultural products that meet the requirements stipulated by the state to apply for pollution-free origin identification, pollution-free agricultural products certification, green food and organic agricultural products certification, and geographical indication registration of agricultural products. Eighth people's governments at all levels, relevant departments and news media should strengthen the publicity of agricultural products quality and safety knowledge, and raise public awareness of agricultural products quality and safety.

Any unit or individual has the right to supervise the quality and safety of agricultural products. Ninth people's governments at or above the county level shall commend and reward the units and individuals that have made remarkable achievements in the quality and safety of agricultural products. Chapter II Origin of Agricultural Products Article 10 People's governments at or above the county level shall take measures to strengthen the protection of agricultural ecological environment and improve the production conditions of agricultural products.

The competent administrative department of environmental protection at or above the county level and the supervision and administration department of agricultural products quality and safety shall monitor the surrounding environment of agricultural products producing areas and deal with environmental pollution accidents and disputes in a timely manner. Eleventh agricultural products quality and safety supervision and management departments at or above the county level shall set up agricultural products safety monitoring points in the following areas (1) agricultural products production areas around industrial and mining enterprises;

(2) Sewage irrigation area;

(3) Agricultural product production areas in urban suburbs;

(4) Major producing areas of agricultural products;

(five) other areas that need to be monitored. Twelfth agricultural products quality and safety supervision and management departments at or above the county level shall dynamically monitor and evaluate the environmental quality and soil quality of agricultural products, and timely publish the agricultural environmental quality and farmland soil conditions. If it is considered unsuitable for the production of specific agricultural products, it shall put forward a production ban area and report it to the people's government at the same level for approval before publication.

Areas designated as prohibited from producing specific agricultural products shall not change the nature of cultivated land and basic farmland, and shall not lower the compensation standard for agricultural land.

If losses are caused to producers of agricultural products due to the designation of areas where the production of specific agricultural products is prohibited, the polluter shall compensate the losses according to law; If the responsible person cannot be determined, the people's government at the county level shall give appropriate compensation.

Where the forbidden production area of specific agricultural products needs to be adjusted, it shall be handled in accordance with the procedures specified in the first paragraph. Article 13 Producers of agricultural products shall use agricultural inputs scientifically and rationally, promptly remove and recycle agricultural films and other packaging materials of agricultural inputs, promptly remove waste water and livestock manure produced in large-scale production or carry out harmless treatment to prevent pollution.
