Landlord, such regulations are absolutely illegal and seriously violate the labor law!
first of all, let's discuss the contents stipulated in the employee handbook of this company:
1 > According to the company's regulations, employees are only allowed to take holidays within seven days, and holidays exceeding seven days are not approved under any circumstances. "Under any circumstances" in this regulation is a serious violation of the law, and we can refute it one by one according to the regulations in the current law:
1. According to the law, pregnant women can enjoy three months paid maternity leave when giving birth (and another 1 months maternity leave when they are killed)! The three-month law mentioned here does not and cannot stipulate that female employees who want to take maternity leave should take leave in batches (that is to say, it is stipulated that they should take leave in batches, and each time must be less than 7 days). Your company's stipulation that "leave exceeding 7 days will not be approved under any circumstances" is one of the conflicts with the current laws! -Please understand the meaning of any situation!
2. The current law stipulates that employees who are married can enjoy 1.5 days (including 3 days' legal leave) of late marriage as long as both parties meet the national regulations on late marriage and late childbirth and meet the age of late marriage (female is 23 years old and male is 25 years old). That is to say, both male and female employees can enjoy 15-day paid marriage leave according to law (there were originally 3-day legal marriage leave+11-day late marriage leave implemented by the new law last year). Similarly, China's laws do not and cannot stipulate that this 13-day leave must be requested in batches, and each time it must be less than 7 days, which is the second conflict!
3. Sick leave, so I won't give a detailed explanation here. I think the landlord can understand it well.
between the above three provisions, it is enough to reflect your company's provisions that "in any case, it is a serious violation of the relevant regulations in the current laws of our country! Is absolutely illegal!
second > About the content in your company's regulations: "Holidays exceeding seven days will not be approved under any circumstances, unless you come back and resign before you go through the entry formalities, or go through the resignation formalities before you leave." As I said above, this provision not only violates the existing laws, but also is analyzed according to the following relevant laws and regulations. It is an act of fraud and coercion/taking advantage of others' danger, which is not allowed by law!
Reference: Labor Contract Law of the People's Republic of China:
Article 26 The following labor contracts are invalid or partially invalid:
(1) By means of fraud, coercion or taking advantage of a person's danger, the other party is forced to conclude or modify a labor contract against its true meaning;
Article 42 The employing unit shall not terminate the labor contract in accordance with the provisions of Articles 41 and 41 of this Law if the employee is under any of the following circumstances:
(1) The employee who is exposed to occupational hazards has not undergone occupational health examination before leaving his post, or the suspected occupational disease patient is under diagnosis or medical observation;
(2) Party B suffers from occupational diseases or work-related injuries in this unit and is confirmed to have lost or partially lost the ability to work;
(3) Being sick or injured at work, within the prescribed medical treatment period;
(4) Female employees are in pregnancy, childbirth and lactation;
(5) Having worked continuously in this unit for fifteen years and less than five years before the statutory retirement age;
(6) other circumstances stipulated by laws and administrative regulations.
in view of the above, landlord, if the company you are working for really violates the relevant regulations in the current law, you can take a complaint to the relevant functional departments according to law with the contract to protect your legal rights!
