(a) failing to establish the responsibility system for production safety and the rules and regulations for production safety in accordance with the provisions;
(2) Failing to investigate and manage hidden dangers of accidents and establish information files of hidden dangers of accidents in accordance with regulations;
(3) Failing to formulate an emergency rescue plan for production safety accidents in accordance with regulations;
(four) failing to organize emergency rescue drills for production safety accidents in accordance with regulations.
Forty-third production and business units have one of the following acts, shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be ordered to suspend production and business for rectification, and may be fined between 5,000 yuan and 20,000 yuan:
(1) Failing to set up a safety production management organization or provide safety production management personnel in accordance with regulations;
(two) the main person in charge and the safety production management personnel have not participated in the training or passed the examination in accordance with the regulations;
(3) Failing to educate and train employees in production safety in accordance with regulations.
Forty-fourth production and business units are not equipped with labor protection articles in accordance with the provisions of the first paragraph of Article seventeenth of these regulations, and shall be ordered to make corrections within a time limit; If it fails to make corrections within the time limit, it shall be ordered to suspend production and business for rectification, and may be fined between 20,000 yuan and 50,000 yuan.
Forty-fifth production and business units have one of the following acts, shall be ordered to make corrections within a time limit, a fine of two thousand yuan and ten thousand yuan:
(a) failing to inspect and maintain the equipped labor protection articles in accordance with the regulations;
(two) failing to set up, inspect and maintain outdoor facilities and hanging objects in accordance with the provisions of article eighteenth of these regulations.
Forty-sixth production and business units have one of the following acts, shall be ordered to make corrections within a time limit and impose a fine of not less than ten thousand yuan but not more than fifty thousand yuan; Overdue correction, shall be ordered to suspend production and business for rectification:
(a) the production and business operation entity with major hazards fails to report the major hazards or safety assessment report to the safety production supervision and management department for the record in accordance with the provisions;
(two) stadiums, tourist attractions, shopping malls, entertainment venues and other crowded units do not meet the requirements of safety production as stipulated in Article 22 of these regulations.
Forty-seventh production and business units engaged in aerial suspension operations without filing with the district (city) construction administrative department, shall be ordered to make corrections within a time limit and impose a fine of more than twenty thousand yuan and fifty thousand yuan; Overdue correction, shall be ordered to suspend production and business for rectification.
If a unit or individual entrusts or employs a unit that has not been put on record by the administrative department of construction in the district (city) to carry out aerial suspension operations, it shall be ordered to make corrections, and a fine of 1000 yuan or more and 1 10,000 yuan or less shall be imposed.
Forty-eighth production and business units engaged in high-altitude suspension operations using personnel who have not passed the examination by the municipal construction administrative department, shall be ordered to make corrections, and be fined 1 10,000 yuan but not more than 50,000 yuan.
Forty-ninth production and business units engaged in the demolition of buildings (structures), high hanging, confined space and other dangerous operations, one of the following acts, shall be ordered to make corrections, and a fine of not less than 5,000 yuan but not more than 20,000 yuan:
(1) Failing to formulate an operation plan or take safety measures;
(2) Failing to arrange a special person to conduct on-site safety management.
Article 50 Where a production and business operation entity refuses or obstructs the safety production supervision and inspection personnel from entering the production and business operation place for supervision and inspection according to law, it shall be fined between/kloc-0 and 30,000 yuan.
Fifty-first key supervision construction projects without safety review or safety review unqualified, investment and construction units to start construction or put into production (use), shall be ordered to stop construction or put into production (use), and impose a fine of not less than ten thousand yuan but not more than thirty thousand yuan.
Article 52 The administrative penalties stipulated in these Regulations shall be decided by the safety production supervision and management department, among which the administrative penalties stipulated in Articles 47 and 48 shall be decided by the construction administrative department, and the administrative penalties for the installation, testing and maintenance of outdoor facilities and hangers that do not meet the requirements shall be decided by the urban management administrative law enforcement department.
Where the relevant laws and regulations provide otherwise for the organ that decides on administrative punishment, such provisions shall prevail.
Article 53 Any functionary of a state organ responsible for the supervision and administration of production safety who neglects his duty, abuses his power or engages in malpractices for personal gain shall be punished by his unit or the competent department at a higher level according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.
