How to deal with the expiration of food business license?

Anyone who engages in food sales and catering services within the territory of the People's Republic of China shall obtain a food business license according to law.

to apply for a food business license, one should first obtain legal subject qualifications such as a business license.

if the food business license is valid for five years and needs to be extended, an application shall be submitted to the food and drug supervision and administration department that originally issued the license 31 working days before the expiration of the food business license.

if the expiration of the validity period fails to apply for extension or cancellation procedures as required, the food and drug supervision and administration department that originally issued the license shall cancel the food business license according to law.

Processing flow of food business license expiration:

1. The applicant fills in the application form and submits relevant materials to the acceptance window of the food and drug supervision department or the acceptance window of the food and drug supervision department of the district and county where the original license is issued.

2. Acceptance

Each district and county sub-bureau will review the application materials in form, and issue an acceptance decision for those who meet the requirements.

3. After the audit

is accepted, each district and county sub-bureau shall assign personnel to conduct data and on-site audit according to the Food Safety Law of the People's Republic of China, the Regulations for the Implementation of the Food Safety Law of the People's Republic of China and the Measures for the Administration of Food Circulation Permit.

4. Examination and approval

Each district and county sub-bureau makes an examination and approval decision to grant (or not grant) the extension of the administrative license according to the examination results.

5. Replacement

If a decision is made to approve the extension of the administrative license, the food circulation service license shall be reissued to the applicant.

When applying for renewal of food business license, a food business operator shall submit the following materials:

(1) An application for renewal of food business license;

(2) the original and duplicate of the food business license;

(3) Other materials related to the renewal of the food business license.

Matters needing attention in handling food licenses:

1. The food business operators whose business licenses have been revoked, their legal representatives, the directly responsible persons in charge and other directly responsible personnel shall not apply for food production and business licenses, or engage in food production and business management, or serve as food safety management personnel of food production and business enterprises within 5 years from the date of making the punishment decision.

2. In any of the following circumstances, if a food business operator fails to apply for cancellation procedures as required, the food and drug supervision and administration department that originally issued the license shall go through the cancellation procedures of the food business license according to law: (1) if the food business license fails to apply for renewal upon expiration;

(2) The qualification of food business operators is terminated according to law;

(3) The food business license has been withdrawn or revoked according to law;

(4) The food business license cannot be implemented due to force majeure;

(5) Other circumstances in which the food business license shall be cancelled as stipulated by laws and regulations.

if the food business license is cancelled, the license number shall not be used again.

Measures for the Administration of Food Business License

Article 27

If the licensing items specified in the food business license are changed, the food business operator shall apply to the original food and drug supervision and administration department for changing the business license within 11 working days after the change.

if the business premises change, a new food business license shall be applied. If the address of the peripheral warehouse changes, the food business operator shall report to the original food and drug supervision and administration department within 11 working days after the change.

Article 28

To apply for changing the food business license, the following application materials shall be submitted:

(1) An application for changing the food business license;

(2) the original and duplicate of the food business license;

(3) Other materials related to the change of food business license.

if a food business operator needs to extend the validity period of a legally obtained food business license, it shall apply to the food and drug supervision and administration department that originally issued the license 31 working days before the expiration of the validity period of the food business license.

Article 31

When applying for renewal of food business license, a food business operator shall submit the following materials:

(1) An application for renewal of food business license;

(2) the original and duplicate of the food business license;

(3) Other materials related to the renewal of the food business license.

the local food and drug supervision and administration department at or above the county level shall, according to the licensee's application for extension, make a decision on whether to approve the extension before the expiration of the validity period of the food business license.

Article 39 of the Administrative Licensing Law of the People's Republic of China

If an administrative organ makes a decision to grant an administrative license and needs to issue an administrative license certificate, it shall issue the following administrative license certificate to the applicant with the seal of the administrative organ:

(1) Permit, license or other license certificate;

(2) qualification certificate, qualification certificate or other qualification certificates;

(3) the approval document or certification document of the administrative organ;

(4) other administrative license certificates as prescribed by laws and regulations. Where an administrative organ conducts inspection, testing and quarantine, it may affix labels or affix inspection, testing and quarantine seals to the equipment, facilities, products and articles that have passed the inspection, testing and quarantine.
