The Regulations on the Management of Health Food Labeling is a law promulgated and implemented according to the relevant requirements of the Food Hygiene Law of People's Republic of China (PRC) and the Measures for the Management of Health Food.
Article 1 In order to strengthen the supervision and management of health food labels and product specifications, these Provisions are formulated in accordance with the relevant requirements of the Food Sanitation Law of People's Republic of China (PRC) (hereinafter referred to as the Food Sanitation Law) and the Measures for the Administration of Health Food.
Article 2 These Provisions shall apply to all domestic and imported health foods sold in China.
Article 3 The definitions in these Provisions are as follows:
Health food: refers to food with specific health care functions. That is, it is suitable for specific people to eat, has the function of regulating the body, and does not aim at treating diseases.
Functional ingredients: refers to the ingredients in health food that produce health care effects.
Food label: The so-called food label includes words, figures, symbols and instructions on food packaging. To show or explain the characteristics, functions, preservation conditions and deadlines, eating people and eating methods of food and other related information.
Minimum sales packaging: refers to the food packaging delivered to consumers with the minimum delivery unit in the sales process. Main display page: refers to the largest area that consumers can easily see or display on the packaging label when purchasing goods. At least one surface of the general food sales package can be used as the main display layout.
Information page: The packaging surface next to the right of the "main display page". If the "Information Layout" immediately to the right of the "Main Display Layout" cannot meet the labeling requirements due to the packaging design (such as folding packaging bags), the "Information Layout" can choose the next layout on the right side of the right layout.
Special name of health food: the name indicating the main raw materials, physical forms of products and food properties of health food. Functional name of health food: the part of the name used to indicate the main functions of health food.
Health care function statement phrase: a brief introduction or description of health care function in the form of a phrase.
Article 4 All labeling contents of health food labels and product manuals must conform to the following basic principles:
The name, health function, functional components, suitable people and approval number of health food must be consistent with the contents specified in the health food approval certificate issued by the Ministry of Health.
It should be scientific and easy to understand, and feudal superstition should not be used to promote health food.
It shall meet the quality requirements of products, and shall not use misleading words, figures or symbols to describe or imply that a certain health food or a certain characteristic of health food is similar to or the same as another product.
False, exaggerated or deceptive words, figures and symbols shall not be used to describe or imply the health care function of health food, nor shall they be used to treat diseases.
Article 5 The labeling methods of health food labels and product specifications must conform to the following basic principles:
The health food label shall not be separated from the packaging container. The attached product manual should be placed on the outer packaging of the product.
The contents of each logo shall be marked on the corresponding page according to the provisions of these Measures. When one "information page" is not enough, it can be marked on the second "information page".
The words, figures and symbols of health food labels and product manuals must be clear, eye-catching, intuitive and easy to identify and read. The background and background colors should be contrasting colors.
The words, figures and symbols of health food labels and product instructions must be firm and lasting, and must not become blurred or even fall off during circulation and consumption.
It must be based on standardized Chinese characters, and Chinese pinyin, minority languages or foreign languages can be used at the same time, but it must have a direct correspondence with the contents of Chinese characters and be written correctly. The pinyin or foreign characters used shall not be larger than the corresponding Chinese characters.
The unit of measurement must adopt the national legal unit of measurement.
Article 6 The labels and product descriptions of health foods must be marked with all the contents specified in Annex 1 of the Measures (refer to the contents and requirements of Labels and Product Descriptions of Health Foods), and the marking method must meet the corresponding requirements specified in Annex 1 of the Measures.
Article 7 If the labeling contents or labeling methods of health food labels and product manuals do not conform to these measures, penalties shall be imposed in accordance with the provisions of Articles 45 and 46 of the Food Hygiene Law. Article 8 The Ministry of Health shall be responsible for the interpretation of these Provisions.
Article 9 These Provisions shall come into force as of the date of promulgation. ? [ 1]?
