Article 1 In order to strengthen the management of kitchen waste, promote the harmless treatment and rational utilization of kitchen waste, improve the city appearance and environmental sanitation, and protect human health, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations of the State Council Municipality on the Administration of City Appearance and Environmental Sanitation and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 The term "kitchen waste" as mentioned in these Measures refers to food residue, food processing waste and waste edible oil produced in the process of production and operation by catering services, catering units, food production and processing units and self-employed households (hereinafter referred to as kitchen waste producing units).

The waste edible oils and fats mentioned in the preceding paragraph refer to the oils and fats of animals and plants that can no longer be eaten, the oils and fats contained in kitchen waste, and the oils and fats produced after the separation of oil-water separators and grease traps. Article 3 These Measures shall apply to the generation, collection, transportation, disposal and related management activities of kitchen waste within the urban planning area of this Municipality. Article 4 The Municipal People's Government shall set up a coordination body for the management of kitchen waste to study and solve major problems in the management of kitchen waste, coordinate and urge relevant departments to perform their duties of supervision and management according to law, and the municipal urban management department shall be responsible for daily work. Fifth city management department is responsible for the supervision and management of the city's kitchen waste; The district urban management department is responsible for the supervision and management of kitchen waste within its jurisdiction according to its management authority.

Development and reform, environmental protection, health, food and drug supervision, industry and commerce, public security, agriculture, quality supervision, commerce, planning, finance and other relevant departments shall, according to their respective functions and duties, do a good job in the supervision and management of kitchen waste. Article 6 The principles of reduction, harmlessness and recycling shall be adhered to in the treatment of kitchen waste, and a unified collection, transportation and centralized fixed-point disposal system shall be implemented. Article 7 It is advocated to reduce the amount of kitchen waste by listing clean vegetables, improving catering processing technology and civilized dining.

The collection, transportation and disposal of kitchen waste shall be subsidized by the municipal finance, and the specific measures shall be formulated separately by the municipal urban management department in conjunction with the municipal finance and price departments, and implemented after being reported to the Municipal People's Government for approval. Article 8 The catering industry association shall strengthen industry self-discipline, standardize industry behavior, popularize the method of reducing kitchen waste, bring the management of kitchen waste into the scope of rating and integrity management of catering enterprises, and urge catering enterprises to do a good job in the harmless treatment of kitchen waste. Article 9 Any unit or individual shall have the right to complain and report acts in violation of these Measures.

After receiving a complaint or report, the municipal or district urban management department shall immediately investigate and deal with it, and inform the complainant or informant of the result in time after accepting it. Article 10 The urban management department of the city shall, jointly with relevant departments, formulate a plan for kitchen waste disposal facilities according to the overall urban planning and national economic and social development plan of this Municipality, and incorporate it into the special plan for city appearance and environmental sanitation facilities of this Municipality.

The land for kitchen waste disposal facilities shall be included in urban and rural planning as the land for environmental sanitation facilities, and no unit or individual may occupy or change its use without authorization. Eleventh kitchen waste generating units shall report to the local urban management department the types and output of kitchen waste in the next year before February 20 each year.

The newly established kitchen waste generating unit shall, within 30 days from the date of first generation, declare to the local urban management department the types and output of kitchen waste this year. Twelfth kitchen waste generating units shall comply with the following provisions:

(a) set up standard containers and facilities for the collection of kitchen waste, which should be kept intact and sealed, and keep the surrounding environment clean and tidy;

(2) Store kitchen waste and non-kitchen waste separately, and set up pollution prevention facilities such as oil-water separators or grease traps in accordance with the relevant provisions of environmental protection;

(three) shall not be discharged into rainwater pipes, sewage pipes, rivers, lakes, ditches, public toilets;

(four) the establishment of kitchen waste account, a true and complete record of kitchen waste production and destination.

The kitchen waste generating unit shall sign a contract for the collection and transportation of kitchen waste with the collection and transportation service enterprise that has obtained the franchise license, and report it to the local urban management department and the food and drug supervision department for the record. Thirteenth the collection, transportation and disposal of kitchen waste in the urban planning area of this Municipality shall be subject to the franchise system.

The kitchen waste generating unit shall hand over the kitchen waste generated to the franchised service enterprise for collection, transportation and disposal, and enterprises and individuals without franchise shall not collect, transport and dispose of the kitchen waste. Article 14 An enterprise applying for kitchen waste collection and transportation services shall meet the following conditions:

(a) the collection of kitchen waste should adopt a closed special collection container, and should have the function of classified collection;

(2) The kitchen waste should be transported by a fully enclosed automatic dump truck, which has the function of preventing odor from spreading, spilling and dripping, and a driving and loading and unloading recorder should be installed;

(3) Establish and implement relevant technical, quality, safety and monitoring management systems and effectively implement them;

(4) Having a road transport business license and a vehicle driving license;

(5) Having a fixed office space and parking places for machinery, equipment and vehicles;

(six) other conditions stipulated by laws, regulations and rules.
