Regulations of Jiangxi Province on the Administration of Small Vendors in Small Food Workshops, Small Catering and Small Food Stores

chapter I general provisions article 1 these regulations are formulated in accordance with the provisions of the food safety law of the people's Republic of China and other laws and administrative regulations, and in combination with the actual situation of this province, in order to standardize the production and business operations of small food workshops, small restaurants, small grocery stores and small food vendors, ensure food safety and ensure public health and life safety. Article 2 The production and business activities of small food workshops, restaurants, grocery stores and food vendors within the administrative area of this province, as well as their supervision and management, shall abide by these regulations. Article 3 The term "small food workshops" as mentioned in these Regulations refers to individual operators engaged in food production and processing with fixed production and processing places, simple production and processing conditions, few employees and small production and processing scale. The term "small catering" as mentioned in these Regulations refers to individual operators who have fixed business premises, small business area, small business scale, few employees and simple operating conditions and are engaged in catering services. The term "small grocery store" as mentioned in these Regulations refers to individual operators who have a fixed business place, a small business area, a small business scale and few employees, and are engaged in food sales, excluding individual operators who sell food by wholesale, logistics, internet, TV shopping, automatic vending, etc. The term "food vendors" as mentioned in these Regulations refers to individual operators who engage in selling food or selling food on the spot without a fixed business place or at a relatively fixed place. If small food workshops, restaurants, grocery stores and food vendors are mixed, the food and drug supervision and administration department shall determine the business types according to the highest food safety risk level and the primary and secondary business types. Article 4 The people's governments at or above the county level shall be responsible for the supervision and management of food safety within their respective administrative areas, uniformly lead, organize and coordinate the supervision and management of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas, and evaluate and assess the supervision and management of food safety. The food safety committees of the people's governments at all levels and their offices shall comprehensively coordinate, supervise and guide the management of small food workshops, restaurants, grocery stores and food vendors, put forward relevant policies and measures, and urge the implementation of food safety supervision and management responsibilities. Township people's governments and sub-district offices shall arrange personnel to do a good job in the investigation, information reporting, publicity and education of potential safety hazards of small food workshops, small restaurants, small grocery stores and food vendors within their respective administrative areas, and assist the food and drug supervision and management departments to do a good job in the supervision and management of small food workshops, small restaurants, small grocery stores and food vendors within their respective administrative areas. Village (neighborhood) committees shall assist relevant departments, township people's governments and sub-district offices in the management of small food workshops, restaurants, grocery stores and food vendors. Article 5 The food and drug supervision and administration department of the people's government at or above the county level shall be responsible for supervising and managing the production and business activities of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas.

the health and family planning departments of the people's governments at or above the county level are responsible for food safety risk monitoring and result reporting of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas. The health and family planning department of the provincial people's government shall, jointly with the food and drug supervision and administration department and the agricultural department of the provincial people's government, formulate and publish local standards for food safety with local characteristics. The urban management department of the people's government at or above the county level shall be responsible for the supervision and management of small food workshops, restaurants, grocery stores and food vendors in outdoor public places. The departments of agriculture, industry and commerce, quality and technical supervision, environmental protection, education, planning and public security of the people's governments at or above the county level shall be responsible for the supervision and management of small food workshops, restaurants, grocery stores and food vendors within their respective administrative areas. Article 6 The agency established by the food and drug supervision and administration department of the people's government at the county level in a township or a specific area according to law shall, within the limits of authority stipulated in these Regulations, make specific administrative acts in its own name and bear corresponding legal responsibilities. Article 7 Small food workshops, restaurants, grocery stores and food vendors shall engage in food production and marketing activities according to law, abide by food safety laws, regulations and management systems, and be responsible for food safety in their production and marketing. Article 8 Food industry associations shall strengthen self-discipline in the industry, promote the construction of industry integrity, publicize and popularize food safety knowledge, and guide small food workshops, restaurants, grocery stores and food vendors to carry out production and business activities according to law. Article 9 Any organization or individual has the right to report and complain about the illegal acts of small food workshops, restaurants, grocery stores and food vendors in their production and business activities, and to obtain food safety information from relevant departments and put forward opinions and suggestions on food safety supervision and management. The food and drug supervision and administration department shall publish the telephone number or e-mail address for reporting complaints and accept consultation, complaints and reports. Units that receive and handle reports shall protect the lawful rights and interests of informants and keep them confidential. Informants shall be rewarded for reports that are verified. Chapter II General Provisions Article 11 Small food workshops, small restaurants, small grocery stores and small food vendors shall produce and sell food in compliance with state regulations and food safety requirements, and shall abide by the following provisions:

(1) Food raw materials and food additives meet state regulations and food safety requirements, and food additives shall be used in accordance with national standards and regulations;

(2) The water used meets the hygienic standard for drinking water stipulated by the state;

(3) Packaging materials that come into contact with food shall be non-toxic, harmless and clean, and meet food safety standards;

(4) The detergents and disinfectants used are safe and harmless to human body;

(5) containers, tools and equipment for producing, selling, storing, transporting and loading and unloading food shall be safe, harmless and kept clean, and food shall not be stored and transported together with toxic and harmful articles;

(6) raw and cooked food shall be isolated when making food, and non-toxic, harmless and clean utensils shall be used when selling unpackaged food for direct entrance;

(7) Other requirements stipulated by laws and regulations.
