Provisions of Yunnan Province on Environmental Protection Management of Construction Projects
Article 1 In order to strengthen the management of environmental protection of construction projects and effectively control environmental pollution and ecological damage, these Provisions are formulated in accordance with the Regulations on the Management of Environmental Protection of Construction Projects issued by the State Council (hereinafter referred to as the Regulations) and combined with the actual situation of this province. Second construction projects that have an impact on the environment within the administrative area of this province shall abide by the Regulations and these Provisions. Article 3 The term "construction projects" as mentioned in these Provisions refers to the following new construction, reconstruction, expansion and relocation projects that have an impact on the environment and implement an environmental impact assessment system:

(1) Regional development and construction projects such as river basin development, economic and technological development zones, high-tech industrial development zones, tourism economic development zones and industrial parks;

(2) radioactive facilities construction projects;

(3) Agricultural, forestry, animal husbandry and fishery construction projects such as agricultural planting, forest planting, livestock raising and freshwater aquaculture;

(four) open pit mining, coal mining, metal mining, non-metal mining and other mine construction projects;

(five) food processing and manufacturing, tobacco processing, textile, leather, paper making, printing, coking, chemical raw materials and products manufacturing, pharmaceutical manufacturing, chemical fiber manufacturing, rubber products, plastic products, non-metallic mineral products, metal smelting and calendering, machinery manufacturing and other manufacturing construction projects;

(6) Construction projects for the production and supply of electricity, gas and water;

(seven) urban construction projects such as urban roads, old city reconstruction, centralized landfill of solid waste and centralized treatment of urban sewage;

(8) Geological exploration and water conservancy construction projects;

(nine) highway construction, railway construction, civil aviation engineering, ports, docks, water transportation hubs and other transportation warehousing and telecommunications construction projects;

(ten) wholesale and retail, catering construction projects;

(eleven) real estate development projects;

(12) Social service construction projects such as urban gardens and urban greening, development of schools, hotels and tourist attractions, cable car and ropeway construction, entertainment services, exhibition halls, theaters, etc. ;

(thirteen) hospitals, nursing homes, health stations, stadiums, gymnasiums and other health sports construction projects;

(fourteen) radio, film and television construction projects;

(fifteen) other construction projects that have an impact on the environment as determined by the state environmental protection department. Article 4 The environmental protection departments at or above the county level shall exercise unified supervision and graded examination and approval management over the environmental protection of construction projects.

The provincial environmental protection department is responsible for examining and approving the environmental impact report, environmental impact report form or environmental impact registration form of the following construction projects:

(a) the provincial people's government and its relevant departments are responsible for examination and approval of construction projects;

(2) industrial construction projects with a total investment of more than 50 million yuan but less than 200 million yuan and non-industrial construction projects with a total investment of more than 654.38 billion yuan but less than 200 million yuan;

(3) Construction projects that cross regional, state and municipal administrative regions;

(4) The provincial environmental protection department determined by the Ministry of Environmental Protection is responsible for the environmental impact assessment and approval of construction projects.

The local, state and municipal environmental protection departments are responsible for examining and approving the environmental impact report, environmental impact report form or environmental impact registration form of the following construction projects:

(1) Industrial construction projects with a total investment of less than 50 million yuan and non-industrial construction projects with a total investment of less than 654.38 billion yuan shall be examined and approved by the Municipal People's Government, regional administrative offices and their relevant departments;

(two) industrial construction projects with a total investment of more than 2 million yuan but less than 50 million yuan and non-industrial construction projects with a total investment of more than 5 million yuan but less than 65.438+0 billion yuan shall be examined and approved by the county, city and district people's governments and their relevant departments;

(3) Construction projects across counties, cities and districts;

(four) the provincial environmental protection department shall determine the construction projects that are responsible for the examination and approval of environmental impact assessment by the local, state and municipal environmental protection departments.

County, city and district people's governments and their relevant departments are responsible for the examination and approval of industrial construction projects with a total investment of less than 2 million yuan and non-industrial construction projects with a total investment of less than 5 million yuan. The environmental impact report, environmental impact report form or environmental impact registration form shall be examined and approved by the county, city and district environmental protection departments.

The environmental impact report, environmental impact report form or environmental impact registration form of a construction project approved by the environmental protection department at a higher level may be entrusted to the environmental protection department at a lower level for approval when necessary. Article 5 The site selection of construction projects shall meet the requirements of environmental protection planning.

In the initial site selection or project proposal stage of a construction project, the construction unit and its competent department shall listen to the opinions of the environmental protection department; The environmental protection department shall participate in the preliminary site selection of construction projects that have a significant impact on the environment. Article 6 A construction unit shall submit an environmental impact report, an environmental impact report form or an environmental impact registration form at the feasibility study stage of a construction project. However, railway, transportation and other construction projects can be submitted for approval before the preliminary design is completed with the consent of the environmental protection department with the power of examination and approval; If a feasibility study is not necessary, it shall be submitted for approval before the construction project starts, and if it is necessary to apply for a business license before the start of construction, it shall be submitted for approval before the business license is applied. Article 7 When preparing an environmental impact report or an environmental impact report form, the construction unit shall report to the environmental protection department that has the right to examine and approve the environmental protection design chapter of the construction project. Where design review is required, the environmental protection department shall participate in the review.
