Measures of Shenzhen Municipality on the Administration of Kitchen Wastes

article 1 in order to strengthen the management of kitchen waste, ensure food safety and improve the level of urban environmental sanitation, these measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this municipality. Article 2 These Measures shall apply to the collection, transportation, treatment, supervision and management activities of kitchen waste within the administrative area of this Municipality. Article 3 The term "kitchen waste" as mentioned in these Measures refers to food residues, food processing wastes, expired foods and discarded edible oils and fats produced by kitchen waste producing units in food production and business activities.

the kitchen waste generating units mentioned in these measures refer to the production and business operation units that provide food to consumers by means of instant processing, commercial sales and service labor, including restaurants, snack bars, fast food restaurants, canteens and shopping malls and supermarkets that provide food consumption.

the term "waste edible oils and fats" as mentioned in these measures refers to oils and fats in kitchen waste, oil-water mixtures and oils and fats produced after separation by oil-water separators and grease traps.

The kitchen waste generated by residents' daily life should be treated separately from other domestic wastes, and gradually brought into the scope of kitchen waste for centralized treatment. Article 4 The municipal and district governments (including the management institutions of the new district, the same below) shall organize relevant departments to carry out the propaganda work of kitchen waste management, support the development of kitchen waste treatment technology and the construction of facilities, and promote the harmless treatment and resource utilization of kitchen waste.

Article 5 the municipal urban management department (hereinafter referred to as the municipal competent department) is responsible for the management of the collection, transportation and treatment of kitchen waste in the whole city, and its main responsibilities are as follows:

(1) to guide, coordinate, supervise and inspect the management of kitchen waste in various districts;

(2) according to the relevant provisions on the management of municipal solid waste, issue the license for the collection, transportation and disposal of kitchen waste and the permit for the transportation of kitchen waste vehicles;

Article 6 the district urban management department (hereinafter referred to as the district competent department) is responsible for the daily management of kitchen waste within its jurisdiction, and its main responsibilities are as follows:

(1) to supervise and inspect the collection, transportation and treatment of kitchen waste, and to track and manage the whole process;

(2) responsible for checking the account of the collection, transportation and treatment of kitchen waste;

(3) investigate and deal with illegal discharge, collection, transportation and disposal of kitchen waste according to law. Article 7 The market supervision and management department shall be responsible for the supervision and management of food production, processing and circulation, investigate and deal with illegal acts of food production and processing with kitchen waste as raw materials, and investigate and deal with illegal acts of selling fake and inferior edible oils and fats according to law.

the human settlement environment department is responsible for the supervision and management of pollution prevention measures of kitchen waste generating units and collection, transportation and treatment enterprises, and investigates and deals with illegal acts of environmental pollution during the collection, transportation and treatment of kitchen waste according to law.

the water department is responsible for the management of river courses and drainage, and investigates and deals with illegal acts of discharging kitchen waste into river courses and public drainage facilities according to law.

the traffic police department of the public security shall issue a permit within 3 working days from the date of accepting the application to the food waste transport vehicles that have been filed with the competent authorities and need to pass in the restricted and forbidden areas, so as to facilitate the food waste transport vehicles to collect and transport food waste.

the administrative departments of education, health, cultural and sports tourism shall assist the competent departments in the management of kitchen waste, and urge the units in their respective management industries to perform their duties as stipulated in these measures. Article 8 The catering trade association shall play the role of industry self-discipline and regulate the collection, transportation and disposal of kitchen waste in the industry. Promote the reduction method of kitchen waste, bring the management of kitchen waste into the scope of rating and integrity management of catering enterprises, and urge catering enterprises to do a good job in the harmless treatment of kitchen waste. Article 9 The collection, transportation and treatment of kitchen waste in our city shall implement the franchise system.

Enterprises and individuals without franchise are not allowed to collect, transport and treat kitchen waste. Article 11 An enterprise applying for a license for the collection, transportation and treatment of kitchen waste shall meet the following basic conditions:

(1) It has the qualification of an enterprise legal person;

(2) The technologies and processes adopted meet the requirements of relevant national standards and have passed professional evaluation;

(3) More than 11 fully enclosed kitchen waste removal vehicles with the functions of preventing odor diffusion, spillage and leachate dripping, and equipped with driving and loading and unloading recorders;

(4) The daily processing capacity of kitchen waste is not less than 211 tons;

(5) There shall be no less than 5 persons with professional titles such as environmental protection, chemical engineering, biology, machinery, etc., among which there shall be no less than 1 persons with professional titles above deputy senior level, and the technical director shall have professional titles above intermediate level and have more than 5 years working experience in garbage disposal;

(6) installing and using online video monitoring equipment and networking with the competent authorities;

(7) having a fixed office space, mechanical equipment and parking places for vehicles. Article 11 The municipal government may, according to the actual management needs, divide the whole city into several areas and grant different kitchen waste collection, transportation and treatment enterprises to operate.

authorized kitchen waste collection, transportation and treatment enterprises shall carry out unified collection, transportation and centralized fixed-point treatment of kitchen waste within the authorized area.
