The term "red cultural resources" as mentioned in these Regulations refers to the material and spiritual resources with commemorative, educational significance or historical, scientific and artistic value, which are formed in the process of spreading Marxism-Leninism and China's thought of unity of the production party and leading the people of all ethnic groups to carry out revolution, construction and reform and opening up. Including:
(1) Former sites, sites, relics and memorial facilities of important institutions, conferences, events and campaigns;
(2) Former residences, former residences, activity places, cemeteries, relics and memorial facilities of important people;
(3) cemeteries, churches, pavilions, towers, memorial archways, statues, columbariums, cemeteries and other facilities built to commemorate martyrs;
(4) Important documents, audio-visual materials, oral materials, literary and artistic works and other movable articles;
(5) Spiritual resources that have positive significance in different historical periods and inspire people to unite and struggle. Article 3 The protection of red cultural resources shall adhere to the principles of giving priority to protection, giving priority to rescue, inheriting development and rational utilization, and correctly handle the relationship between economic construction, social development and protection of red cultural resources in accordance with the requirements of government leadership and social participation, so as to ensure the truthfulness, integrity and safety of red cultural resources. Article 4 The people's governments of cities and counties (cities, districts) shall be responsible for the protection of red cultural resources within their respective administrative areas, and incorporate the protection of red cultural resources into the national economic and social development plan and the national land space plan at the corresponding level.
City, county (city, district) administrative departments of culture and tourism and the competent departments of retired military personnel are responsible for the guidance, supervision and management of the protection of red cultural resources within their respective administrative areas.
Departments of development and reform, education, public security, finance, civil affairs, human resources and social security, natural resources and planning, housing and urban and rural construction, transportation, agriculture and rural areas, emergency management, ecological environment, historical records of Party history and archives shall do a good job in the protection of red cultural resources within their respective functions and duties.
The town people's government and sub-district offices shall carry out the protection of red cultural resources under the guidance of the administrative departments of culture and tourism of the people's governments of counties (cities, districts) and the administrative departments of veterans.
Villagers' committees and residents' committees shall assist in protecting red cultural resources. Article 5 The people's governments of cities and counties (cities, districts) shall incorporate the funds for the protection of red cultural resources into the fiscal budget at the corresponding level, and establish a fund guarantee mechanism that is compatible with economic development. Article 6 The people's governments of cities and counties (cities, districts) shall establish an expert consultation mechanism for the protection of red cultural resources, and give full play to the role of professionals in culture and tourism, veterans affairs, education, natural resources and planning, housing and urban and rural construction, as well as experts in party history, cultural relics and laws, so as to provide consultation, demonstration, evaluation services and professional guidance for the protection of red cultural resources. Article 7 Any unit or individual has the right to discourage and report acts of embezzlement and destruction of red cultural resources. Eighth city and county (city, district) people's governments and their relevant departments should strengthen the publicity and education of red cultural resources protection, and attach importance to the research and personnel training of red cultural resources protection.
News media such as radio, television, newspapers, websites and self-media platforms should strengthen public welfare propaganda on the protection of red cultural resources and enhance the awareness of the whole society on the protection of red cultural resources. Chapter II Investigation and Identification Article 9 The people's governments of cities and counties (cities, districts) shall establish a system of investigation and identification of red cultural resources, and the competent departments of culture and tourism shall, jointly with the retired military personnel at the same level and the party history departments, organize and implement the investigation and identification of red cultural resources on a regular basis in accordance with the relevant measures of the province.
Encourage units and individuals to provide clues about red cultural resources to the administrative department of culture and tourism or the competent department of retired military personnel. Tenth the establishment of red cultural resources protection list system. The protection list is published by the people's governments of cities and counties (cities, districts) at all levels.
City, county (city, district) red cultural resources protection list, respectively, by the competent department of culture and tourism of the people's government at the same level in conjunction with the work of retired soldiers at the same level, party history and other departments from the identified red cultural resources put forward suggestions, reported to the people's government at the same level for approval and publication, and by the people's government at the same level reported to the people's government at the next higher level for the record. Eleventh city, county (city, district) administrative departments of culture and tourism, the competent department of retired military personnel shall, within three months from the date of publication of the protection list of red cultural resources, according to their respective responsibilities, set up protection signs for immovable red cultural resources included in the protection list.
No unit or individual may deface, damage or set, move or remove the protection signs without authorization. Chapter III Protection and Management Article 12 The people's governments of cities and counties (cities, districts) shall reasonably delimit the protection scope of immovable red cultural resources listed in the protection list and make it public.
According to the actual needs of protection, with the approval of the provincial people's government, a certain construction control zone can be drawn around the immovable red cultural resources listed in the protection list and published.
