Measures for emergency implementation of production safety accidents in Hubei Province
Chapter I General Provisions Article 1 In order to standardize the emergency work of production safety accidents and ensure the safety of people's lives and property, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on Safety in Production, the Law of People's Republic of China (PRC) on Emergency Response and the Regulations on Emergency of Production Safety Accidents, and in combination with the actual situation of this province. Article 2 These Measures shall apply to the emergency work of production safety accidents within the administrative area of this province. Article 3 The people's governments at or above the county level shall uniformly lead the emergency work of production safety accidents within their respective administrative areas. If the emergency work of production safety accidents involves more than two administrative regions, the people's government at the next higher level in the relevant administrative region shall be responsible, or the people's government at the next higher level in the relevant administrative region shall be responsible.

The emergency management department of the people's government at or above the county level and other departments that supervise and manage the work of production safety in related industries and fields (hereinafter referred to as the departments responsible for the supervision and management of production safety) shall, within the scope of their respective functions and duties, do a good job in the emergency work of production safety accidents in related industries and fields.

The emergency management department of the people's government at or above the county level shall guide and coordinate the emergency work of production safety accidents of other departments of the people's government at the same level and people's governments at lower levels.

Township people's governments and neighborhood offices, development zones (parks, ports) management agencies and other people's government agencies and state-owned agricultural (forestry) fields and other functional areas shall clarify the emergency management agencies, equip them with staff commensurate with the needs of the work, and assist the relevant departments of the people's governments at higher levels to perform their emergency duties for production safety accidents according to law.

Village (neighborhood) committees shall assist the Township People's governments and sub-district offices to carry out emergency publicity and education and information reporting on production safety accidents. Article 4 The production and business operation entity is the main body responsible for the emergency work of production safety accidents in its own unit, and shall strengthen the emergency work of production safety accidents and establish and improve the responsibility system for emergency work of production safety accidents.

The main person in charge of the production and business operation entity is the first person in charge of the emergency work of production safety accidents in this unit, who is fully responsible for the emergency work of production safety accidents in this unit and performs the duties stipulated by laws and regulations.

Where a production and business operation entity has a safety officer, the safety officer shall assist the principal responsible person to perform emergency duties. The person in charge of the emergency work of the production and business operation entity or the person in charge of the safety management institution shall perform the duties of emergency work in accordance with the relevant provisions. Chapter II Emergency Preparedness Article 5 People's governments at or above the county level and their departments responsible for the supervision and administration of production safety, people's government agencies such as township people's governments, neighborhood offices, development zone (park, port) management institutions, state-owned agricultural (forest) farms and other functional areas shall conduct risk identification and assessment according to the types, characteristics and harmfulness of possible production safety accidents, formulate corresponding emergency rescue plans for production safety accidents, and announce them to the public according to law. Article 6 A production and business operation entity shall conduct risk identification and assessment according to the types, characteristics and degree of harm of production safety accidents that may occur in the entity, formulate corresponding emergency rescue plans for production safety accidents, and announce them to employees of the entity.

Production and business units with various risks and possible accidents shall organize the preparation of comprehensive emergency rescue plans in accordance with relevant state regulations.

In view of one or more types of accident risks, production and business operation entities may prepare corresponding special emergency rescue plans in accordance with relevant state regulations, or incorporate special emergency rescue plans into comprehensive emergency rescue plans.

Production and business operation entities shall, in addition to preparing comprehensive emergency rescue plans or special emergency rescue plans for places, installations or facilities with greater risks, also prepare on-site disposal plans. Production and business units with single accident risk and low risk can only prepare on-site disposal plans. Article 7 The preparation of emergency rescue plans shall meet the following basic requirements:

Provisions of relevant laws, regulations, rules and standards;

(two) the actual situation of production safety in the region, the department and the unit;

(three) the risk analysis of the region, the department and the unit;

(4) Having a clear emergency organization system and division of responsibilities;

(five) there are clear and specific emergency rescue procedures and disposal measures, and they are suitable for their emergency capabilities;

(six) there are clear emergency measures to meet the emergency work needs of the region, the department and the unit;

(seven) the basic elements of the emergency rescue plan are complete, and the information provided in the annex of the emergency rescue plan is accurate;

(eight) the contents of the emergency rescue plan are scientific, targeted and operable, and are connected with the relevant emergency rescue plans.

When laws and regulations stipulate that the emergency rescue plan should be revised, the plan-making unit shall revise the relevant plan in time. Article 8 The emergency management department of the people's government at or above the county level shall organize relevant experts to examine and approve the departmental emergency plan prepared by the department; When necessary, a hearing can be held to listen to the opinions of relevant parties in society.

Mines, metal smelting units, production, management, storage and transportation units of inflammable and explosive articles and dangerous chemicals, and chemical enterprises, fireworks production and wholesale enterprises and other medium-sized or above that use dangerous chemicals to reach the quantity prescribed by the state shall review the emergency rescue plan prepared by the unit and form a written review summary.

Other production and business units other than those specified in the preceding paragraph may, according to their own needs, demonstrate the emergency rescue plan prepared by their own units.

The evaluation or demonstration of emergency rescue plan should pay attention to the integrity of basic elements, the rationality of organizational system, the pertinence of emergency handling procedures and measures, the feasibility of emergency safeguard measures and the cohesion of emergency plan.
