Article 352 The ownership of buildings, structures and their appurtenances constructed by the owner of the right to use the land for construction belongs to the owner of the right to use the land for construction, unless there is evidence to the contrary.

Article 354 Where the right to use land for construction is transferred, exchanged, contributed, gifted or mortgaged, the parties shall enter into a corresponding contract in written form. The term of use shall be agreed upon by the parties, but shall not exceed the remaining term of the construction land use right.
