Chapter I Terms and Definitions
Article 1 Terms and definitions in this Contract
1. Team domestic travel service refers to the travel agency organizing tourists to travel in People's Republic of China (PRC) (excluding Hongkong, Macau and Taiwan Province Province) in accordance with the provisions of the Tourism Law of the People's Republic of China and the Travel Agency Regulations, and providing services such as catering, accommodation and sightseeing.
2. Travel expenses refer to the expenses paid by tourists to travel agencies for purchasing the travel services agreed in this contract.
Travel expenses include:
(1) transportation expenses; (2) Accommodation fee; (3) meals (excluding drinks); (4) Ticket fees for scenic spots arranged by travel agencies; (5) Other project expenses arranged in the itinerary; (6) Tour guide service fee; (7) Other service fees of travel agencies (including land agencies).
Travel expenses do not include:
(1) personal accident insurance expenses insured by tourists; (2) The expenses paid by the travel agency are not stipulated in the contract, including but not limited to the expenses required for non-contractual activities outside the itinerary and the expenses incurred during the self-arranged activities; (3) Personal expenses incurred by tourists during their travels include, but are not limited to, non-free meals on vehicles, excess baggage fees, laundry fees, telephone charges during their stay, drinks fees, personal entertainment fees, personal injury medical expenses, expenses and rewards for finding personal lost items, and compensation fees caused by personal reasons.
3. The performance assistant refers to the legal person, natural person or other organization that has a contractual relationship with the travel agency, assists it to perform its obligations under this contract and actually provides relevant services.
4. Free activities, especially those arranged in the travel itinerary.
5. The period of self-arranged activities refers to the period of free activities arranged in the "travel trip", the period when tourists do not participate in the travel trip, the period when tourists leave the accommodation facilities before and after the daily trip, and the period when tourists leave the group temporarily with the consent of the tour guide.
6. Unreasonable low price means that the service price provided by the travel agency is lower than the reception and service fee or lower than the reasonable price recognized by the industry, and there is no justifiable reason and sufficient evidence to prove the rationality of the price. Among them, reception and service expenses mainly include the expenses paid by travel agencies for providing or purchasing services such as catering, accommodation, transportation, sightseeing and tour guides.
7. Specific shopping places refer to shopping places with independent trade names, relatively clear business boundaries, closed and independent business entities, including duty-free shops, large shopping malls, shopping places with front shops and back factories, shopping places in scenic spots, shopping places around or on the way to scenic spots, specialized shops serving tourism teams, commodity wholesale markets and shopping places related to catering, entertainment, parking and rest.
8. personal accident insurance insured by tourists refers to short-term insurance purchased by tourists themselves or through travel agencies, air ticket agents, scenic spots and other insurance institutions, with their own life, body or related interests as the subject matter of insurance, including but not limited to aviation accident insurance, travel accident insurance, emergency rescue insurance and special project accident insurance.
9. Leaving the group refers to the behavior that group tourists do not complete the agreed itinerary with the consent of the tour guide.
10. Leaving the group means that the group tourists leave the tour group without the consent of the tour guide and do not complete the agreed itinerary with the group.

Transfer refers to the behavior that the travel agency obtains the written consent of the tourists, and before the start of the trip, the tourists can't leave the group because they don't reach the agreed number of group members, and hand it over to the domestic travel team organized by other travel agencies to perform the contract.
12. A package tour agency refers to the behavior of a travel agency to form a group with tourists attracted by other travel agencies to arrange tourism services in a unified way with the consent of tourists when signing a contract, on the premise of ensuring that the promised service content and standards remain unchanged.
13. Force majeure refers to unforeseeable, unavoidable and insurmountable objective circumstances, including but not limited to those caused by natural and social reasons, such as natural disasters, wars, terrorist activities, turmoil, riots, strikes, public health emergencies and government actions.
14. Events that are unavoidable despite reasonable duty of care refer to events caused by objective factors other than intentional or negligent actions of the parties concerned, including but not limited to traffic jams caused by major protocol activities, delays or cancellations of public transport such as airplanes, trains, liners and intercity passenger buses, and temporary closure of scenic spots.
15. The necessary expenses refer to the expenses incurred by the travel agency during the performance of the contract and the non-refundable expenses paid to the local agency or the performance assistant, including the expenses of taking the plane (car, boat) and other means of transportation (including the booking fee), hotel accommodation (including the booking fee), and per capita car rental in sightseeing bus.
16. Public transport operators refer to public transport operators such as airlines, railways, passenger ships, city buses and subways.
Chapter II Formation of a Contract
Article 2 Travel itinerary
The travel agency shall provide a travel itinerary with the package agency number (hereinafter referred to as "travel itinerary"), which shall be deemed as an integral part of this contract after being signed or sealed by both parties. The following contents shall be clearly stated in the travel itinerary:
(1) The starting point, passing place, destination, destination, route travel time and specific arrangements of the travel itinerary (calculated in natural days, including the time of taking planes, cars, boats, etc.). , less than 24 hours is counted as one day); (2) The name, address, contact person and telephone number of the agency; (3) Traffic service arrangements and standards (clear information such as vehicles and grades, departure time, whether or not to transfer); (4) Accommodation service arrangement and standard (indicate the name, location and star rating of the accommodation hotel, and indicate whether there are air conditioning, hot water, independent toilets and other related service facilities in non-star hotels); (5) Dining (breakfast and dinner) service arrangement and its standard (indicate the number, place and standard of dining); (6) The specific contents and time of the tour items arranged by the travel agency (the contents of the tour route include the names of the scenic spots and the tour items, and the minimum stay time of the scenic spots); (7) Time for free activities; (8) Entertainment activities arranged in the itinerary (specify the time, place and project content of entertainment activities); The language in the travel itinerary must be accurate and clear, and there must be no uncertain terms such as "quasi × star", "luxury", "for reference only" and "subject to ××".
Article 3 Concluding a Contract
Visitors should read the terms of this contract and travel itinerary carefully. After the tourists understand the terms of this contract and related annexes, the travel agency and the tourists shall sign a written contract.
If the contract is concluded by the tourist's agent, the agent needs to issue a power of attorney from the tourist.
Article 4 Tourism advertisements and promotional materials
Travel advertisements and promotional materials of travel agencies should follow the principle of good faith. If its contents conform to the provisions of the Contract Law of People's Republic of China (PRC), it shall be regarded as an integral part of this contract, which shall be binding on both travel agencies and tourists.
Chapter III Rights and Obligations of the Parties to a Contract
Article 5 The rights of travel agencies
1. Decide whether to accept tourists to join the tour group according to their physical health and related conditions; 2. Verify the relevant information provided by tourists; 3. Collect full travel expenses from tourists according to the contract; 4. In case of emergency, the tourism team can take safety precautions and emergency measures and ask tourists to cooperate; 5. Refuse the unreasonable demands of tourists beyond the contract; 6. Require tourists to be liable for compensation for acts that damage the legitimate rights and interests of travel agencies during tourism activities or when resolving disputes; 7. Require tourists to travel in a healthy and civilized way and discourage tourists from violating laws and social ethics.
Article 6 Obligations of travel agencies
1. Provide services for tourists according to the contents and standards agreed in the contract and travel itinerary, and do not change the travel itinerary without authorization; 2. Order products and services from qualified suppliers; 3. Do not organize tourism activities at unreasonably low prices, trick tourists, and obtain kickbacks and other illegitimate interests by arranging shopping or paying for tourism projects separately; Organize the reception of tourists, do not specify specific shopping places, and do not arrange other paid tourism projects, except that it is agreed by both parties through consultation or requested by tourists and does not affect the itinerary of other tourists; 4. Truthfully inform the specific itinerary and related specific matters before leaving the group, including but not limited to the important laws and regulations, customs and habits of the tourist destination; Safety precautions and safety measures in tourism activities, and the situation that tourists are not suitable to participate in tourism activities; Information that the travel agency can reduce or exempt its responsibilities according to law; Emergency contact information and other matters that should be informed as stipulated by laws and regulations; 5. According to the contract, arrange certified tour guides for the tourism team in accordance with the Tourism Law of the People's Republic of China and the Regulations on the Administration of Tour Guides; 6. Properly keep the documents, luggage and other items handed over by tourists; 7. Issue safety information cards written in a fixed format and filled in by tourists (including tourists' names, blood types and emergency contact information, etc.). ); 8. When the personal and property rights and interests of tourists are damaged, reasonable and necessary protection and rescue measures should be taken to avoid the expansion of personal and property rights and interests of tourists; 9. Actively coordinate and handle disputes in the travel itinerary and take appropriate measures to prevent the loss from expanding; 10. Remind tourists to take out insurance in personal accident insurance; 1 1. Provide invoices to tourists; 12. Keep the personal information of tourists confidential according to law; 13. If the contract is terminated during the travel itinerary, the travel agency shall assist the tourists to return to the place of departure or the reasonable place designated by the tourists.
Article 7 the rights of tourists
1. Require travel agencies to perform relevant obligations according to the contract and travel itinerary; 2. Refuse to transfer or join the League without prior consensus; 3. Have the right to choose tourism products and services independently, have the right to refuse the behavior of travel agencies without consensus or tourists asking for designated shopping places and arranging tourists to participate in paid tourism projects, and have the right to refuse the behavior of travel agency guides forcing tourists to shop or forcing tourists to participate in paid tourism projects in disguise; 4. Ask the travel agency to issue an invoice when paying the travel expenses; 5. Personal dignity, national customs and religious beliefs are respected; 6. Have the right to request assistance and protection when personal and property safety is threatened; Personal and property damage, have the right to compensation according to law; 7. When the legitimate rights and interests are damaged, complain to the relevant departments or ask the travel agency to assist in claiming compensation; 8. Other rights granted to tourists by the Tourism Law of the People's Republic of China, the Consumer Protection Law of People's Republic of China (PRC) and relevant laws and regulations.
Article 8 obligations of tourists 1. Fill in the travel registration form, travel safety information card and other contents truthfully, inform the personal health information related to tourism activities, and be responsible for its authenticity, and ensure that the contact information provided is accurate and timely; 2. Pay travel expenses according to the contract; 3. Abide by laws, regulations and relevant regulations, and do not engage in illegal activities or participate in pornography, gambling and drug activities during the travel itinerary; 4. Abide by public order and social morality, respect the customs, cultural traditions and religious beliefs of tourist destinations, cherish tourism resources, protect the ecological environment, and abide by the civilized behavior norms such as the China Convention on Civilized Behavior of Citizens in Domestic Tourism; 5. Cooperate with the measures taken by the state to temporarily restrict tourism activities in response to major emergencies, as well as the safety precautions and emergency measures taken by relevant departments, institutions or tourism operators; 6. Take care of your luggage, carry cash, securities and valuables with you, and don't carry them in your luggage; 7. In the process of tourism activities or in the settlement of disputes, measures should be taken to prevent the loss from expanding and not to harm the legitimate rights and interests of local residents; Do not interfere with other people's tourism activities; Shall not harm the legitimate rights and interests of tour operators and tourism professionals, and shall not take improper actions such as refusing to get on or off the plane (car or ship), delaying the trip or leaving the group; 8. During the self-arranged activities, you should choose activities within your own risk control, abide by the safety warning regulations in tourism activities, and be responsible for your own safety.
Chapter IV Modification and Assignment of Contract
Article 9 Modification of the Contract
1. Travel agencies and tourists can change the contents of this contract through consultation, but both parties shall sign it in writing. The increased travel expenses and losses caused to the other party shall be borne by the party proposing the change; The travel agency shall refund the reduced travel expenses to the tourists.
2. In case of force majeure before the start of the trip, or events that cannot be avoided after the travel agency and assistant have done their reasonable duty of care, both parties can cancel or postpone the trip through consultation. If the trip is cancelled, it shall be handled according to Article 14 of this contract; If the itinerary is postponed, the increased expenses shall be borne by the tourists and the reduced expenses shall be returned to the tourists.
3. If the travel itinerary is affected by force majeure or unavoidable events after the travel agency and assistant have fulfilled their reasonable duty of care, it shall be handled in the following ways:
(1) If the contract cannot be fully performed, the travel agency can explain to the tourists that the contract can be changed within a reasonable range after the tourists agree to the change, so the increased expenses will be borne by the tourists and the reduced expenses will be returned to the tourists.
(2) If the personal and property safety of tourists is endangered, the travel agency shall take corresponding safety measures, and the expenses thus incurred shall be borne by the travel agency and tourists.
(3) If tourists stay, travel agencies should take corresponding resettlement measures. Therefore, the increased accommodation expenses are borne by tourists, and the increased return expenses are shared by both parties.
Article 10 Transfer of the Contract Before the tour begins, the tourist may transfer his rights and obligations under this contract to a third party, and the travel agency shall not refuse without justifiable reasons, and go through the relevant transfer procedures, so the increased expenses shall be borne by the tourist and the third party.
Justifiable reasons include but are not limited to: the relevant services handled by the original applicant cannot be transferred to a third party; Unable to arrange transportation for the third party; Tourism activities have special requirements for the identity and qualification of tourists.
Article 11 Arrangements for not forming a group
When the travel agency fails to reach the agreed number of tour groups and cannot form a tour group, tourists can make an agreement with the travel agency on the following arrangements in Article 23 of this contract.
1. Transfer: On the premise of ensuring that the promised service content and standard will not be lowered, the travel agency can entrust other travel agencies to perform the contract with the prior written consent of the tourists, and only after taking responsibility for the breach of this contract by the entrusted travel agency can it recover the compensation. If a tourist signs a separate contract with the entrusted travel agency, the rights and obligations of this contract will be terminated.
2. Postpone the tour and change the route: With the written consent of the tourists, the travel agency may postpone the tour or change other routes, so the increased expenses shall be borne by the tourists and the reduced expenses shall be refunded by the travel agency. If necessary, you can re-sign a travel contract.
Chapter V Termination of the Contract
Article 12 The travel agency terminates the contract.
1. If the group cannot be formed without reaching the agreed number, the travel agency shall take effective forms such as writing to terminate the contract. If the travel agency proposes to terminate the contract more than 7 days before the start of the trip (calculated according to the difference between the departure date and the natural day when the termination notice arrives, the same below), it will not be liable for breach of contract, and the travel agency will refund all the travel expenses it has collected to the tourists; If the travel agency proposes to terminate the contract within 7 days before the start of the trip (excluding the seventh day, the same below), it shall not only refund all the travel expenses already collected to the tourists, but also bear the corresponding liabilities for breach of contract in accordance with the provisions of Article 17, paragraph 1, of this contract.
2. If the tourist is in any of the following circumstances, the travel agency may terminate the contract:
(1) Suffering from infectious diseases and other diseases that may endanger the health and safety of other tourists; (two) carrying articles that endanger public safety and refusing to hand them over to the relevant departments for handling; (three) engaged in illegal or contrary to social morality activities; (four) engaged in activities that seriously affect the rights and interests of other tourists, and can not be stopped without dissuasion; (5) Other circumstances stipulated by laws and regulations.
If the travel agency terminates the contract due to the above circumstances, it shall notify the tourists in writing and return the balance to the tourists after deducting the necessary expenses in accordance with the relevant provisions of Article 15 of this contract.
Thirteenth tourists terminate the contract
1. If the group cannot be formed without the agreed number of members, and the tourists do not agree to transfer the group, postpone the trip or change other routes to leave the group, the travel agency shall promptly issue a written notice that the group cannot be formed, and the tourists may terminate the contract. If the tourist receives the notice that the travel agency cannot form a group more than 7 days before the start of the trip, the travel agency will not be liable for breach of contract and refund all the travel expenses collected to the tourist; If the tourist receives the notice that the travel agency cannot form a group within 7 days before the start of the trip, it shall be handled in accordance with the relevant provisions in Clause 1 of Article 17 of this contract.
2. In addition to the agreement in Article 1 of this article, the tourist may also terminate the contract in writing before the end of the tour. If the tourist proposes to terminate the contract more than 7 days before the start of the trip, the travel agency shall refund all the travel expenses to the tourist; If the tourist proposes to terminate the contract within 7 days before and during the trip, the travel agency will refund the balance to the tourist after deducting the necessary expenses in accordance with the relevant provisions of Article 15 of this contract.
3. If a tourist fails to arrive at the agreed meeting and departure place at the agreed time and does not join the tour team halfway, it shall be deemed that the tourist terminates the contract and shall be dealt with according to the relevant provisions in Article 15 of this contract.
Fourteenth due to force majeure or unavoidable events after fulfilling the duty of reasonable care, the travel agency and tourists can terminate the contract. If the contract cannot be fully performed and the tourists do not agree to the change, the contract may be terminated. If the contract is terminated, the travel agency shall refund the balance to the tourists after deducting the non-refundable fees paid to the land agency or the performance assisting person.
Article 15 Deduction of necessary expenses
1. If the tourist proposes to terminate the contract within 7 days before the start of the trip, or if the travel agency agreed in Paragraph 2 of Article 12 of this contract terminates the contract before the start of the trip, the necessary expenses shall be deducted according to the following standards:
6 to 4 days before the start of the trip, 20% of the total travel expenses will be charged; From 3 days before the start of the trip to 1 day, 40% of the total cost of the trip will be charged; On the day of the trip, 60% of the total travel expenses.
2. If the contract is terminated during the trip, the deduction standard of necessary expenses is:
Travel expenses × deduction ratio on the day of travel+(travel expenses-travel expenses × deduction ratio on the day of travel) ÷ travel days × travel days.
If the necessary expenses deducted in accordance with paragraph 1 or the proportion agreed in the above paragraph 2 are lower than the actual expenses, the tourists shall pay according to the actual expenses, but the maximum amount shall not exceed the total tourism expenses.
If the contract is terminated, the travel agency shall, after deducting the necessary expenses, handle the refund formalities for the tourists within 5 working days from the date of the notice of termination of the contract.
Article 16 Travel agencies assist tourists to return and bear the expenses.
If the contract is terminated during the tour, the travel agency shall assist the tourist to return to the starting point or a reasonable place designated by the tourist. If the contract is terminated due to the travel agency or performance assistant, the round-trip expenses shall be borne by the travel agency; If the contract is terminated during the journey according to the second paragraph of Article 12 and the second paragraph of Article 13 of this contract, the round-trip expenses shall be borne by the tourists; If the contract is terminated according to Article 14 of this contract, the round-trip expenses shall be borne by both parties.
Chapter VI Liability for Breach of Contract
Seventeenth travel agency's liability for breach of contract
1. If the travel agency proposes to terminate the contract within 7 days before the start of the trip, or if the tourist receives a notice from the travel agency that he cannot organize a tour within 7 days before the start of the trip, and does not agree to transfer the tour, postpone the trip or change the route to terminate the contract, the travel agency will refund all the travel expenses collected to the tourist and pay the tourist liquidated damages according to the following standards:
Pay a penalty of 10% of the total travel expenses 6-4 days before the start of the trip; 3 days before the start of the trip to 1 day, pay a penalty of 15% of the total trip cost; On the day of the trip, pay a penalty of 20% of the total travel expenses.
If the liquidated damages paid according to the above ratio are not enough to compensate the actual losses of tourists, the travel agency shall compensate the tourists according to the actual losses.
Without the consent of the tourists, the travel agency shall, within five working days from the date of the cancellation of the notice of leaving the group or the termination of the contract, go through the formalities of refunding all the travel expenses for the tourists and pay the above liquidated damages.
2. If the travel agency fails to provide services as agreed in the contract, or adjusts the travel itinerary without the consent of the tourists (except in the circumstances specified in the third paragraph of Article 9 of this contract), which leads to the reduction of projects, the shortening of travel time or the lowering of standards, it shall bear the liabilities for breach of contract such as continuing to perform, taking remedial measures or compensating for losses according to law.
3. If the travel agency has the conditions to perform, but refuses to perform its obligations under this contract after being requested by the tourists, the travel agency shall pay the tourists a penalty of 30% of the total travel expenses. If the tourists take remedial measures such as booking accommodation, catering and transportation at the same level, the expenses shall be borne by the travel agency; If serious consequences such as personal injury or detention are caused to tourists, tourists can also ask the travel agency to pay compensation of more than one time and less than three times the travel expenses.
4. Without the consent of the tourists, the travel agency shall pay the tourists a penalty of 25% of the total travel expenses; If the tourist terminates the contract, the travel agency shall also refund all the travel expenses to the tourists who have not traveled with the group, and refund the travel expenses that have not yet occurred to the tourists who have traveled with the group. If the liquidated damages are not enough to compensate the actual losses of tourists, the travel agency shall compensate the tourists according to the actual losses.
5. If the travel agency is under any of the following circumstances, the tourists have the right to request the travel agency to handle the return and advance the return fee within 30 days after the end of the travel itinerary, or refund the paid travel expenses:
(1) Travel agencies organize tourism activities at unreasonably low prices, trick tourists, and obtain illegitimate interests such as kickbacks by arranging shopping or paying for other tourism projects; (two) the travel agency has designated a specific shopping place or arranged tourism projects at a separate fee without the consent of both parties or the requirements of tourists.
6. When there is a dispute with tourists, the travel agency should take active measures to prevent the loss from expanding, otherwise it should be responsible for the expanded loss.
Eighteenth tourists' liability for breach of contract
1. Tourists who don't listen to the advice and tips of the travel agency and its tour guides, affect the team trip and cause losses to the travel agency, shall bear the corresponding liability for compensation.
2. The losses caused by tourists' personal activities beyond the content agreed in this contract shall be borne by them.
3. If the travel agency, performance assistant, tourism professional or other tourists are damaged due to the fault of the tourists, the tourists shall compensate for the losses.
4. Tourists should take measures to prevent the loss from expanding in tourism activities or when resolving disputes, otherwise they should bear corresponding responsibilities for the expanded losses.
5. Tourists who violate the safety warning regulations, or do not cooperate with the state's measures to temporarily restrict tourism activities in response to major emergencies, safety precautions and emergency measures, thus causing losses to travel agencies, shall bear corresponding responsibilities according to law.
Article 19 Other responsibilities
1. If this contract cannot be performed or cannot be performed as agreed due to the tourists' own reasons, or personal injuries or property losses are caused to the tourists, the travel agency will not be responsible.
2. If the self-arranged activities cause damage to the personal and property rights and interests of tourists, the travel agency shall fulfill the necessary warning obligation in advance and the necessary rescue obligation afterwards, and shall not be liable for compensation.
3. If the personal and property rights and interests of tourists are damaged due to third-party infringement and other reasons not attributable to the travel agency, the travel agency shall not be liable for compensation. However, if the loss of personal and property rights and interests of tourists increases due to the travel agency's failure to fulfill its obligation of assistance, the travel agency shall be liable for the increased loss.
4. If the public transport operator causes personal injury and property loss to the tourists, the travel agency shall assist the tourists to claim compensation from the public transport operator.

Travel agencies may, in accordance with the principles of equality, voluntariness, honesty and credit, reach an agreement with tourists on shopping activities and payment for other tourism projects on the premise of not organizing unreasonable low-cost tourism activities, deceiving tourists, obtaining kickbacks and other illegitimate interests, and not affecting the itinerary of other tourists; 3. The arrangement of shopping activities and paid tourism projects shall not conflict with the travel itinerary; 4. Where the land agency and its employees arrange shopping activities or pay for tourism projects during the trip, the responsibility shall be borne by the travel agency that concluded this contract; 5. Article 26 dispute settlement methods
