Measures of Tianjin Municipality on the Administration of Barrier-free Environment Construction
Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Law of the People's Republic of China on the Protection of Disabled Persons, the Regulations on the Construction of Barrier-free Environment and other laws and administrative regulations, combined with the actual situation of this Municipality, in order to strengthen the construction of barrier-free environment and ensure that disabled persons and other members of society participate in social life on an equal footing. Article 2 These Measures shall apply to the barrier-free environment construction and related management within the administrative area of this Municipality. Article 3 The term "barrier-free environment construction" as mentioned in these Measures refers to the construction for facilitating disabled people and other social members to independently and safely access roads, relevant buildings, take public transport, exchange information and obtain community services. Article 4 The municipal and district people's governments shall be responsible for organizing the preparation and implementation of the planning for the construction and development of barrier-free environment, incorporating the planning for the construction and development of barrier-free environment into the national economic and social development planning and urban and rural planning, and regularly organizing the evaluation for the construction of barrier-free environment.

The establishment of barrier-free environment construction and development planning shall solicit the opinions of social organizations such as disabled people's organizations. Fifth administrative departments of urban and rural construction shall be responsible for the supervision and management of the construction of barrier-free facilities within their respective administrative areas, and supervise and inspect the construction of barrier-free facilities according to law.

Development and reform, planning, information technology, transportation, public security, culture, radio, film and television, press and publication, health and family planning, education and other administrative departments. Should do a good job in barrier-free environment construction and related management within the scope of their respective duties.

The Federation of Disabled Persons shall cooperate with relevant departments to formulate and implement the development plan for barrier-free environment construction and do a good job in the barrier-free transformation of disabled families. Article 6 The municipal and district people's governments and their departments, disabled persons' federations and relevant social organizations shall adopt various ways to publicize the construction of barrier-free environment and popularize barrier-free knowledge.

Radio, television, newspapers, internet and other media should strengthen the public welfare propaganda of barrier-free environment construction and enhance the awareness of barrier-free environment construction of members of the whole society. Article 7 State organs, social organizations, enterprises and institutions, and foreign service agencies of urban and rural grassroots mass autonomous organizations shall provide barrier-free knowledge education and necessary auxiliary service skills training for their relevant staff. Article 8 Citizens, legal persons and unincorporated organizations shall abide by the provisions on the use of barrier-free facilities and consciously safeguard the barrier-free environment.

No unit or individual may damage or occupy barrier-free facilities or change their use.

Any unit or individual may complain and report to the relevant administrative departments about the damage, occupation and change of the use of barrier-free facilities. After receiving complaints and reports, the relevant administrative departments shall promptly handle them according to law. Ninth disabled persons' federations and other social organizations and other relevant units and individuals may put forward opinions and suggestions on barrier-free environment construction to relevant departments and units. The relevant departments and units shall promptly handle and reply. Tenth Municipal and District People's governments shall, in accordance with the relevant provisions of the state and this Municipality, commend and reward the units and individuals that have made outstanding contributions in the construction and management of barrier-free environment. Chapter II Construction of Barrier-free Facilities Article 11 Barrier-free facilities in roads, public buildings, public transport facilities, residential buildings and residential areas newly built, rebuilt and expanded in this Municipality shall be built in accordance with the standards for the construction of barrier-free facilities, and shall be designed, constructed and put into use at the same time as the main project of the construction project.

New barrier-free facilities should be connected with the surrounding barrier-free facilities. Twelfth relevant units to review the construction drawings and design documents of construction projects, the barrier-free design is not carried out in accordance with the national mandatory standards for barrier-free facilities construction, and will not be reviewed and approved. Thirteenth new construction, renovation and expansion projects, the construction unit shall, when organizing the completion and acceptance of the construction project, accept the barrier-free facilities; If the barrier-free facilities are not constructed in accordance with the qualified design documents and construction technical standards, they shall not pass the final acceptance.

Before the completion and acceptance of the following construction projects, the construction unit shall, according to the actual situation, invite representatives of the disabled to carry out trial operation and listen to the opinions of representatives of the disabled on the trial operation of barrier-free facilities:

(1) Foreign service places of state organs and institutions;

(2) Public service places such as transportation, culture, sports, education, medical care and tourism;

(3) Business places such as finance, postal services and telecommunications;

(four) large and medium-sized shopping malls, restaurants, accommodation and other commercial service places;

(five) support and foster care institutions and other public places. Article 14 The owner or manager shall be responsible for the renovation of barrier-free facilities.

The owner or manager of barrier-free facilities shall carry out transformation according to the barrier-free transformation plan formulated by the municipal and district people's governments. Article 15 The owner or manager of barrier-free facilities shall protect barrier-free facilities, maintain them in time in case of damage or failure, and ensure the normal use of barrier-free facilities.

The owner and manager of barrier-free facilities shall agree on the maintenance and repair responsibilities of barrier-free facilities; If there is no agreement, the owner of barrier-free facilities shall bear the responsibility for maintenance and repair. Article 16 The municipal and district people's governments shall give priority to the barrier-free transformation of the following institutions and places:

Special education, rehabilitation, social welfare and other institutions;

(2) Foreign service places of state organs;

(three) public service places such as culture, sports, medical and health care;

(4) Public service places such as transportation, finance, postal services, telecommunications, commerce and tourism;

(5) Public service places in streets, townships (towns) and communities (villages).
