Measures of Xining Municipality on the Supervision and Administration of Food Safety

Article 3 The term "food producers and operators" as mentioned in these Measures includes enterprises in the fields of food production, processing, transportation, warehousing, sales and catering services, promoters of centralized trading markets, providers of third-party platforms for online food trading, small food production and processing workshops, food vendors and individual vendors of edible agricultural products. Article 4 Food safety supervision and management shall follow the principles of prevention first, risk management, whole-process control and social governance. Article 5 The municipal and county (district) people's governments and the administrative committee of the park shall be responsible for the food safety supervision and management in their respective administrative areas, uniformly lead, organize and coordinate the food safety supervision and management work and the food safety emergency response work in their respective administrative areas, establish and improve the working mechanism of the whole food safety supervision and management and the information sharing mechanism, promote the construction of the food safety standard system, and include the food safety work funds in the fiscal budget at the corresponding level.

Article 7 The people's governments at all levels and the administrative committee of the park shall strengthen the publicity and education of food safety laws and regulations, national standards and scientific knowledge, enhance the law-abiding awareness of food producers and operators, and improve consumers' food safety awareness and self-protection ability. Article 8 Any organization or individual has the right to report food safety violations, obtain food safety information from relevant departments according to law, and put forward opinions and suggestions on food safety supervision and management. Chapter II Government Supervision and Management Article 9 The Food Safety Committee of the people's government of the city or county (district) is responsible for studying and deploying, making overall plans to guide the food safety supervision and management, coordinating and solving major problems across departments and regions, urging and coordinating relevant departments to perform their supervision and management duties, and organizing and evaluating the self-supervision and social supervision of food producers and operators.

the food safety Committee of the municipal people's government shall, in accordance with laws and regulations and these measures, formulate standards and systems for appraisal, examination and evaluation, and be responsible for the appraisal and evaluation of the food safety supervision and management work of the county (district) people's government; The food safety committee of the county (District) people's government shall be responsible for evaluating and assessing the food safety supervision and management work of the food safety supervision and management departments at the corresponding level and other relevant departments.

The appraisal, examination and evaluation shall involve food producers and operators, trade associations, technical institutions, scientific research institutions, consumer associations, news media and representatives of citizens. Article 11 the food safety supervision and management department shall perform the following duties of food safety supervision and management:

(1) supervision and management of food production, processing, transportation, storage and sales;

(2) supervision and management of food, food additives and food-related products;

(3) organizing the formulation of food safety-related management norms;

(4) organizing the exchange of food safety risks;

(5) Other duties of food safety supervision and management as stipulated by laws and regulations.

the competent agricultural and rural authorities are responsible for the supervision and management of edible agricultural products from planting and breeding to entering the wholesale and retail markets and production and processing enterprises; Responsible for the quality and safety supervision and management of livestock and poultry slaughter and fresh milk purchase; Responsible for the supervision and management of the production and use of agricultural inputs such as pesticides, veterinary drugs and feed additives.

the education authorities should guide and urge schools to establish and improve the management system related to food safety and nutrition and health, and schools, kindergartens and other educational institutions should strictly implement the school food safety principal (director) responsibility system to ensure food safety on campus.

the commercial department is responsible for establishing a unified traceability system for edible agricultural products and improving the whole traceability cooperation mechanism.

The public security organs are responsible for investigating cases that are suspected of committing crimes and need to be investigated for criminal responsibility according to law and transferred by food safety supervision and management departments.

other relevant departments shall perform their duties of food safety supervision and management in related fields according to law. Article 11 The food safety supervision and administration department shall be equipped with professional food safety inspection and law enforcement personnel to perform the following duties of food safety supervision and administration:

(1) Conduct on-site inspection on the production and operation process;

(2) Carry out supervisory sampling inspection on the food produced and operated;

(3) consulting and copying relevant contracts, bills, account books and other relevant materials;

(4) Conduct responsibility interviews with food producers and operators;

(5) Other duties of food safety supervision and management as stipulated by laws and regulations.
