Detailed rules for the implementation of housing provident fund withdrawal management in Weihai City in 2022

Chapter I General Principles

Article 1 In order to strengthen the management of housing provident fund withdrawal, standardize the withdrawal and use of housing provident fund, and safeguard the legitimate rights and interests of paid employees, according to the Regulations on the Management of Housing Provident Fund, the Business Specification for Housing Provident Fund Withdrawal, the Guiding Opinions on Several Specific Issues Concerning the Management of Housing Provident Fund (Guan [2005] No.5) and the Notice on Handling Illegal Withdrawal of Housing Provident Fund ([20 18]).

Article 2 These Provisions shall apply to the extraction and management of housing provident fund within the administrative area of Weihai City.

Article 3 Weihai Housing Provident Fund Management Center (hereinafter referred to as the Management Center) shall be responsible for the management and supervision of housing provident fund withdrawal within the administrative area of this Municipality, and investigate and deal with illegal withdrawal.

Article 4 The principle of "employee's own application and management center's approval" shall be applied for the extraction of housing accumulation fund.

Chapter II Extraction Conditions

Article 5 Under any of the following circumstances, employees may apply for withdrawing the storage balance in the housing provident fund account as required:

(a) the purchase, construction, renovation and overhaul of owner-occupied housing;

(2) Repaying the principal and interest of the house purchase loan;

(three) no housing workers rent a house for their own occupation;

(4) Add elevators to existing houses with property rights;

(5) retirees;

(six) completely lose the ability to work, and terminate the labor relationship with the unit;

(seven) have left the country to settle down;

(eight) the termination of labor relations with the city unit for more than two years without re employment;

(10) The employee dies or is declared dead;

(eleven) other circumstances identified by laws and regulations or management center.

Article 6 If the depositor meets the conditions in Items (1), (2), (3) and (4) of Article 5 of these Measures, he may apply for withdrawing the spouse housing provident fund at the same time; In case of items (5), (6), (7), (8), (9) and (10), the employee account shall be sealed and the employee housing provident fund account shall be cancelled.

Article 7 If an employee dies or is declared dead, the employee's heirs and legatees may withdraw the storage balance in the employee's housing provident fund account.

Article 10 Purchase office buildings, commercial houses, commercial apartments, garage parking spaces and renovated houses. , housing provident fund shall not be withdrawn.

Eleventh applicants and their spouses in the same housing in accordance with the purchase of housing extraction, this housing can not apply for housing provident fund loans.

Article 14 Workers who have no housing need to pay the housing provident fund in full for 3 months, and employees and their spouses have no housing with their own property rights within the administrative area of this Municipality and rent housing in this Municipality.

Chapter III Extraction of Application Materials

Nineteenth to repay the principal and interest of the house loan, the following application materials shall be provided:

1. To repay the principal and interest of commercial housing loans, the original loan contract and repayment details for the last three months shall be provided (with the bank seal affixed);

2. To repay the principal and interest of the housing provident fund loan in this Municipality, it shall entrust the monthly repayment method to extract the monthly repayment amount from the designated housing provident fund account to directly repay the loan.

Twentieth workers without housing rental housing for self-occupation, shall provide the following application materials:

1. If married, provide the original spouse ID card and proof of marriage relationship; Single to provide the original residence booklet;

2. If renting public rental housing, provide the original lease contract and the original rent payment certificate within the effective period;

3. If the house lease contract has been filed in the real estate management department, the original registration certificate and the original VAT invoice within the validity period shall be provided.

1. Increase the original title certificate of elevator residence;

2. The original agreement for adding elevator units confirmed by the owner;

3. Original investment certificate within one year.

Article 27 If an employee dies or is declared dead, the following application materials shall be provided:

1. The original household registration cancellation certificate or death certificate of the deceased employee; If death is declared, the original death declaration certificate shall be provided;

2. The identity card of the legal heir or legatee;

3. Notarized inheritance agreement, notarized will, conciliation statement (judgment) of the people's court, or the original inheritance conciliation statement issued by the people's mediation committee confirmed by the people's court.

Chapter IV Withdrawal Amount and Frequency

Twenty-eighth purchase of self-occupied housing to extract housing provident fund, the total amount of extraction by both husband and wife does not exceed the total purchase price; Construction, renovation, overhaul occupied housing extraction, extraction amount does not exceed the total project cost; If the house to be demolished is extracted, the extraction amount shall not exceed the price of the purchased area.

Twenty-ninth applicants and their spouses located in the same housing can only be extracted once through the purchase and construction, and cannot be extracted by repaying the principal and interest of the housing loan after extraction.

Article 30 If housing provident fund is withdrawn to repay the principal and interest of house purchase loans, employees and their spouses may apply for withdrawal of housing provident fund once a year to repay the principal and interest of loans, and the total amount withdrawn by both husband and wife shall not exceed the amount of interest payable in the current year (the annual withdrawal amount is the repayment amount of the current month multiplied by the number of repayment months). After extraction, the houses with the same location can no longer be extracted through purchase and construction.

Article 31 If the principal and interest of the loan are paid off in advance in one lump sum (including the combined loan), the employee and his spouse may apply for withdrawing the storage balance in the housing provident fund account within one year after the loan is paid off in advance, and the total amount withdrawn by both husband and wife shall not exceed the prepayment amount.

Thirty-second employees who rent a house for self-occupation and withdraw housing provident fund can only apply for withdrawing housing provident fund once a year to pay rent. At the same time, it shall meet the following requirements:

(a) the lease of commercial housing, the withdrawal amount per person shall not exceed the maximum annual withdrawal amount stipulated by this Municipality;

(two) public rental housing, the total amount of employees and their spouses shall not exceed the actual rent;

(3) If the lease contract of the leased house has been registered and put on record, the accumulated withdrawal amount of the employees and their spouses shall not exceed the paid rental amount of the house.

Rental of commercial housing, the withdrawal amount by the management center with reference to the development of the city's rental market timely adjustment, reported to the Municipal Housing Provident Fund Management Committee for approval before implementation.

Thirty-third existing residential elevators to withdraw housing provident fund, employees and their spouses can only withdraw once, and the total amount of withdrawal can not exceed the actual amount paid by the family.

Chapter V Extraction Procedure and Audit

Thirty-fourth management center shall, within 3 working days from the date of accepting the employee's application for withdrawal of housing provident fund, make a decision on whether to approve or disapprove the withdrawal, and notify the applicant. The time required for housing management, civil affairs, taxation and other departments and off-site provident fund centers to investigate and verify the purchase behavior of employees and the authenticity of application materials is not counted in the above three working days.

Thirty-fifth management center to deal with the following conditions to extract the application for strict examination:

1. Purchase the owner-occupied housing with different property rights in full;

2. Many people buy and sell the same house frequently;

3. Non-spouse or non-lineal relatives * * * purchase together;

4. Other suspicious extraction conditions.

Thirty-sixth according to the needs of the audit work, the management center has the right to require employees to supplement the application materials. Employees shall truthfully provide application materials as required and cooperate with relevant investigation and verification. If the employee refuses to cooperate, the management center has the right to make a decision not to quit.

Chapter VI Responsibility and Supervision

Thirty-seventh in violation of the provisions of these rules to withdraw housing provident fund, the management center can be handled according to the following provisions:

1. For the paid employees who illegally withdraw the housing accumulation fund, the management center will mark the bad information record in the personal account information and transfer it with the personal account. The withdrawn funds shall be ordered to be returned in full within 10 working days. Failing to pay back within the time limit is classified as a serious act of dishonesty, and the information of dishonesty shall be submitted to the relevant departments in accordance with the law and regulations, and the subordinate units shall be notified at the same time;

2. Within 5 years from the date of fraudulent withdrawal, cancel the qualification of employees to withdraw housing provident fund and apply for individual housing loans from housing provident fund;

3. Units, employees or other personnel who forge, alter or use forged or altered housing provident fund to extract application materials are suspected of a criminal offence, and the management center shall transfer them to the public security organs for handling according to law.

Chapter VII Supplementary Provisions

Thirty-eighth these rules shall be interpreted by Weihai Housing Provident Fund Management Center.

Article 39 These Detailed Rules shall come into force from 202 1, 12 and 10, and shall be valid until 2026 and 12.
