Can the Food and Drug Administration close hotels without business licenses?
The Food and Drug Administration has no right to close hotels without business licenses. However, hotels without catering service licenses can be closed.

According to the provisions of Article 77 of the Food Safety Law of People's Republic of China (PRC), the food and drug supervision and management departments at or above the county level have the right to take the following measures when performing their duties of food safety supervision and management, that is, when investigating and handling catering services without catering service licenses:

(a) to enter the production and business premises for on-site inspection;

(two) sampling inspection of food production and operation;

(three) to consult and copy the relevant contracts, documents, account books and other relevant materials;

(4) sealing up and detaining foods that are proved by evidence not to meet food safety standards, food raw materials, food additives and food-related products used illegally, tools and equipment used for illegal production and operation or contaminated by food and drug supervision and management departments;

(five) to seal up places illegally engaged in food production and business activities.
