Regulations of Yinchuan Municipality on Property Management (revised on 20 19)
Chapter I General Provisions Article 1 In order to strengthen property management, standardize property management activities, safeguard the legitimate rights and interests of owners and property service enterprises, and create a safe, civilized, comfortable, beautiful and harmonious living and working environment for the people, these Regulations are formulated in accordance with the Property Law of People's Republic of China (PRC), the Property Management Regulations of the State Council and the actual situation of this Municipality. Article 2 These Regulations shall apply to the property management activities within the administrative area of Yinchuan City. Article 3 The term "property management" as mentioned in these Regulations refers to the activities that the owners employ property service enterprises, and the owners and the property service enterprises carry out maintenance, conservation and management of the houses, supporting facilities, equipment and related sites in accordance with the provisions of the property service contract, so as to maintain the environmental sanitation and order in the relevant areas. Article 4 The administrative department of housing and urban-rural construction of the Municipal People's Government (hereinafter referred to as the municipal property administrative department) is the competent department of property management activities in this Municipality, and the municipal property management institution is entrusted by the municipal property administrative department to be specifically responsible for the supervision and management of property management activities in xingqing district, jinfeng district and Xixia District.

County (city) District People's government is responsible for the property management activities of the department (hereinafter referred to as the county (city) District Property Department) is responsible for the daily supervision and management of property management activities within their respective administrative areas, and accept the guidance, supervision and assessment of the municipal property department in business. Specific assessment methods shall be formulated separately by the Municipal People's government.

Civil affairs, comprehensive law enforcement supervision, natural resources, municipal management, emergency management, gardens, ecological environment, public security, development and reform, market supervision, health and other administrative departments shall, within the scope of their respective duties, do a good job in the supervision of property management activities.

Neighborhood offices and township (town) people's governments shall, under the leadership of party organizations at the same level, organize and guide the owners within their respective jurisdictions to establish owners' congresses according to law, coordinate the relationship between property management and community construction, mediate management disputes between owners, owners' committees and property service enterprises, and guide and supervise the owners' congresses and owners' committees to perform their duties according to law.

Community neighborhood (village) committees shall assist neighborhood offices and township (town) people's governments to do a good job in property management. Article 5 Yinchuan Property Management Association may, under the guidance of the property administrative department, organize the formulation and supervision of industry rules and regulations, establish the industry self-discipline mechanism, and standardize the industry self-management behavior. Sixth city, county (city) District People's government should encourage, guide and support the development of property management in the direction of socialization, marketization and specialization, and improve the level of property management.

Advocate green property management, encourage the adoption of new technologies and methods, and promote energy saving and water saving, garbage sorting, environmental greening and pollution prevention in property management areas.

Encourage property service enterprises and owners' committees to use new media to guide owners to participate in public affairs, carry out consultation activities, organize neighborhood mutual assistance, and implement networked property management. Chapter II Pre-property Management Article 7 Before selling the house, the construction unit shall divide the property management area according to the scope of the red line map determined in the construction land planning permit, facilities and equipment, building scale, residential construction and other factors, and make it clear in the house sales contract.

The construction unit shall, before the pre-sale of the house, declare to the municipal property administrative department to determine the property management area. Eighth construction units should be in accordance with the following standards for the new property allocation of property services, and to the municipal property authorities for the record:

(a) the construction area of less than 50 thousand square meters, not less than four thousandths of the total construction area, and not less than 120 square meters;

(two) the construction area of more than fifty thousand square meters, in addition to four thousandths of fifty thousand square meters, the excess part is not less than two thousandths of the standard configuration;

(three) residential (including commercial and residential) project property services should be located in the first to second floors above ground;

(four) the property service room should have basic decoration and facilities such as water, heating, electricity, lighting and ventilation, and can be directly put into use. Article 9 A residential property construction unit shall select a property service enterprise to conduct preliminary property management through bidding. If the number of bidders is less than 3, or the construction area of residential property is less than 50,000 square meters, with the consent of the municipal property department, the realty service enterprise can be selected through agreement.

If a realty service enterprise is selected through bidding, the construction unit shall complete the bidding work within the following prescribed time limit:

(a) new commercial housing projects should be completed within thirty days before the sale;

(two) the pre-sale of commercial housing projects should be completed before obtaining the "pre-sale permit for commercial housing";

(three) new property projects that are not for sale shall be completed within ninety days before delivery. Article 10 The construction unit shall sign a written preliminary realty service contract with the selected realty service enterprise.

The prophase realty service enterprise shall, within fifteen days after the signing or alteration of the realty service contract, report to the county (city) district realty department for the record. Eleventh the construction unit shall formulate a temporary management agreement before the sale of the property, and stipulate the use, maintenance and management of the property, the interests of the owners, the obligations that should be performed and the responsibilities that should be borne in violation of the management agreement according to law.
