Township people's governments and sub-district offices shall cooperate and assist the safety supervision and management departments of special equipment to do a good job in safety supervision of special equipment. Fifth provincial special equipment safety supervision and management department is responsible for the safety supervision of special equipment in the province, and organize the implementation of these regulations; City (prefecture) and county (city, district) special equipment safety supervision and management departments shall be responsible for the safety supervision of special equipment within their respective administrative areas.
All levels of production safety supervision and management, public security, industry and commerce administration, transportation, housing and urban and rural construction and other relevant departments shall do a good job in the safety supervision and management of special equipment according to their respective responsibilities. Article 6 The producers and users of special equipment are the main bodies responsible for the safety of special equipment and bear corresponding legal responsibilities.
The main person in charge of the production unit and the use unit of special equipment shall be fully responsible for the safety and energy saving of the special equipment of the unit. Article 7 Institutions engaged in inspection, testing, appraisal and evaluation of special equipment shall have legal qualifications, abide by relevant laws, regulations and professional standards, accept the supervision and management of special equipment safety supervision and management departments, and charge inspection, testing and technical service fees in accordance with relevant national and provincial regulations.
Special equipment inspection and testing institutions shall bear legal responsibility for their inspection and testing results and appraisal conclusions. Article 8 Encourage the implementation of scientific management methods, adopt advanced technologies, improve the safety, energy-saving performance and scientific management level of special equipment, enhance the accident prevention ability of units that produce and use special equipment, and reward units and individuals that have made remarkable achievements in the production, use, inspection and testing of special equipment.
Any unit or individual who violates the provisions of these regulations has the right to report to the special equipment safety supervision and management department and administrative supervision and other relevant departments. Special equipment safety supervision and management departments and administrative supervision and other relevant departments shall keep confidential the informants and reward them in accordance with regulations. Article 9 The production, use, inspection, appraisal and evaluation of special equipment shall meet the requirements of corresponding safety technical specifications, national standards and industry standards. Tenth governments at all levels and special equipment safety supervision and management departments should establish a special equipment liability insurance system, encourage special equipment liability insurance, and improve the ability to pay for accidents. Chapter II Production and Use of Special Equipment Article 11 A production unit of special equipment shall obtain a license according to law before engaging in corresponding activities.
The licensed special equipment production unit shall conduct production in accordance with the requirements of national standards, industry standards, local standards and safety and energy-saving technical specifications, and be responsible for the safety performance and energy efficiency indicators of special equipment. Article 12 Units engaged in the maintenance of boilers, pressure vessels, elevators, hoisting machinery, passenger ropeways, large amusement facilities and special motor vehicles in the field (factory) shall meet the following conditions and obtain the license issued by the provincial special equipment safety supervision and management department before engaging in the corresponding maintenance activities:
(1) Having an enterprise business license;
(two) there are professional and technical personnel and skilled workers suitable for the maintenance of special equipment;
(3) Having equipment and testing means suitable for the maintenance of special equipment;
(four) a sound management system, responsibility system and safety operation procedures.
Units engaged in chemical cleaning of boilers shall also have cleaning equipment and analytical means suitable for corresponding activities. Thirteenth special equipment before or within thirty days after it is put into use, users of special equipment shall register with the municipal special equipment safety supervision and management department in accordance with relevant regulations.
Within the administrative area of this province, long-distance pressure pipelines across cities divided into districts shall be registered with the provincial special equipment safety supervision and management department by users.
Users of special equipment who purchase second-hand special equipment shall pass the inspection or safety technical appraisal of special equipment inspection and testing institutions before putting into use, and meet the requirements for safe use. Fourteenth special equipment production and use units (including leasing and borrowing units) shall establish and improve the management system for safe use and energy saving of special equipment and the responsibility system for post safety and energy saving. Fifteenth users of special equipment shall not have the following acts:
(1) Entrusting an unauthorized unit or individual to design, manufacture, install, maintain, transform and inspect special equipment;
(2) Using non-pressure-bearing equipment as pressure-bearing equipment;
(three) the use of special equipment that has not passed the product supervision and inspection, installation supervision and inspection or unqualified supervision and inspection;
(four) the use of special equipment has been scrapped.
If it is necessary to re-enable special equipment after it has been stopped for more than one year, or under the circumstances that accidents or natural disasters may affect its safe operation, it shall be inspected and tested by special equipment inspection and testing institutions.
