Measures of Zhengzhou Municipality on Classified Management of Municipal Domestic Waste

chapter I general provisions article 1 these measures are formulated in accordance with the law of the people's Republic of China on the prevention and control of environmental pollution by solid waste, the regulations on the administration of city appearance and environmental sanitation and other relevant laws and regulations in combination with the actual situation of this municipality in order to strengthen the classified management of domestic waste, improve the level of reduction, recycling and harmlessness of domestic waste, and promote the construction of ecological civilization. Article 2 These Measures shall apply to the classified delivery, collection, transportation, disposal and related management activities of domestic garbage within the urban area of this Municipality. Article 3 The term "domestic waste" as mentioned in these Measures refers to the solid waste generated in daily life or activities providing services for daily life, and the solid waste regarded as domestic waste according to laws and regulations. Domestic waste is divided into the following four categories:

(1) kitchen waste refers to the organic domestic waste generated by residents in their daily lives, including kitchen waste such as solid food, eggshells, peels and cores of melons and fruits, tea residue, and waste of fruits and vegetables from farmers' markets and agricultural products wholesale markets;

(2) Recyclable materials refer to wastes suitable for recycling and resource utilization, including glass, paper, plastics, metals, large pieces of garbage and waste fabrics;

(3) harmful waste refers to domestic garbage that directly or potentially harms human health or the natural environment, including waste batteries, waste fluorescent tubes, waste thermometers, waste sphygmomanometers, waste drugs and their packages, waste paints, solvents and their packages, waste pesticides, disinfectants and their packages, waste films and waste photographic paper, etc.

(4) Other garbage refers to domestic garbage other than the first three items, including lime-soil ceramics, discarded sanitary napkins, disposable diapers, napkins and other wastes that are difficult to recycle. Article 4 The classified management of domestic waste shall follow the principles of government leading, participation of the whole people, overall planning of urban and rural areas, systematic promotion and territorial management. Article 5 The Municipal People's Government shall take the construction of domestic garbage transfer facilities and disposal facilities as an important content in the preparation of national land spatial planning and national economic and social development planning, and the funds and land needed for construction shall be incorporated into the annual investment plan and annual land supply plan of the city and district in accordance with regulations.

the municipal and district people's governments shall establish a comprehensive coordination mechanism for the classification and management of domestic waste, and coordinate and solve major issues such as classification, reduction and resource utilization of domestic waste. Article 6 The municipal urban management department is the competent department in charge of the classified management of domestic waste in this Municipality. District urban management department is responsible for the classified management of domestic waste in this area. Sub-district offices (Township People's governments) are responsible for the specific implementation of daily management work such as classified delivery, classified lighterage and related classified collection of domestic garbage within their jurisdiction. Seventh city housing security and real estate management department is responsible for urging property service enterprises to do a good job in the classification of domestic waste in accordance with the division of responsibilities.

the municipal ecological environment management department is responsible for supervising and guiding the management of collection, transportation and disposal in harmful waste.

the municipal recycling management department is responsible for the recycling management of recyclable materials in domestic garbage.

the municipal government affairs management department is responsible for promoting, supervising and guiding the classification of domestic waste in the office areas of municipal state organs, institutions and other public institutions.

natural resources and planning, education, health, development and reform, finance, transportation, culture, radio and television, tourism and other relevant departments should do a good job in the classified management of domestic waste according to their responsibilities. Chapter II Classified Delivery Article 8 Units and individuals that produce domestic garbage are responsible subjects for classified delivery of domestic garbage, so they should reduce the production of domestic garbage and fulfill their obligations such as classified delivery of domestic garbage.

state organs, institutions, social organizations and other public institutions should play a leading role in garbage sorting. Article 9 The municipal urban management department shall, jointly with the ecological environment management department, formulate a classified catalogue of domestic waste and make it public.

the municipal urban management department shall formulate the guidelines for the classification of domestic waste, clarify the standards, labels, delivery rules and other contents of domestic waste classification, and provide various forms of convenient inquiry services. Article 11 Units and individuals that produce domestic garbage shall put domestic garbage into the specified time, place and manner, and abide by the following provisions:

(1) Drain the kitchen waste and put it into the kitchen waste collection container;

(2) The recyclable materials are put into recyclable materials collection containers or sold to renewable resource recycling operators;

(3) collection containers put by harmful waste into harmful waste;

(4) Other garbage is put into other garbage collection containers. Article 11 The management responsible person system shall be implemented for the classified delivery of domestic garbage, and the management responsible person shall be determined in accordance with the following provisions and publicized:

(1) The management area of state organs, enterprises, institutions, social organizations and other organizations, and the unit shall be the responsible person;

(2) in residential areas where property management is implemented, the property service enterprise is the responsible person; In residential areas where property management is not implemented, the community residents' committee is the responsible person;

(3) airports, railway stations, passenger stations, subway stations, bus stations, stadiums, cultural venues, parks, tourist attractions, roads, squares and other public places, with the management unit or operator as the responsible person;

(4) In hotels, restaurants, shopping malls, bazaars and other business places, the management unit is the responsible person;

(5) in the construction area of the construction project, the construction unit is the responsible person.

if the person in charge of management is not specified in the preceding paragraph, the person in charge of management shall be determined by the local sub-district office (township people's government).
