article 1 in order to strengthen the management of kitchen waste, ensure food hygiene and safety and people's health, maintain city appearance and environmental sanitation, and promote the recycling of resources, these measures are formulated in accordance with the State Council's regulations on the administration of city appearance and environmental sanitation, Chongqing's regulations on the administration of city appearance and environmental sanitation and other laws and regulations, and combined with the actual situation of this municipality. Article 2 These Measures shall apply to the collection, transportation, treatment and related management activities of kitchen waste in the urban built-up areas in the main urban area of this Municipality, the urban built-up areas where the people's governments of counties (autonomous counties) are located outside the main urban area and the people's governments of towns.
the term "kitchen waste" as mentioned in these measures refers to the kitchen waste and waste edible oil generated from food processing, catering service, unit feeding and other activities other than residents' daily life. Among them, kitchen waste refers to food residue and food processing waste; Waste edible oils and fats refer to inedible animal and vegetable oils and various oil-water mixtures. Article 3 The municipal competent department of city appearance and environmental sanitation shall be responsible for the policy formulation, supervision, management and coordination of the collection, transportation and treatment of kitchen waste in the whole city. Its daily management is the responsibility of the municipal environmental sanitation management institution.
the competent department of city appearance and environmental sanitation of counties (autonomous counties) is responsible for the management, supervision and coordination of the collection, transportation and treatment of kitchen waste within their respective administrative areas. Article 4 The food and drug supervision and administration department shall be responsible for the supervision and management of catering consumption, investigate and deal with the illegal acts of kitchen waste producing units (including individual industrial and commercial households, the same below) in making food with kitchen waste as raw materials, and check the declaration receipt of kitchen waste producing units.
the quality and technical supervision and management department is responsible for the supervision and management of food production links, and investigates and punishes illegal acts of food production units using kitchen waste as raw materials according to law.
the administrative department for industry and commerce is responsible for the supervision and management of food circulation, and investigates and deals with illegal acts of selling waste edible oils and fats according to law.
the animal husbandry and veterinary administrative department is responsible for the supervision and management of livestock and poultry production sites, and investigates and deals with illegal acts of raising livestock and poultry with kitchen waste that has not been treated harmlessly according to law.
health, environmental protection and other relevant departments should do a good job in the management of kitchen waste according to the division of responsibilities. Article 5 The management of kitchen waste shall follow the principles of reduction, recycling and harmlessness.

encourage and support the development of kitchen waste treatment technology and the construction of facilities to promote the resource utilization of kitchen waste.
kitchen waste that cannot be recycled must be treated harmlessly. Sixth kitchen waste generating units shall pay the kitchen waste disposal fee. The kitchen waste disposal fee shall be incorporated into the municipal solid waste charging system, and the specific measures and standards for its collection and management shall be formulated separately by the municipal finance department and the municipal price department jointly with the municipal city appearance and environmental sanitation department, and implemented after being reported to the Municipal People's government for approval. to engage in the collection, transportation and treatment of kitchen waste, a business license for urban domestic waste shall be obtained according to law.
the people's governments of districts and counties (autonomous counties) should encourage social participation, actively explore the market-oriented operation mode of the collection, transportation and treatment of kitchen waste, and in principle, determine the collection, transportation and treatment units of kitchen waste within their respective administrative areas through fair competition such as bidding.
the collection, transportation and treatment of kitchen waste should form a network. The establishment of kitchen waste disposal sites shall conform to the overall urban planning and land use planning. Article 8 The following provisions shall be observed in the collection, transportation and treatment of kitchen waste:
(1) Measures such as deodorization, leakage prevention and leakage prevention shall be taken to prevent and control environmental pollution in accordance with relevant national requirements;
(2) Categorize kitchen waste and other domestic waste, and carry out separate collection and sealed storage;
(3) kitchen waste shall not be discharged into rainwater pipes, sewage drainage pipes, rivers and toilets;
(4) kitchen waste that has not been treated harmlessly shall not be used as livestock and poultry feed;
(5) Waste edible oils and fats or their processed products shall not be used for food processing and sales. Article 9 A kitchen waste generating unit shall abide by the following provisions:
(1) Within 11 days before the end of each quarter, declare the basic information such as the type and quantity of kitchen waste in the next quarter to the local district/county (autonomous county) city appearance and environmental sanitation department, and obtain the receipt;
(2) Set up special containers for kitchen waste collection that meet the standards, and keep the collection containers intact, airtight and clean; Where waste edible oils and fats are produced, pollution prevention facilities such as oil-water separators or grease traps shall be installed in accordance with the relevant provisions on environmental protection management;
(3) Give the kitchen waste to the collection and transportation unit for transportation within 24 hours after it is generated;
(4) the kitchen waste shall not be handed over to the collection, transportation and disposal units or individuals within their administrative areas that have not been determined by the people's governments of districts and counties (autonomous counties) through bidding. Article 11 The collection and transportation unit of kitchen waste shall abide by the following provisions:
(1) Go to the kitchen waste generating unit to remove the kitchen waste at least once a day (including legal holidays);
(2) Remove the kitchen waste to the kitchen waste treatment unit for treatment within the day of collection;
(3) Without approval, it is not allowed to suspend business; If it is really necessary to suspend business, it shall report to the competent department of city appearance and environmental sanitation of the local county (autonomous county) 15 days in advance and obtain its consent;
(4) The transportation shall be sealed, and no dripping or scattering is allowed;
(5) before 11 of each month, the source, quantity and disposal destination of the kitchen waste collected and transported last month shall be filed with the competent department of city appearance and environmental sanitation of the local county (autonomous county), and a receipt shall be obtained.
