Legal basis: Provisions on Administrative Penalties for Price Violations
Article 2 The competent price department of the people's government at or above the county level shall supervise and inspect the price activities according to law, and decide the administrative penalties for price violations.
Article 3 The administrative punishment for price violations shall be decided by the competent price department of the local people's government where the price violations occur. Where the provisions of the competent price department of the State Council are determined by the superior competent price department, those provisions shall prevail.
Article 4 An operator who violates the provisions of Article 14 of the Price Law and commits any of the following acts shall be ordered to make corrections, his illegal income shall be confiscated and he shall be fined not more than 5 times of his illegal income; If there is no illegal income, a fine of 6,543,800 yuan or more and 6,543,800 yuan or less shall be imposed; If the circumstances are serious, it shall be ordered to suspend business for rectification, or its business license shall be revoked by the administrative department for industry and commerce:
(1) Dumping at a price lower than the cost in order to crowd out competitors or monopolize the market, disrupting the normal production and operation order, and harming the interests of the state or the legitimate rights and interests of other operators, except for handling fresh goods, seasonal goods and overstocked goods at reduced prices according to law;
(2) Providing the same goods or services and discriminating against other business operators on the same trading terms.
Article 5 Business operators who, in violation of Article 14 of the Price Law, collude with each other to manipulate market prices, resulting in a sharp rise in commodity prices, shall be ordered to make corrections, their illegal income shall be confiscated, and a fine of less than five times the illegal income shall be imposed; If there is no illegal income, a fine of 6,543,800 yuan and 6,543,800 yuan will be imposed; if the circumstances are serious, a fine of 6,543,800 yuan and 5 million yuan will be imposed; If the circumstances are serious, it shall be ordered to suspend business for rectification, or its business license shall be revoked by the administrative department for industry and commerce.
In addition to the provisions of the preceding paragraph, operators who collude with each other to manipulate market prices and damage the legitimate rights and interests of other operators or consumers shall be punished in accordance with the provisions of Article 4 of these Provisions. Trade associations or other units that organize operators to manipulate market prices in collusion with each other shall be punished in accordance with the provisions of the preceding two paragraphs; Trade associations or other units may be fined up to 500,000 yuan. If the circumstances are serious, the registration and license shall be revoked by the registration administration organ according to law.
