These Regulations shall apply to the generation, collection, storage, transportation, utilization, disposal and supervision and management of construction waste outside the urbanization management area of this Municipality.
Where there are no provisions in these regulations, the provisions of relevant laws and regulations shall apply. Article 3 The term "construction waste" as mentioned in these Regulations refers to the solid waste such as waste soil and materials generated by the construction unit, the construction unit's new construction, reconstruction, expansion and demolition of various buildings, structures and pipe networks, and the renovation and decoration of houses by residents. Article 4 The management of construction waste shall adhere to the principles of reduction, recycling, harmlessness, and who produces and bears the responsibility for treatment, and build a construction waste management system with government leading, social participation, industry director and territorial management. Article 5 The people's governments of cities and counties (cities, districts) shall incorporate the management of construction waste into the national economic and social development plan, formulate measures to reduce the source of construction waste and support policies for comprehensive utilization, establish and improve the coordination mechanism for law enforcement of construction waste management, and study and deal with major problems in construction waste management.
Street offices and Township People's governments shall, under the guidance of the relevant departments of the people's governments of counties (cities, districts), do a good job in the daily management of construction waste within their respective jurisdictions. Sixth city and county (city, district) people's government environmental health departments responsible for the management of construction waste.
The development and reform, finance, ecological environment, housing and urban and rural construction, public security, transportation, natural resources and planning, water conservancy and other relevant departments of the people's governments of cities and counties (cities, districts) are responsible for the related work of construction waste management within their respective functions and duties. Article 7 The competent department of environmental sanitation of the Municipal People's Government shall, jointly with relevant departments, establish a comprehensive information platform for construction waste management, realize the dynamic management of the following information and make it public, and promote the whole process control and information traceability of construction waste:
(1) Generation and demand information of construction waste;
(2) Information on examination and approval of construction waste disposal and information on construction waste transport vehicles and construction waste disposal sites;
(three) the relevant administrative law enforcement information.
City, county (city, district) people's government ecological environment, housing and urban construction, public security, transportation, natural resources and planning, water conservancy and other departments shall provide relevant information to the information platform in a timely manner according to their respective responsibilities.
Encourage producers and demanders of construction waste to adjust and utilize construction waste through information platform. Eighth the implementation of construction waste classification system. The Municipal People's Government shall formulate norms for the classified treatment of construction waste and make them known to the public. Article 9 Any unit or individual has the right to complain and report acts in violation of the provisions of these Regulations.
The competent department of environmental health shall publish the telephone number, email address, email address and website of complaints. The department that accepts complaints and reports shall promptly investigate, handle and give feedback, and keep the relevant information of the complainant confidential. Tenth city and county (city, district) people's government departments, neighborhood offices and township people's governments, neighborhood (village) committees, related industry associations, building decoration enterprises, news media, etc. Publicity, education and scientific popularization of classified treatment, reduction and comprehensive utilization of construction waste should be strengthened, and public awareness of classification, recycling and environmental protection of construction waste should be enhanced. Eleventh construction waste transportation and disposal fee system. The charging standard shall be approved by the people's government of the city or county (city) in accordance with the relevant provisions of the state and announced to the public. Twelfth units that dispose of construction waste shall, in accordance with the management authority, apply to the competent department of environmental sanitation of the people's government of the city or county (city, district) and obtain the relevant approval of urban construction waste disposal before disposal.
The competent department of environmental health of the people's government of the city or county (city or district) shall make a decision of approval or disapproval within twenty days after receiving the application. If approved, an approval document shall be issued; If it is not approved, it shall inform the applicant and explain the reasons.
The specific conditions for examination and approval of urban construction waste disposal shall be implemented in accordance with the relevant provisions of the state.
Residents who are engaged in sporadic construction of house decoration or need emergency construction due to special circumstances such as engineering rescue may not apply for relevant examination and approval of construction waste disposal, but should complete the removal of construction waste within 24 hours after the completion of construction work. Article 14 The construction site where construction waste is generated by an engineering construction unit shall meet the following requirements:
