Article 4 The people's governments at or above the county level are responsible for the supervision and management of food safety of food workshops and food vendors, integrated planning and construction of food workshops and food vendors centralized production and operation sites, support for food workshops and food vendors to improve the process technology and production and operation conditions.

Township people's governments, street offices in accordance with the law to fulfill the food safety management of food workshops and food vendors.

Chapter II General Provisions

Article X. Food workshops and food vendors should be established to demand proof and purchase inspection system. Article 15 housing renters found in their rental housing suspected of unlicensed production and operation of food, production and operation of counterfeit and shoddy food, the use of non-food raw materials for the production of food and other illegal acts, should be promptly reported to the food and drug supervision and management department or the township people's government, the street office.

Chapter III Production and Operation of Small Food Workshops

Article 16 of the food workshop shall have the following conditions:

Article 22 of the food workshop to the supermarkets, unit canteens, food service enterprises and network food trading third-party platform sales of food production, should provide "food production and processing of small workshop registration card", the product inspection and certification documents.

Article 23 prohibits the production and processing of food small workshops, the implementation of catalog management. Food small workshops shall not produce the state banned the production and processing of food and food must obtain food registration license.

State and municipal people's governments, food and drug supervision and management departments can work with the health administration and relevant departments, combined with the local reality, to add the prohibition of food production and processing of small workshops food directory, approved by the people's government at the same level and announced to the community.

Chapter IV Food Vendors

Article 26 Food vendors engaged in business activities shall comply with the following provisions:

(b) the sale of food directly into the mouth, there should be moisture-proof, dust-proof, fly-proof, insect-proof and other equipment;

(c) food packaging containers, tools and Food packaging containers, tools and vending equipment in contact with food is non-toxic, harmless, in line with health requirements;

(D) cleaning and disinfecting products are safe for human beings, harmless;

(E) clean up the site in a timely manner, to maintain a clean and hygienic environment.

No fixed business stores of food vendors, in addition to comply with the provisions of the preceding paragraph, but also in the delineation of the business area, set the business hours to engage in business activities.

Article 27 of the food service food vendors in addition to comply with the provisions of Article 26 of these measures, but also shall comply with the following provisions:

Chapter V Supervision and Administration

Article 33 The food and drug supervision and management departments of the people's governments at the county level should be published in the food workshop and food vendor production and operation of supervisory personnel information, complaint and reporting telephone numbers and daily supervision and inspection results.

Article 34 The food workshop and food vendors found that the production and operation of food does not meet food safety standards or evidence that may endanger human health, should immediately stop production and operation, notify the relevant production and operation and consumers, and record the cessation of operation and notification.

Food workshops and food vendors should stop the operation of the food to take remedial, harmless treatment, destruction and other measures, and will report to the people's government at or above the county level food and drug supervision and management departments.

Article 35 of the food workshop and food vendors on the occurrence of food safety accidents should be immediately disposed of, sealing the food and its raw materials, tools, equipment, etc.; food poisoning occurs, it should be immediately sent to the medical institutions for treatment, and within two hours to the food and drug supervision and management department of the people's government of the county in the place of the accident; admission to the medical institution of the foodborne disease is suspected, it should be within two hours to the county level where the accident occurs, the food and drug supervision and management department. hours to the health administrative department of the people's government at the county level where the accident occurred.

No unit or individual shall not conceal, falsely report, slow report of food safety incidents, shall not conceal, falsify, destroy evidence.

Chapter VI Legal Liability

Article 38 The market operator, fair organizers in violation of the provisions of Article 14 of these Measures, the food and drug supervision and management department of the people's government at the county level shall order rectification, impose a fine of 10,000 yuan or more than 30,000 yuan; food safety accidents, according to the law, to assume joint and several liability.

Article 39 The food workshop violates the provisions of Article 18 and Article 19 of these measures, the food and drug supervision and management department of the people's government at the county level shall order rectification, and give a warning; refusal to make corrections, shall be imposed a fine of more than 1000 yuan 3000 yuan.

Article 40 of the food workshop in violation of the provisions of Article 20 of these Measures, the food and drug supervision and management department of the people's government at the county level shall order rectification, and impose a fine of 5,000 yuan or more than 10,000 yuan.

Article 44 Food vendors in violation of the provisions of Article 27 of these Measures, the food and drug supervision and management department of the people's government at the county level shall order rectification, and give a warning; refusal to make corrections, shall be imposed a fine of not less than 1000 yuan and not more than 3000 yuan.

Article 45 Food vendors in violation of the provisions of Article 28 of these Measures, the food and drug supervision and management department of the people's government at the county level shall order rectification, and impose a fine of more than 2,000 yuan 5,000 yuan.

Article 46 The food workshop and food vendors in violation of the provisions of Article 34 of these Measures, the food and drug supervision and management department of the people's government at the county level shall order them to stop operating, and impose a fine of 3,000 yuan or more than 10,000 yuan on the food workshop, and impose a fine of 300 yuan or more than 1,000 yuan on the food vendors.

Article 47 The food and drug supervision and management departments and other departments responsible for the supervision and management of food safety and their staff, in the supervision and management of food workshops and food vendors, dereliction of duty, abuse of power, favoritism, or concealment, false reporting, delayed reporting of food safety accidents, the directly responsible officer in charge of other directly responsible personnel shall be given sanctions according to law; constitutes a crime. Criminal responsibility shall be investigated according to law.

Chapter VII Supplementary Provisions

Article 48 The supervision and management of food safety at all levels and types of school canteens in this province in accordance with the "People's Republic of China *** and the State Food Safety Law" and other relevant laws and regulations, does not apply to the implementation of these measures.

Article 49 These Measures shall come into force on December 1, 2016 onwards.
