When an employer withholds or owes wages to a worker, the worker can file a complaint against the employer with the Labor Security Supervision Brigade.
When workers go to the labor inspection brigade to file a complaint, they should bring with them: their ID card, the full name of the employer, the name and contact phone number of the person in charge, and relevant evidence proving that the workers are working at the employer, and the labor security inspection brigade will issue a deadline for correction; if the complaint is not corrected, the labor security inspection brigade can issue a decision on the administrative penalties to be imposed; and if the decision is not carried out after the deadline, it will be applied to the court for compulsory execution. At the same time overdue correction, the workers can claim the employer to pay you the amount of wages in arrears of 50%-100% of the amount of compensation (Labor Security Supervision Regulations, Article 26).
Article 50 of the Labor Law stipulates that wages shall be paid in monetary form to the workers themselves on a monthly basis, and that no wages shall be withheld or owed to the workers without reason.
Article 30 of the Labor Contract Law stipulates that the employer shall pay the labor remuneration to the workers in full and on time in accordance with the agreement in the labor contract and the state regulations.
Article 9 of the Interim Provisions on the Payment of Wages: When a labor contract is terminated by both parties in accordance with the law, the employer shall pay the wages of the workers in full at the time of termination of the labor contract.
