Measures for the implementation of the minimum living guarantee for urban residents in Kunming
Chapter I General Provisions Article 1 In order to further standardize and improve the minimum living security system for urban residents in our city and effectively guarantee the basic livelihood of urban poor residents, these measures are formulated in accordance with the relevant provisions of the Regulations on Minimum Living Security for Urban Residents in the State Council and the Measures for Minimum Living Security for Urban Residents in Yunnan Province, and combined with the actual situation of our city. Article 2 The implementation of the minimum living security system for urban residents (hereinafter referred to as urban minimum living security) shall follow the following principles:

(1) Openness, justice and fairness;

(two) to ensure the basic life;

(3) Territorial management;

(4) Dynamic management;

(5) Encourage labor to help themselves. Article 3 The people's governments at all levels shall be responsible for the urban minimum living security system. The civil affairs department of the people's government of the city and county (city) District is the competent department in charge of urban subsistence allowances within its administrative area, and is responsible for policy guidance, organization and implementation, examination and approval management, etc.

Neighborhood offices, town (township) people's governments, labor security and minimum living security offices (service stations), community neighborhood committees, and enterprise trade unions are responsible for accepting applications for urban subsistence allowances, investigating and auditing, issuing urban subsistence allowances, and daily management and service work. Article 4 Responsibilities of relevant departments:

The financial department is responsible for the implementation of urban subsistence allowances and subsistence allowances in accordance with the regulations;

Labor and social security, trade union organizations, enterprises and institutions are responsible for providing relevant information about on-the-job (laid-off, unemployed) personnel, retirees and their families;

Statistics, development and reform departments are responsible for providing data such as the types, prices and consumer price index of local necessities, and participating in the formulation and adjustment of urban minimum living standards; Education, health, housing management, industry and commerce, taxation and other departments shall, according to their respective responsibilities, be responsible for implementing the social assistance policy of minimum living security and do a good job in urban subsistence allowances. Chapter II Protection Objects and Standards Article 5 Urban residents who have permanent residence in our city and are not in agricultural registered permanent residence, and whose per capita income of family members living together is lower than the local urban minimum living standard, can be included in the urban minimum living standard and enjoy the urban minimum living standard.

Students who come from other places to study in Kunming are not included in the scope of urban subsistence allowances. Article 6 The term "family members" as mentioned in these Measures refers to persons who have legal relations such as maintenance, support and maintenance. In accordance with the provisions of the Marriage Law of the People's Republic of China and other relevant laws and regulations, as well as the household registration book and ID card issued by the public security department for verification.

College students who have moved out of the city but have difficulties in family life (except military college students) are included in the calculation of their family security population. Article 7 The term "family income" as mentioned in these Measures refers to the sum of the per capita monthly income of all family members (including discounts in kind), which mainly includes the following parts:

(a) wages, bonuses, allowances, subsidies and other types of labor income;

(2) Pensions, pensions, basic living expenses and various insurance benefits;

(3) Deposits, securities and interest;

(four) rent, dividends, transfer or sale of family property income;

(5) Maintenance, support and maintenance expenses that should be paid by the legal maintenance, support and maintenance obligor;

(6) Accepted inheritance and donated property;

(seven) other income as prescribed by the provincial civil affairs department. Eighth the following income, not included in the income of families applying for urban subsistence allowances:

(1) Awards and honorary allowances given by the government;

(2) Pensions, grants, preferential payments, nursing fees and health care fees received by the entitled groups according to relevant policies and regulations;

(three) subsidies given by the government and society to solve the difficulties of students in school;

(4) Temporary living assistance provided by social organizations and individuals;

(five) the housing provident fund and social insurance premiums paid by the employees in accordance with the regulations;

(six) the nursing expenses of the injured workers and the nursing expenses of the disabled educated youth who return to this city;

(seven) the one-child health care fund;

(eight) funeral grants and one-time pensions. Ninth families in any of the following circumstances, shall not enjoy the treatment of urban subsistence allowances:

(a) frequent access to high-end restaurants and entertainment places, and the daily consumption level of families is significantly higher than the local urban minimum living standard;

(2) Having high-grade consumer goods such as automobiles, motorcycles and air conditioners that are not necessary for basic life;

(3) Having investment behaviors such as buying and selling stocks;

(4) arranging funds for children to choose schools;

(five) the purchase of commercial housing for less than five years or high-grade decoration housing for less than three years;

(VI) Because the deposit amount is unclear and the hidden income cannot be verified, but the actual living standard of the family is obviously higher than the local urban minimum living standard, it is considered inappropriate to be included by the preliminary investigation of the neighborhood offices, town (township) people's governments or community neighborhood committees, enterprise trade unions and other preliminary units.

One of the following circumstances, shall not enjoy the treatment of urban subsistence allowances:

(a) have the ability to work within the age of employment, and have been recommended for employment twice by employment service agencies within one year without justifiable reasons;

(two) have the ability to work, but during the period of enjoying the urban minimum living allowance, do not participate in public welfare labor twice within one month without reason;

(three) because of drug abuse and gambling difficulties;

(4) Reeducation through labor and the period of serving a sentence.
