Provisions of Nanning Municipality on Smoking Control
Article 1 In order to reduce the harm of tobacco smoke, purify the sanitary environment in public places and workplaces, safeguard public health and improve the level of urban civilization, these Provisions are formulated in accordance with the relevant provisions of the Nanning Patriotic Health Regulations and in combination with the actual situation of this Municipality. Article 2 These Provisions shall apply to smoking control within the administrative area of this Municipality. Article 3 Smoking control in this Municipality follows the principles of government guidance, classified management and public participation. Article 4 patriotic health campaign committee is responsible for organizing the implementation of these Provisions, and guiding, coordinating and supervising patriotic health campaign committee and relevant departments in counties and cities to carry out smoking control.

Patriotic health campaign committee, county and city, is responsible for tobacco control within its jurisdiction. Fifth administrative departments in accordance with the principle of hierarchical management and the following division of responsibilities, responsible for the daily supervision and management of smoking control in relevant places, and punish acts in violation of these provisions:

(a) the administrative departments of education, human resources and social security are responsible for the control of smoking in the educational institutions and training institutions under their jurisdiction;

(two) the public security organs are responsible for the control of smoking in Internet service business premises and accommodation service premises;

(three) the civil affairs department is responsible for the control of smoking in social welfare institutions;

(four) the traffic administrative department is responsible for the control of smoking in urban public transport and related public places;

(five) the administrative department for Industry and commerce is responsible for the control of smoking in shopping malls and supermarkets;

(six) the food and drug supervision and management department is responsible for the control of smoking in catering service places;

(seven) the administrative department of culture, science and technology and sports is responsible for the control of smoking in cultural and artistic entertainment places, science and technology places and sports places;

(eight) the administrative department of health is responsible for the control of smoking in medical and health institutions, workplaces of state organs, social organizations and other social organizations and other public places other than those specified in items 1 to 7 of this article.

The municipal and county people's governments may, according to the actual needs of smoking control, adjust the duties of relevant departments to control smoking. Article 6 Smoking is prohibited in indoor and outdoor places in the following public places:

(a) nurseries, kindergartens, children's welfare homes, primary and secondary schools, secondary vocational schools, children's palaces, youth activity centers and other places where minors are concentrated;

(2) Maternal and child health care institutions and children's hospitals. Article 7 Smoking is prohibited in indoor places in the following public places:

(1) Teaching areas and canteens of institutions of higher learning and other educational and training institutions;

(2) Social welfare institutions;

(3) Business premises for Internet service;

(four) buses, taxis, urban rail vehicles, passenger ferries and other public transport vehicles and their ticket offices, waiting rooms and other related places;

(5) Shopping malls and supermarkets;

(six) hotels, restaurants and other catering service places;

(seven) libraries, museums, science and technology museums, exhibition halls, theaters, concert halls, art galleries and other scientific, cultural and artistic venues;

(eight) stadiums, gymnasiums and other sports venues;

(nine) public places of entertainment such as song (dance) halls and amusement halls (rooms);

(10) medical and health institutions. Article 8 Smoking is prohibited in indoor workplaces of state organs, enterprises and institutions, social organizations and other social organizations. Article 9 In other indoor public places and workplaces other than those designated as no-smoking places in these Provisions, operators or managers may implement a total ban on smoking; If smoking is not completely banned, designated smoking areas should be designated. Article 10 Smoking areas may be set up outside places or areas where smoking is prohibited. Setting up a smoking area shall comply with the following provisions:

(a) meet the requirements of fire safety and personal safety;

(two) away from crowded areas and pedestrians must pass through the channel;

(three) set up eye-catching smoking area signs and route guidance signs;

(four) set up ashtrays and other smoking-related appliances to keep the environment clean and hygienic;

(5) Do not use the same air conditioning system and ventilation system as the non-smoking area.

If the designated smoking area does not meet the requirements, the administrative department prescribed in Article 5 of these Provisions shall guide the operators or managers to correct it.

Operators or managers of public places that have designated smoking areas should strengthen the propaganda that smoking and tobacco smoke are harmful to health and gradually reduce and cancel smoking areas. Eleventh operators or managers of public places and workplaces should be fully responsible for the control of smoking in their own places and perform the following duties:

(1) Posting warnings and signs prohibiting smoking in prominent positions in places or areas where smoking is prohibited;

(2) Failing to install smoking-related appliances in places or areas where smoking is prohibited;

(three) to discourage, stop or ask people who smoke in places or areas where smoking is prohibited to leave; For those who do not listen to dissuasion, report to the administrative department as stipulated in Article 5 of these Provisions;

(four) establish and improve the smoking control management system, and train the staff to control smoking.
