Legal Analysis: According to the Opinions on Further Strengthening the Control of Plastic Pollution issued by the National Development and Reform Commission and the Ministry of Ecology and Environment, according to regulations, non-degradable disposable plastic straws are prohibited in the catering industry in China. Many large catering enterprises, including tea shops and coffee shops of various brands, no longer provide disposable plastic straws. Most of them are replaced with paper straws, some with biodegradable polylactic acid straws, and some with cups. Not only tea shops, fast food restaurants, baking coffee shops and other catering enterprises have also begun to use paper straws and polylactic acid degradable straws.

Legal basis: plastic products whose use is prohibited or restricted in Article 5 of the Opinions on Further Strengthening the Prevention and Control of Plastic Pollution. 1. Nondegradable plastic bag. By the end of 2020, the use of non-degradable plastic bags will be prohibited in shopping malls, supermarkets, pharmacies, bookstores and other places in the built-up areas of municipalities directly under the central government, provincial capital cities and cities with separate plans, as well as in catering packaging and take-away services and various exhibition activities, and the use of non-degradable plastic bags will be standardized and restricted in bazaars; By the end of 2022, the scope of implementation will be extended to all urban built-up areas above prefecture level and coastal counties built-up areas. By the end of 2025, the use of non-degradable plastic bags will be banned in the markets in the above areas. Encourage qualified places to stop using non-degradable plastic bags in urban-rural fringe, urban and rural markets. 2. Disposable plastic tableware. Before the end of 2020, the use of non-degradable disposable plastic straws is prohibited in the catering industry nationwide; Non-degradable disposable plastic tableware is prohibited in catering services in built-up areas and scenic spots of cities above prefecture level. Before the end of 2022, non-degradable disposable plastic tableware is prohibited in catering services in built-up areas and scenic spots in counties. By 2025, the consumption intensity of non-degradable disposable plastic tableware in the field of food and beverage takeout in cities above prefecture level will drop by 30%. 3. Disposable plastic products for hotels and restaurants. Before the end of 2022, star-rated hotels, hotels and other places in China will no longer provide disposable plastic products, but can provide related services by setting up self-service buying machines and providing refillable detergents. By the end of 2025, the scope of implementation will be extended to all hotels, hotels and homestays. 4. Express plastic packaging. By the end of 2022, postal express outlets in Beijing, Shanghai, Jiangsu, Zhejiang, Fujian, Guangdong and other provinces and cities will first ban the use of non-degradable plastic packaging bags and disposable plastic woven bags to reduce the use of non-degradable plastic tapes. By the end of 2025, the use of non-degradable plastic packaging bags, plastic tapes and disposable plastic woven bags will be prohibited in postal express outlets across the country.
