Kitchen Contract

Party A:

Article I; contract form

Party B contracted to the kitchen of the Party's work as follows:

Article 3 Contracting Treatment

1, the contractor's salary

Article 4: Responsibility and authority of Party A

1 Responsibility

1), Responsible for Party B's kitchen work to provide the necessary and complete hardware equipment, facilities and utensils, items and other material conditions and operating environment to ensure the smooth progress of Party B's work.

2), is responsible for the kitchen catering food processing and production of all raw materials timely procurement and supply.

3), is responsible for the relevant agreements in accordance with this contract, on time, full settlement and issuance of Party B's full salary and related treatment.

4) Responsible for providing Party B's chef with working meals and accommodation according to the relevant agreements of this contract.

5] Responsible for the medical expenses in case of accidental injury to Party B's personnel in the course of operation.

2. Power

1) Party A has the right to supervise and manage the behavior of Party B's personnel during their working period in Party A in accordance with the relevant systems of the company and the relevant provisions of this contract, and put forward opinions on the handling of criticisms, notices, warnings, penalties, punishment and so on, and supervise Party B's executive chef and so on to implement them.

2), Party A management personnel ( ), is the direct management of the kitchen work of the superiors, the right to the kitchen and the restaurant's integrated management and unified management of the organization, coordination, guidance and leadership.

3), Party A has the right to Party B's executive chef's work and the overall work of the kitchen, including safety, hygiene, product and service quality, efficiency and management level, etc., to carry out supervision and inspection and assessment before the assessment, on the work of the problems that do exist, the right to put forward criticism, suggestions and require Party B to improve within a limited time.

Article V. Party B's responsibility, power

4), Party B has the right to suggest and participate in the pricing of catering food, and at the same time, has the right to make suggestions on the restaurant in terms of service, management and sales of catering food.

2. Responsibility

1), Party B staff must strictly abide by the national, local and the Company and the catering industry's relevant laws, policies and regulations. Otherwise, all legal and economic and collateral responsibilities arising therefrom shall be their own responsibility and liability.

2), Party B personnel in Party A during the work period, must recognize, receive and strictly abide by the provisions of Party A's "Employee Handbook" and Party A's relevant management system, to comply with the Party's leadership and management, and to actively carry out and complete the scheduled work plan and task indicators.

3) Responsible for the overall management of the internal work of the kitchen of Party A Mengfei Hotel, including:

① Responsible for the kitchen personnel, labor and administrative management. Including the kitchen work must establish and improve the management rules and regulations, personnel, job preparation and the corresponding responsibility for the development of the recruitment and dismissal of staff, staff performance appraisal and salary treatment and distribution program development and other management work.

② responsible for the "Dreamfly Hotel" menu planning and design, the main food and beverage food research and development and processing production, as well as the corresponding workflow and technology, quality standards, health and cost control and other aspects of management.

③Responsible for kitchen personnel, equipment and facilities and food (including raw materials, semi-finished products and finished products) safety management.

4) actively assist and cooperate with the restaurant staff (including management and service personnel, sales staff, etc.), research and development of the overall program of food and beverage operations, *** with the restaurant and the kitchen to do a good job of integrated management and unified management of related work.

5) Ensure that the quality and speed of production, timely and properly deal with the process of customer service and kitchen-related work matters.

6) Party B should control the gross margin of catering food within 40%-45%.

7) Party B shall be responsible for the confidentiality of all business information and secrets related to Party A's operation and management that Party B is aware of during the working period.

8) Party B should ensure that the monthly launch of new food and beverage (dishes, snacks, etc.).

9) Party B to replace the main chef needs to be discussed with Party A in advance, with the consent of Party A can be replaced.

Article 7 Management of raw materials

Party A is responsible for the purchase and supply of raw materials, and Party B is responsible for the quality and acceptance of raw materials. Party B can not specify the suppliers of materials, if Party B is found to collude with the raw material suppliers to the detriment of Party A's interests, the losses brought to Party A shall be borne by Party B.

Party A is responsible for the procurement and supply of raw materials.

Article VIII Contract Modification

The contract in the process of implementation, by mutual consensus, the relevant provisions can be modified, but the original provisions are still valid before the modified provisions come into effect.

Article 10: Cancellation, Termination and Renewal of Contract

2 Under normal circumstances, if either party wants to terminate this contract in advance

20 days in advance, it should submit a written notice to the other party so as to allow the other party to arrange for the aftermath of the matter.

1) If Party B now proposes to terminate this contract, it must at least hire a new `kitchen staff

and then leave the store. Otherwise, you shall bear all the economic losses and joint and several liabilities caused to Party A by leaving the store early.

2) If Party B, in the kitchen work, can not guarantee the quality of dishes, can not do

good varieties of dishes, and can not do a good job of cost control and other work in any of the circumstances, Party A needs to be one month in advance to inform Party B

3) Whether it is the expiration of the term of the present contract, and the two sides failed to renew a new contract, or any other cause of the contract, Party B will not have to pay the cost of the contract. Whether it is the expiration of this contract and the two parties fail to renew the new contract, or any other circumstances leading to the termination of this contract, both parties shall do the relevant work and transfer of all financial and economic formalities in a timely and proper manner within the agreed period of time, and clean up the work. Otherwise, the economic losses caused by this to the other party shall be fully borne by the responsibility repeatedly.

Article 9 Liability for breach of contract

3 Either party failing to fulfill and breaching the responsibilities and obligations agreed in this contract shall bear the full liability for breach of contract to the other party according to

the provisions of this contract, including the corresponding joint and several liability for economic losses.

5 The liability for breach of contract under the circumstances not covered in the preceding paragraph shall be dealt with in accordance with the relevant regulations and policies of the State

and the relevant rules and regulations of Party A's enterprise recognized by both parties, or by mutual consultation. If the negotiation fails, either party may apply to the arbitration organization for a decision.

3, A and B parties without reason to terminate the contract, shall pay the other party one month liquidated damages.

Article 11 Outstanding Matters

The outstanding matters of this contract shall be resolved through consultation between the two parties, and the opinions reached in the consultation can be signed a new supplemental contract, the supplemental contract as an annex to this contract, and this contract has the same legal effect.

Article 12

This contract shall be signed in duplicate, one for each party, and shall be validly signed and sealed by both parties.
