Article 2 Scope of Application These Provisions shall apply to the planning, site selection, construction, operation, management and related activities of cruise ship marinas within the administrative area of this Municipality and outside the port area.
Port area refers to the area under the jurisdiction of Qinhuangdao Port. The yacht marina in the port area is managed in accordance with the Law of the People's Republic of China on Ports, the Port Regulations of Hebei Province and the relevant regulations of the Ministry of Transport. Article 3 Concept Interpretation The term "cruise ship yacht" as mentioned in these Provisions refers to all kinds of passenger ships, yachts, speedboats and sightseeing boats used for tourism, entertainment and leisure.
Cruise Yacht Wharf refers to all kinds of fixed wharves and floating wharves, which are composed of a certain water area and related land areas, and have corresponding wharves and supporting facilities, and are used for entering and leaving, parking, berthing and getting people up and down. Article 4 The competent department of marine fisheries of the city shall be responsible for the management of cruise ships and yachts in the whole city.
the marine fishery administrative department of each county (district) or the department determined by the county (district) government (hereinafter collectively referred to as the county (district) administrative department) is responsible for the management of cruise ship marinas within their respective administrative areas.
The counties (districts) mentioned in the preceding paragraph include Qinhuangdao Economic and Technological Development Zone and Beidaihe New District. Article 5 Departmental Duties Departments and units at all levels, such as development and reform, natural resources and planning, tourism, water affairs, ecological environment, administrative examination and approval, public security, emergency management, fire rescue, housing and urban and rural construction, urban management, market supervision, sports, maritime affairs, etc., shall, according to their respective responsibilities, do a good job in the management of cruise ships and yachts. Chapter II Site Selection and Construction of Wharf Article 6 Site Selection Planning The municipal department in charge of marine fisheries shall, according to the needs of the construction and development of cruise yacht marina, organize the preparation of cruise yacht marina planning, which shall be linked and coordinated with the national spatial planning, marine ecological red line, river basin flood control planning, regional water conservancy planning, urban flood control planning and other relevant planning as stipulated by laws and administrative regulations, and conform to the provisions on the protection and management of military facilities. Article 7 Site Selection Requirements The site selection of cruise ship marina shall be determined in accordance with the planning of cruise ship marina, combined with sea resources, shoreline resources, tourism resources, land traffic conditions, maritime traffic conditions, etc., with scientific site selection, reasonable distribution and overall planning. Article 8 Site Selection Procedure When building, rebuilding or expanding a cruise yacht wharf, the wharf construction unit shall solicit the opinions of the county (district) competent department in writing on the site selection of the proposed wharf. The written materials shall include the basic situation of the construction unit, the location and surrounding conditions of the proposed site, the scale, purpose, structural type, cost estimation, operation mode, benefit analysis and other necessary information of the proposed terminal.
after receiving the written materials, the competent department of the county (district) where it is located shall put forward the preliminary examination opinions and report them to the competent department of marine fisheries of the city with the consent of the local county (district) government. The municipal department in charge of marine fisheries shall make an opinion on whether to agree to the proposed site, and if it agrees to the proposed site, the construction unit shall carry out the construction according to the prescribed procedures; Do not agree with the proposed site selection, the construction unit may choose another site and re-solicit opinions. Article 9 Where the use of the sea requires the construction, renovation and expansion of cruise ship marinas for reclamation or the construction of offshore structures, the construction unit shall carry out marine environmental impact assessment and sea area use demonstration according to law. After the evaluation and demonstration are passed, the procedures for using the sea shall be handled and obtained according to the prescribed procedures.

Tenth river management requirements strictly control the construction of cruise ships and yachts in rivers and estuaries. New construction, renovation and expansion of cruise ship marinas within the scope of river management shall go through the licensing procedures for river-related construction projects in accordance with the law, and go through the commencement procedures after examination and approval by the administrative examination and approval department in accordance with the river management authority. Article 11 Construction Procedures New construction, renovation and expansion of cruise ship marinas shall comply with the basic construction procedures stipulated by the state, go through the procedures of project initiation, preliminary design and construction drawing design approval, quality supervision and so on according to the management authority, and conform to the relevant national design specifications and technical standards.

Article 12 Safety and environmental protection requires that the safety facilities and environmental protection facilities of the newly built, rebuilt and expanded cruise ship marina must be designed, constructed and put into use at the same time as the main project.

Supporting the construction of ship pollutant receiving facilities, and the garbage generated by cruise ships and yachts shall be collected, stored and transported to the domestic garbage collection and transportation facilities designated by the urban management department of the jurisdiction, and transported to the specified garbage disposal sites by the urban management department of the jurisdiction or qualified transportation units; Domestic sewage, oily sewage, etc. should be discharged after reaching the standard according to the regulations, or be received by qualified receiving units and transported to disposal sites that meet the requirements.
the laying of water, electricity, communication and other pipelines of the wharf shall be designed and constructed synchronously with the main structure of the wharf according to the design codes and standards of the wharf. Article 13 Acceptance Provisions After the completion of the construction of the cruise ship marina project, the construction unit shall carry out the completion acceptance and completion acceptance in accordance with the relevant provisions of the state. Only after passing the inspection can it be put into use.
upon completion acceptance, an on-site inspection team shall be established to conduct on-site inspection of the project. Specific verification requirements shall be formulated and published by the municipal marine fishery administrative department.
the construction unit shall, within 15 days after the completion and acceptance of the project, report the materials for the completion and acceptance of the project to the competent department of marine fisheries of the city, and the competent department of marine fisheries of the city will announce them to the public, and inform the maritime department of the technical standards of wharf navigation and other information.
