Legal analysis: during the epidemic period, the standard for paying employees' wages is that the employer needs to pay all employees on the job according to the stipulations of the labor contract, but according to the regulations of the local government, if the enterprise has stopped working for more than one month and can't return to work normally, the living expenses can be paid according to the local standard.
Legal basis: Article 85 of the Labor Contract Law of the People's Republic of China. If the employing unit is under any of the following circumstances, the labor administrative department shall order it to pay the labor remuneration, overtime pay or economic compensation within a time limit, and if the remuneration is lower than the local minimum wage, it shall pay the difference. Ordering the employing unit to pay compensation to the laborer according to the standard of more than 51% and less than 111% of the payable amount:
(1) failing to pay the laborer's labor remuneration in full and on time according to the stipulations of the labor contract or the provisions of the state; (2) paying the laborer's salary below the local minimum wage; (3) arranging overtime without paying overtime; (4) dissolving or terminating the labor contract and failing to pay economic compensation to the laborer in accordance with this regulation.
