chapter I general provisions article 1 these regulations are formulated in accordance with the relevant laws and regulations of the state and the actual situation of this municipality in order to strengthen the management of the tourism industry, protect and rationally develop tourism resources, safeguard the legitimate rights and interests of tourists and tour operators, establish a unified, open, competitive and orderly tourism market and promote the development of tourism. Article 2 Anyone who engages in tourism, tourism operation and management activities within the administrative area of this Municipality shall abide by these regulations.
the tourism industry as mentioned in these regulations refers to a comprehensive service industry that provides services for travel and sightseeing with tourism resources as the carrier and tourism facilities as the condition.
the term "tour operators" as mentioned in these regulations refers to units and individuals that operate travel agencies, tourist hotels and other tourism businesses. Article 3 The people's governments of cities and districts (cities) and counties shall, based on local conditions, bring tourism into the national economic and social development plan and promote the development of tourism in this region. Article 4 The people's governments of cities and districts (cities) and counties shall establish a tourism coordination system, regularly solve major problems in tourism management in this region, and make the tourism industry develop in harmony with other related industries.
The relevant administrative departments of this Municipality shall, according to their respective responsibilities, strengthen the coordinated management of the tourism market under the unified leadership of the Municipal People's Government. Article 5 The tourism industry in this Municipality shall implement a system of unified leadership and hierarchical management. Chongqing Tourism Bureau is the tourism administrative department of the Municipal People's Government, which implements the industry management of the city's tourism industry. Its main responsibilities are:
(1) to implement the national laws, regulations, guidelines and policies on tourism;
(2) to work out the long-term planning and annual implementation plan of the city's tourism development, and to study, guide and coordinate the development and utilization of tourism resources;
(3) to be responsible for the guidance, supervision, coordination and management of the city's tourism industry;
(4) organizing foreign tourism promotion and opening up international and domestic tourist markets;
(5) To be responsible for the education and training of talents in the tourism industry and the grading of technical services for employees, and to guide the academic activities of tourism in the whole city;
(6) to undertake the examination and management of foreign-related affairs in tourism;
(7) responsible for the examination and approval and annual inspection of tourism business qualifications;
(8) accepting complaints from domestic and foreign tourists, and handling complaint cases in accordance with the law or jointly with public security, industry and commerce, price and health departments;
(9) to guide the work of tourism safety in conjunction with relevant departments;
(11) to undertake other tasks assigned by the municipal government. Article 6 The tourism administrative departments of districts (cities) and counties established according to the needs of tourism development shall, under the guidance of the people's government at the same level and the municipal tourism administrative department, implement industry management of tourism within their respective jurisdictions according to the division of responsibilities. Chapter II Protection, Development and Utilization of Tourism Resources Article 7 The people's governments of cities and districts (cities) and counties shall adhere to the principle of "unified planning, planned development and utilization, and multi-channel fund raising", protect and rationally develop and utilize tourism resources, and protect historical relics, scenic spots and natural resources according to law.
the tourism resources mentioned in these regulations refer to all kinds of natural landscapes and human landscapes that are attractive to tourists, can be developed and utilized for the development of tourism, and can generate operational, environmental and social benefits. Article 8 The funds needed for the protection, development and utilization of tourism resources shall be raised in the following ways, and the specific measures shall be formulated by the Municipal People's Government.
(1) funds used by governments at all levels for the protection, development and utilization of tourism resources;
(2) related matching funds for construction projects of relevant departments;
(3) Establish a tourism development fund according to relevant national and provincial regulations;
(4) encourage units and individuals and foreign businessmen, overseas Chinese and compatriots from Hong Kong, Macao and Taiwan to invest in the development and construction of tourism resources.
the funds for the protection, development and utilization of tourism resources should be used for special purposes and shall not be used for other purposes. Article 9 The development of tourism resources must be coordinated with the protection of ecological environment, and the construction of tourism facilities that have an impact on the ecological environment should be designed, constructed and put into use at the same time as the construction of environmental protection facilities.
the construction of tourist facilities must meet the requirements of national territory planning, overall urban planning and scenic spot planning, and the construction scale and style should be coordinated with the surrounding environment, so as to suit local conditions and highlight characteristics.
before the construction of a tourism project, the construction unit shall solicit written opinions from the tourism administrative department.
construction projects in scenic spots should also be handled in accordance with the regulations on the administration of scenic spots in Sichuan province. Article 11 To protect tourism resources, it is forbidden to carry out any activities that damage tourism resources and change the topography and landforms of tourist attractions in tourist areas.
in the tourist area, no unit or individual is allowed to cut mountains, quarry, dig sand, mine, build graves, cut trees and hunt wild animals without approval. Eleventh city and district (city) county tourism administrative departments should do a good job in the survey and evaluation of tourism resources within their respective jurisdictions, formulate plans for the protection, development and utilization of tourism resources, and submit them for approval according to the prescribed procedures. Chapter III Tourism Operation and Management Section 1 General Provisions Article 12 The operation of tourism business (including accommodation, catering, shopping, entertainment, health care, travel, etc.) shall be examined and approved by the municipal tourism administrative department, and the Travel Agency Business License or Tourism Business License shall be obtained, and the local administrative department for industry and commerce shall approve and register it, and then the tourism business can be operated.
No unit or individual may forge, alter, sell or transfer the Travel Agency Business License or the Tourism Business License.
