Article 35 The state implements a licensing system for food production and operation. Engaged in food production, food sales, food service, shall obtain a license in accordance with the law. However, the sale of edible agricultural products is not required to obtain a license.

Local people's governments above the county level food safety supervision and management departments shall, in accordance with the provisions of the "Chinese People's **** and the State Administrative Licensing Law", the review of the applicant's submission of the first paragraph of Article 33, paragraph 1 of this law, the first to the fourth item of the requirements of the relevant information, when necessary, the applicant's production and operation of the premises for on-site verification; meet the prescribed conditions, the permit is granted; do not meet the prescribed conditions

"Food Production License Management Measures" in the provisions:

Article 4 of the food production license to implement the principle of one enterprise one license, that is, the same food producers engaged in food production activities, should obtain a food production license.

Article 10 The application for food production permit, should first obtain a business license and other legal qualifications.

Article 18 of the local food and drug supervision and management departments at or above the county level on the applicant's application for a food production license, shall be dealt with in accordance with the following:

(a) the application does not need to obtain a food production license according to law, the applicant shall be informed immediately inadmissible.

(B) the application does not belong to the food and drug supervision and management department's terms of reference, shall immediately make a decision of inadmissibility, and inform the applicant to the relevant administrative organs.
