What is the purpose of requiring a certificate of separation from the original company when joining a company?
When a worker joins a company, he or she is required to provide a certificate of separation from the original company in order to prove that he or she has not left the original company before, and that he or she has performed well during the period of separation.

Separation certificate is a written proof of the termination of the labor relationship between the employer and the worker, and it is a written document that must be issued by the employer and the worker after the termination of the labor relationship.

China's current laws do not yet have complete and clear provisions on the employer to issue a certificate of termination or termination of labor contract, only in 1999 the State Council announced the "Regulations on Unemployment Insurance" from the point of view of the registration of unemployment insurance, enjoyment of unemployment insurance treatment, urban enterprises and institutions should be issued in a timely manner for the unemployed to terminate or dissolve the labor relationship certificate. Article 99 of the Labor Law stipulates that if an employer recruits a worker whose labor contract has not yet been terminated and causes economic loss to the original employer, that employer shall be jointly and severally liable for compensation in accordance with the law. This has given rise to social debate and calls for workers to be required to hold a certificate of separation for re-employment, and for the original employer to issue a certificate of separation for the worker. Drawing on international experience, and in order to safeguard the order of the labor market and the rights and interests of workers, this law clarifies the legal obligation of the employer to issue a certificate of termination of the labor contract.

The departing employee may apply to the Human Resources Department to fill out a certificate of separation, which is issued by the Human Resources Department to certify only the date of employment, the position of the departing employee, and the reason for his/her departure. Generally, employees who are dismissed are issued a certificate of dismissal and not a certificate of separation.

Because the certificate of separation does not have a definite place of delivery, it is not necessary to write the name and address of the addressee, but only the date on which the certificate is issued.

The purpose of the separation certificate:

1, to prove that the employer and the worker have terminated the labor relationship;

2, to prove that in accordance with the normal procedures for the separation;

3, to prove that it is a free man, you can apply for unemployment benefits or to apply for a new position;

4, you can use this to transfer the laborer's personnel relations, social security, provident fund and so on.
