Food-related laws, regulations and policies
The laws, regulations and policies related to food are as follows:

1, food safety supervision and management departments should focus on the traceability system construction of foods with high food safety risks or large sales volume, such as infant formula foods;

2. The health administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, in accordance with the provisions of Article 29 of the Food Safety Law, formulate local standards for food safety and publicly solicit opinions. The health administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, within 30 working days from the date of publication of local food safety standards, report the local standards to the health administrative department of the State Council for the record. If the health administrative department of the State Council finds that the local food safety standards for record violate laws, regulations or national food safety standards, it shall promptly correct them;

3. Special foods such as health food, formula food for special medical purposes and formula food for infants and young children do not belong to local specialty foods, and local food safety standards shall not be formulated for them;

4. After the publication of food safety standards, food producers and operators can implement them in advance and publicly before the implementation date of food safety standards;

5. Food production enterprises shall not formulate enterprise standards lower than the requirements of national or local food safety standards. Food production enterprises shall report to the health administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government for the record when formulating enterprise standards whose food safety indicators are stricter than the national or local food safety standards;

6. The validity period of the food production and operation license is 5 years;

7. If the production and operation conditions of food producers and operators change and no longer meet the requirements of food production and operation, food producers and operators shall immediately take corrective measures; If it is necessary to go through the licensing procedures again, it shall be handled according to law;

8. The administrative department of health of the State Council shall promptly publish the catalogue of new varieties of food raw materials, new varieties of food additives, new varieties of food-related products and applicable national food safety standards.

Whoever engages in the following activities within the territory of People's Republic of China (PRC) shall abide by this Law:

1, food production and processing hereinafter referred to as food production, food circulation and catering services hereinafter referred to as food management;

2. Production and management of food additives

3. Packaging materials, containers, detergents, disinfectants and tools and equipment used in food production and operation are hereinafter collectively referred to as the production and operation of food-related products.

4. Food producers and operators use food additives and food-related products;

Safety management of food, food additives and food-related products.

To sum up, food producers and operators should establish a food safety traceability system, and truthfully record and save information such as incoming inspection, ex-factory inspection and food sales in accordance with the provisions of the Food Safety Law to ensure food traceability.

Whoever engages in the following activities within the territory of People's Republic of China (PRC) shall abide by this Law:

(a) food production and processing (hereinafter referred to as food production), food sales and catering services (hereinafter referred to as food business);

(2) Production and operation of food additives;

(3) Production and operation of packaging materials, containers, detergents and disinfectants for food and tools and equipment for food production and operation (hereinafter referred to as food-related products);

(four) the use of food additives and food-related products by food producers and operators;

(5) Storage and transportation of food;

(6) Safety management of food, food additives and food-related products.

The quality and safety management of edible agricultural products (hereinafter referred to as edible agricultural products) shall comply with the provisions of the Law of People's Republic of China (PRC) on the Quality and Safety of Agricultural Products. However, the sales of edible agricultural products, the formulation of relevant quality and safety standards, the publication of relevant safety information and the provisions of this law on agricultural inputs shall abide by the provisions of this law.
