Legal analysis: food producers and operators engaged in food production, food sales and catering services should obtain permission according to law. However, the sale of edible agricultural products does not require a license. The Food Production and Business License shall be uniformly issued by the food and drug supervision and administration department. The food and drug supervision and administration department shall, in accordance with the implementation procedures stipulated in the Administrative Licensing Law, examine the materials submitted by the applicant, and in principle, make a licensing decision within 20 days. The applicant shall submit relevant materials, indicating that the applicant has the conditions to engage in food production and operation. When the food and drug supervision and administration department deems it necessary, it may conduct on-site inspection of the applicant's production and business premises to verify the substantive contents of the application materials. After reviewing the above materials, the food and drug supervision and administration department considers that the applicant meets the conditions stipulated by laws and regulations, and shall grant an administrative license and issue a license. If it does not meet the prescribed conditions, it shall decide not to grant the license and explain the reasons, which shall be in written form.

Legal basis: Article 13 of the Measures for the Administration of Catering Service Licensing. After accepting the application materials submitted by the applicant, the food and drug supervision and administration department shall examine the relevant materials submitted by the applicant in accordance with the provisions of Article 10 of these Measures, and conduct on-site inspection of the applicant's catering service business premises. The food and drug supervision and administration department at a higher level may entrust the food and drug supervision and administration department at a lower level to conduct on-site verification of the catering service license application.
