Measures of Qingdao Municipality on Implementing the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution
Article 1 In order to implement the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution (hereinafter referred to as the Law on the Prevention and Control of Air Pollution), these Measures are formulated in light of the actual situation of our city. Article 2 These Measures shall apply to the administrative area of Qingdao. Article 3 People's governments at all levels must strictly implement the Law on the Prevention and Control of Air Pollution and these Measures, strengthen scientific research on the prevention and control of air pollution, rationally plan the industrial layout, and incorporate the prevention and control of air pollution into the national economic and social development plan. Article 4 The environmental protection department of the Municipal People's Government is the organ that exercises unified supervision and management over the prevention and control of air pollution.

The environmental protection departments of the people's governments of cities, county-level cities and districts shall supervise and manage the prevention and control of air pollution according to their management authority.

The environmental protection assistant of the township (town) people's government shall supervise and inspect the air pollution in this area.

Public security, transportation, railways, harbour superintendency administration (including harbour superintendency administration), fishery administration and other departments shall, according to their respective functions and duties, supervise and manage the air pollution caused by motor vehicles and vessels. Article 5 The management or evaluation of atmospheric environment shall be carried out in accordance with the National Atmospheric Environment Quality Standard. Items that are not included in the atmospheric environmental quality standards shall be implemented in accordance with the provisions of the National Hygienic Standard for the Design of Industrial Enterprises on the maximum allowable concentration of harmful substances in the atmosphere of residential areas. Article 6 People's governments at all levels shall strengthen the comprehensive improvement of atmospheric environment, develop central heating and urban pipeline gas and liquefied gas in Shinan District, Shibei District, sifang district District, Licang District and other county-level cities and districts, popularize the use of briquette, and build smoke control areas.

City and county (city) urban areas of the old city reconstruction and new district construction, should implement central heating. Advocate enterprises and institutions to implement central heating for employees' houses. Boilers shall not be installed dispersedly in the built central heating area. Seventh new construction, expansion, renovation and technical transformation of construction projects that discharge pollutants into the atmosphere must go through the examination and approval procedures at the environmental protection department in accordance with the relevant provisions of the state. The combustion equipment (boilers, kilns, tea stoves, public and business stoves) in the project shall be examined and approved separately. Without examination and approval, no construction is allowed. Eighth in the scenic spots approved by the State Council, industrial production facilities that pollute the environment shall not be built; Construction of other facilities, the pollutant discharge shall not exceed the prescribed emission standards. Facilities that have been built before the implementation of the Law on the Prevention and Control of Air Pollution shall be treated within a time limit if their pollutant discharge exceeds the prescribed discharge standards. Article 9 Units that discharge or leak toxic and harmful gases and radioactive substances due to accidents or other unexpected events, which cause or may cause air pollution accidents and endanger human health, must immediately take emergency measures to prevent and control air pollution hazards, and notify the units and residents who may be harmed by air pollution.

Units that have air pollution accidents must report to the environmental protection department within one hour after the accident is discovered, and report the details within seven days after the accident and accept the investigation and handling. Article 10 Where production facilities and experimental devices discharge dusty gases and toxic and harmful substances into the atmosphere, the national industrial "three wastes" emission trial standards shall be implemented before the new standards are promulgated by the state and the province.

The height of exhaust pipes for discharging pollutants from production facilities and experimental devices shall meet the national standards. When there are civil and public buildings within the radius of 100 meters around the vent, the height of the vent should be more than three meters higher than the tallest building. Eleventh power plant boiler smoke emissions should be implemented in the national industrial "three wastes" emission pilot standards. Smoke emission and chimney height of other boilers should meet the national standards for smoke emission of boilers. The maximum allowable smoke blackness shall be limited to Ringelmann blackness III within 30 minutes of boiler ignition and within 5 minutes of ignition/kloc-0.

Before the national and provincial emission standards are issued, the smoke blackness of kilns, tea stoves, public and business stoves shall be implemented according to the provisions of Table 1 in the national boiler smoke emission standards.

The chimney height of the new kiln shall be implemented in accordance with the provisions of the attached table 1 of these measures. Chimneys of tea stoves, public and commercial stoves should be higher than adjacent buildings. Twelfth production facilities, experimental devices and combustion equipment discharge pollutants into the atmosphere and exceed the standard, and the sewage charges exceeding the standard shall be levied according to the provisions of the "Implementation Measures for the Collection of Sewage Charges in Shandong Province".

If the combustion equipment exceeds the standard value of smoke and dust emission in the applicable area, the sewage charges for excessive smoke and dust shall be levied according to the standards in Schedule 2 of these Measures. Thirteenth new construction, expansion, reconstruction and technical transformation of coal-fired boilers and kilns, conditions should be equipped with desulfurization devices to reduce sulfur dioxide emissions. Fourteenth combustion equipment that exceeds the smoke emission standard should improve the combustion mode within a time limit and choose advanced smoke and dust removal equipment.

The boiler with evaporation capacity of 1 ton/hour must adopt mechanical combustion.

Oil-fired boilers and kilns should be operated mechanically and automatically, using high-pressure atomization or other advanced burners. Fifteenth the use of various smoke and dust removal equipment, due to damage, failure or low dust removal efficiency, resulting in excessive emission of smoke and dust, should be repaired or replaced immediately.

Don't violate the operating rules of combustion equipment to make its smoke exceed the standard. Article 16 In Shinan District, Shibei District, sifang district District, Licang District and other county-level cities and districts, urban combustion equipment (except power station boilers) with smoke blackness above Ringelmann Blackness III and smoke emission concentration above 800 mg/m3 shall be treated within a time limit.
