It is legal for the company to outsource employees. If there is any dispute, it should be handled by the company's superior. It is not illegal for a company to have the qualification to operate labor dispatch business, obtain administrative license, handle the corresponding company registration, sign an outsourcing contract with employees according to law, and faithfully and reasonably perform the obligations stipulated in the outsourcing contract according to law. If the parties fail to reach an agreement through consultation, they may request the relevant institutions to mediate. For example, if one or both parties are state-owned enterprises, they can seek mediation from higher authorities.
Labor Contract Law
Article 60 A labor dispatch unit shall inform the dispatched workers of the contents of the labor dispatch agreement. The labor dispatch unit shall not deduct the labor remuneration paid by the employing unit to the dispatched workers according to the labor dispatch agreement. Labor dispatch units and employing units shall not charge the dispatched workers.
