1. Registration in the name of a company: copy of business license and trademark pattern
2. Registration in the name of an individual: copy of ID card, copy of business license of individual industrial and commercial households (required) and trademark pattern
3. Other applicants: copy of passport provided by foreigners; Hong Kong, Macao and Taiwan residents to provide valid identification documents (passport, ID card, home visit permit); Hong Kong companies need to provide company registration certificate and business registration certificate.
second, the procedure of trademark registration
the procedure of trademark registration is divided into three steps.
step 1: query and analysis; ① choose your own trademark (such as Chinese/English/graphics) and confirm which products or services you want to register on (in order to avoid the trademark being rejected by the Trademark Office because it is similar to others, inquiry is an essential link)
② Our company determines the category of the product according to the name provided by the applicant, and then makes an inquiry through the system of the Trademark Office. If the same or similar trademarks are found, our company will make a good suggestion according to the inquiry; If it is found that there is no identical and similar trademark, the applicant can prepare for the application of the trademark.
step 2: determine the design of the trademark;
step 3: apply for registration.
① application stage: submit the documents (before 4:31 pm) → report to the Trademark Office on the same day → get a receipt from the Trademark Office the next day;
② formal acceptance and examination stage: formal examination passed → the Trademark Office issued an acceptance notice → substantive examination;
③ announcement and registration stage: substantive examination passed → preliminary examination announcement → registration announcement → registration certificate issued by the Trademark Office.
when the formalities are complete and submitted before 4pm, we will report it to the State Trademark Office on the same day. Because the principle of prior application is implemented in trademark registration in China (please apply for the trademark as early as possible and keep it confidential to avoid being squatted by others), the establishment of the application date is very important for the success of trademark registration. If someone else applies one day earlier, your creativity or huge investment in the brand in the early stage will be wasted.
III. Time of trademark registration
1. After entering the Trademark Office, it is divided into two parts: the first part is a formal review, which takes about 21 days. If it passes the review, a Notice of Trademark Acceptance will be issued, and relevant application information can be found on China Trademark Network; The second part is waiting for substantive examination, about 6 months;
2. After passing the substantive examination, enter the announcement period of preliminary examination, and the announcement period is 3 months;
3. The approval announcement period is 1 months, and a trademark certificate will be issued.
